Michael Oher’s conservatorship lawsuit produced one clear outcome and one open question. On September 29, 2023, a Shelby County probate judge terminated the Tennessee conservatorship that Sean and Leigh Anne Tuohy had held over the former NFL lineman since 2004, finding it should have been dissolved long ago. The broader petition Oher filed in August 2023, which seeks a full accounting of money earned from his life story along with compensatory and punitive damages, remains unresolved. Oher now lives in Nashville with his wife and four children and runs a nonprofit focused on scholarships for disadvantaged youth.
What the 2004 Conservatorship Actually Was
Less than three months after Oher turned eighteen, he signed documents placing him under a conservatorship held by Sean and Leigh Anne Tuohy. In Tennessee, that mechanism is normally reserved for adults deemed disabled and unable to manage their own affairs. It gave the Tuohys authority over his financial and personal decisions; Oher could not sign contracts or make his own medical decisions while it was in place.1NPR. Michael Oher Tuohys Conservatorship
In the fourteen-page petition he filed on August 14, 2023, Oher alleged the Tuohys told him the arrangement was functionally the same as an adoption and that “the laws were just written in a way that took my age into account.” He said he did not learn he had never been legally adopted until February 2023.2ESPN. The Tuohys, in a September 2023 filing, said plainly that “there was never an intent to adopt him” and that references to Oher as a son had been made “in the colloquial sense.”4ABC News. Michael Oher Speaks in New Interview About Lawsuit Against Tuohy Family
The Money Dispute Over The Blind Side
At the center of the lawsuit is how proceeds from the 2009 film, which grossed more than $300 million at the box office, were divided. Oher’s petition alleged each of the four Tuohy family members received $225,000 plus 2.5 percent of the film’s defined net proceeds, while he received nothing. The petition also pointed to a 2007 contract that it said assigned his life rights to 20th Century Fox “without any payment whatsoever.”2ESPN. The Tuohys gave the court a different accounting. Tax forms they submitted showed the family received more than $432,000 in film-related proceeds between 2007 and 2021, and their attorneys said Oher himself received $138,311 across ten payments over the same period, roughly one-third of the family’s net profit from the movie.5The Commercial Appeal. The Blind Side Movie Controversy, Michael Oher
The Tuohys’ attorney Marty Singer called the petition “ludicrous” and “absurd,” arguing that a family already worth hundreds of millions through a restaurant business had no incentive to withhold money from Oher. The family also alleged that Oher had threatened to plant a negative story about them unless they paid him $15 million, describing his legal action as a “shakedown,” and Sean Tuohy Jr. publicly called the claims a “publicity stunt.”7Fox5 Vegas. Why the Tuohys Say They Used a Conservatorship
The Tuohys’ lawyer Randy Fishman offered a specific reason for the choice. Because the NCAA classified the Tuohys as “boosters” of the Ole Miss program, a formal family relationship was needed to clear Oher for immediate eligibility, and the conservatorship served that purpose. An NCAA investigation into the arrangement ultimately found nothing that would prevent Oher from playing.9Clarion Ledger. The September 2023 Ruling and What Remains Open
Judge Kathleen Gomes ended the conservatorship on September 29, 2023, saying she had “never seen such a conservatorship for someone who isn’t disabled” and that it “should have been dissolved a long time ago.”1NPR.
