Minnesota Rusco Lawsuit: Bankruptcy Stay, Suing, Recovery Fund

If you lost a deposit or have an unfinished project from the Minnesota Rusco shutdown, a lawsuit against the company in the ordinary sense is not available: Minnesota Rusco filed Chapter 7 bankruptcy on November 3, 2025, and the case has been designated “no asset.”1BK Alerts. Renovo Home Partners, LLC Bankruptcy Case A May 2026 bankruptcy court order, however, created a streamlined path that lets former customers lift the automatic stay without hiring an attorney, sue the company in Minnesota court to obtain a judgment, and then apply to the state’s Contractor Recovery Fund for reimbursement.2Minnesota Attorney General. Why a Normal Lawsuit Is Blocked

Minnesota Rusco ceased all operations on October 29, 2025, and filed for Chapter 7 liquidation in the U.S. Bankruptcy Court for the District of Delaware five days later, Case No. 1:25-bk-11951.3PacerMonitor. Minnesota Rusco, LLC Bankruptcy Case The filing disclosed between $100 million and $500 million in liabilities against less than $10 million in assets, and court documents stated no funds were expected to remain for unsecured creditors.4Star Tribune. Two consequences follow for customers. First, filing a bankruptcy claim against Minnesota Rusco is unlikely to produce any recovery because there is no estate property to distribute. Second, the Chapter 7 filing triggered an automatic stay under federal bankruptcy law, which blocks lawsuits against the company in any other court. Without relief from that stay, you cannot sue Minnesota Rusco in Minnesota at all.

How to Lift the Stay Without a Lawyer

On May 22, 2026, the Delaware bankruptcy court approved a procedure specifically designed to let individual former Minnesota Rusco customers lift the automatic stay on their own. The steps are:

No attorney is required. The court’s order also authorized the trustee to put similar procedures in place for consumers of other Renovo subsidiaries in other states.5Minnesota Attorney General. Bankruptcy Court Order on Stay Procedures

Once the stay is lifted for your claim, you can file suit against Minnesota Rusco in Minnesota Conciliation Court or District Court.2Minnesota Attorney General. The point is to obtain a court judgment, which is a prerequisite for applying to the Minnesota Contractor Recovery Fund.

Applying to the Contractor Recovery Fund

The Minnesota Department of Labor and Industry’s Contractor Recovery Fund reimburses Minnesota residents who lost money because a licensed contractor failed to perform, converted funds, or engaged in deceptive practices.6Minnesota DLI. Contractor Recovery Fund For Minnesota Rusco customers, this is the primary route to any real recovery.

Key limits and conditions:

Because the judgment requirement sits upstream of the application, the full sequence of lifting the stay, filing suit in Minnesota, obtaining judgment, and then applying to the fund needs to be completed with that deadline in mind.

Other Recovery Paths

The Attorney General’s office identified several options that can run alongside, or in place of, the Contractor Recovery Fund route:

  • Credit card chargebacks. If you paid your deposit by credit card, you can contact the card issuer to dispute the charge for services never delivered.
  • The federal Holder Rule. If Minnesota Rusco arranged your financing, you may be able to stop loan payments or seek a refund from the lender under the Holder Rule, which allows consumers to raise claims against a lender when the seller set up the financing. The Attorney General’s office has cautioned that stopping payments can trigger collection activity or negative credit reporting.
  • Filing a complaint with the Attorney General. This both documents your loss and keeps you on the office’s distribution list for bankruptcy and recovery updates.8Minnesota Attorney General. Consumer Alert Regarding Minnesota Rusco’s Abrupt Closing

Reported individual losses give a sense of the stakes. One Minnesota couple reported losing $48,000 paid for a window installation that was never started.9FOX 9. The Attorney General Investigation

Minnesota Attorney General Keith Ellison issued a formal consumer alert on November 21, 2025, and opened an investigation into why Minnesota Rusco shut down without warning.8Minnesota Attorney General. If You Were a Customer of a Renovo Affiliate in Another State

The Minnesota Contractor Recovery Fund is open only to Minnesota residents, so customers of other Renovo brands cannot use it. The May 2026 bankruptcy order authorized the trustee to establish parallel stay-relief procedures in other states where Renovo subsidiaries operated, including Dreamstyle Remodeling (New Mexico, California, Idaho, Colorado), Alure Home Improvements (New York), Reborn Cabinets (California), NewPro (Northeast), and Woodbridge Home Solutions (Kansas and elsewhere).5Minnesota Attorney General.
