Michael Jackson Mug Shot: Charges, 2005 Trial, and Acquittal

Michael Jackson’s mugshot was taken on November 20, 2003, at the Santa Barbara County jail after he surrendered on child molestation charges brought by the family of a 13-year-old boy. He posted a $3 million bond, left within the hour, and was ultimately acquitted of all charges at trial in June 2005.¹²

The Day the Photo Was Taken

Two days before the booking, on November 18, 2003, Santa Barbara County sheriff’s deputies executed a search warrant at Neverland Ranch and other Southern California locations, looking for evidence to corroborate the accuser’s statements.³ An arrest warrant followed on November 19.⁴

Jackson’s attorneys spent more than a day negotiating the terms of his surrender. On the morning of November 20 he flew from Las Vegas to Santa Barbara on a private Gulfstream jet, arriving around noon. He was arrested at the airport and driven to the jail in handcuffs, wearing a black suit with his hands cuffed behind his back.¹⁵

Booking took roughly 30 to 40 minutes. He was fingerprinted, photographed, and required to surrender his passport.¹ The booking record captured the standard identifying information: height, weight, race, hair color, eye color, and sex.⁶ After posting a $3 million bond, Jackson left the jail in a limousine and flew back to Las Vegas the same day.

The Charges Behind the Booking

Jackson was initially booked on suspicion of multiple counts of child molestation. Formal charges came on December 18, 2003: seven counts of child molestation and two counts of administering an intoxicating agent for the purpose of committing a felony.⁷ A grand jury later returned a 10-count indictment adding conspiracy charges tied to child abduction, false imprisonment, and extortion.⁸ By trial, the count had reached 14, covering child molestation, conspiracy, false imprisonment, and providing alcohol to a minor.⁹

The accuser was Gavin Arvizo, a 13-year-old cancer patient who said Jackson had molested him on two occasions at Neverland Ranch in 2003 and given him and his brother alcohol.¹⁰ Gavin’s younger brother, Star, provided corroborating testimony.¹¹ The prosecution also drew heavily on a 2003 Martin Bashir documentary, “Living with Michael Jackson,” which showed Jackson holding hands with Arvizo and acknowledging that he shared his bed with young boys.

The Neverland search yielded materials that later became trial exhibits. Investigators found a bedroom suite with a combination-keypad lock and a loft containing a king-size bed. A briefcase in the master bathroom contained pornographic magazines and videos, some of which carried fingerprints from both Jackson and the Arvizo brothers. A locked file cabinet held two coffee-table photography books that prosecutors would later present as possible grooming tools; the defense called them art books. No child pornography was recovered.¹²

The 2005 Trial and Acquittal

People v. Jackson went to trial at the Santa Barbara County Courthouse in Santa Maria in late February 2005. It ran 14 weeks and drew testimony from more than 130 witnesses.¹³

District Attorney Tom Sneddon told jurors Jackson had subjected a 13-year-old cancer patient to “strange sexual behaviour” and plied him with alcohol. Defense attorney Thomas Mesereau countered that the accusations were a scheme by a “con artist” family to extort the singer. On the stand, Gavin Arvizo testified that Jackson had masturbated him. Under cross-examination, he acknowledged telling a school teacher earlier that Jackson “never did anything” to him, saying he had lied out of fear of ridicule.¹⁴

Mesereau’s defense went after the credibility of the accuser’s family, particularly the mother. Jurors heard evidence that she had committed welfare fraud, that she had lied in a prior civil case against J.C. Penney, and that during the period she claimed she was being held against her will at Neverland she had left for a leg-waxing appointment.¹⁵ The conspiracy charges forced prosecutors to call her as a witness, giving the defense a long cross-examination. Actor Macaulay Culkin testified for the defense that he had slept in Jackson’s bed between ages 10 and 14 without anything inappropriate happening.¹³

Jackson did not testify. The defense played a video of him saying, “I haven’t been betrayed or deceived by children. Adults have let me down.”¹³

On June 13, 2005, after nearly 33 hours of deliberation across seven days, the jury acquitted Jackson on all counts: one count of conspiracy, four counts of committing a lewd act upon a child, one count of attempting to commit a lewd act, and four counts of administering an intoxicating agent to assist in the commission of a felony.²

Foreman Paul Rodriguez, a retired high school counselor, said afterward that while there was a “closetful of evidence,” it was “just not enough.” Jurors described the accuser’s mother as combative in court, saying she snapped her fingers at them and stared, and they questioned why any mother would allow her child to sleep alone with an adult man. One juror, Raymond Hultman, said he personally believed Jackson “probably has molested boys” but that the evidence at trial did not prove the specific charges.¹⁶

The Earlier 1993 Allegations

The 2003 booking wasn’t Jackson’s first brush with such accusations. In 1993, 13-year-old Jordan Chandler alleged in a sworn declaration that Jackson had kissed, fondled, and orally molested him in a relationship that began in May 1992. The family filed a civil suit alleging sexual battery, seduction, and intentional infliction of emotional distress.¹⁷

Jackson settled on January 25, 1994. The agreement placed $15 million in a trust for Chandler, paid $1.5 million to each parent, and covered $5 million in legal fees, while stating that Jackson “specifically disclaims any liability” and denied wrongdoing.¹⁷ No criminal charges followed. Grand juries in Santa Barbara and Los Angeles declined to indict, and in September 1994 District Attorneys Sneddon and Gil Garcetti said their 18-month investigation had not produced sufficient evidence. Jordan Chandler had refused to testify.¹⁸

After the Acquittal and After Jackson’s Death

Jackson died on June 25, 2009, but the legal story around the abuse allegations did not end there. Wade Robson and James Safechuck, two men who knew Jackson as children, later alleged he had sexually abused them starting when they were roughly seven and ten years old. Robson had testified for Jackson at the 2005 trial and later said he had lied then. Their accounts became the basis of the 2019 HBO documentary “Leaving Neverland,” directed by Dan Reed. The Jackson estate has called the film a “posthumous character assassination.”¹⁹

Robson sued the Jackson estate in 2013, Safechuck in 2014, targeting Jackson’s companies MJJ Productions and MJJ Ventures. Both suits were initially dismissed as untimely.¹⁹ A California law expanding the window for child sexual abuse claims revived the cases. On August 18, 2023, California’s Second District Court of Appeal held that a corporation that facilitates the sexual abuse of children by an employee cannot escape a duty to protect them just because the corporation is solely owned by the perpetrator. Associate Justice John Shepard Wiley Jr. described the companies not as Jackson’s “alter ego” but as a “same ego” case.²⁰

Robson and Safechuck are seeking $400 million in damages.²¹ Judge Michael E. Whitaker has set a trial date of February 14, 2028, with the case now in discovery.²² The estate maintains that Jackson is innocent and that the lawsuits have no merit.

In February 2026, four siblings from the Cascio family, Edward, Dominic, Marie-Nicole, and Aldo, sued the Jackson estate in federal court, alleging that Jackson groomed, drugged, and sexually assaulted them over more than a decade beginning when some were as young as seven.²³ The Cascios are also asking the court to invalidate a 2019 confidential settlement, under which each sibling was to receive five annual payments of approximately $690,000 in exchange for silence, alleging they were coerced into signing. As of mid-2026, the estate had moved to compel arbitration and the court had not yet ruled.²⁴
