Missed a Show Cause Hearing? Contempt and Motion to Set Aside

If you missed a show cause hearing, the judge almost certainly ruled without you, and the order entered against you is real and enforceable starting now. Depending on the type of case, that can mean a default judgment, a contempt finding, a bench warrant, fines, forfeited bond, or jail. You can sometimes undo the damage by filing a motion to set the order aside, but only if you act quickly and can document a legitimate reason for your absence.

What the Judge Likely Did Without You

The default outcome is exactly that: a default. When no one shows up to argue the other side, judges typically grant the moving party what they asked for. Under federal court rules, when a party fails to respond or defend, the court can enter a default and then a default judgment based solely on the opposing party’s claims.1GovInfo. Federal Rules of Civil Procedure Rule 55 – Default; Default Judgment State courts work the same way. Whatever the other side requested — money, a custody change, enforcement of an existing order — the judge can grant in full.

On top of the default, the judge may hold you in contempt for disobeying the order to appear. Federal courts have the power to punish contempt through fines, imprisonment, or both.2Office of the Law Revision Counsel. 18 USC 401 – Power of Court A bench warrant is also common. That warrant authorizes any officer to arrest you and bring you before the court. Some jurisdictions give you a short window to come in voluntarily before the warrant issues; many do not.

Two other outcomes depend on your role in the case. If you were the one who filed, the judge may dismiss your claims outright. Courts can also order you to pay the other party’s attorney fees and costs for the hearing you wasted. And if you were out on bond in a criminal case, that bond can be declared forfeited.3Office of the Law Revision Counsel. 18 USC 3146 – Penalty for Failure to Appear

How Serious It Is Depends on the Case

The same empty chair plays very differently in family court, civil court, and criminal court.

Family Cases

In a custody or child support hearing, the judge hears only the other parent’s version. That can produce a default order granting their requested parenting schedule or a support obligation calculated entirely on their figures. Reversing a default custody order later is possible but hard. You will have to argue the current order does not serve the child’s best interests, and you will be doing it from a weaker position than you started in.

Civil Cases

In debt collection and other civil suits, the normal result is a default judgment for the full amount claimed. Once the judgment exists, the creditor can use it. A court judgment can allow a creditor to garnish your wages or bank accounts to satisfy the debt.4Consumer Financial Protection Bureau. Can a Debt Collector Take or Garnish My Wages or Benefits? Any defense you had — disputed amount, expired statute of limitations, mistaken identity — went unheard.

Criminal Cases

Criminal non-appearance is the most dangerous. A bench warrant is nearly automatic, and failure to appear is itself a separate federal crime. Penalties scale with the underlying offense, up to ten years for the most serious felonies and up to one year for misdemeanors. Any sentence for failure to appear runs consecutively to the sentence on the underlying case, not concurrently. The court can also forfeit your bond.3Office of the Law Revision Counsel. 18 USC 3146 – Penalty for Failure to Appear

Civil Contempt and Criminal Contempt Are Different

If the judge finds you in contempt, which kind matters a great deal.

Civil contempt is coercive. You hold the key to your own cell: comply with the underlying order and you go free. A parent jailed for unpaid child support, for example, is released once the required payment is made. Civil contempt has no fixed sentence and lasts until you comply or until it becomes clear you genuinely cannot.5Constitution Annotated. Inherent Powers Over Contempt and Sanctions The court has to give you a way out, called a purge condition.

Criminal contempt is punishment for something already done. The sentence is fixed, and complying afterward will not shorten it. Because it is punitive, criminal contempt carries stronger procedural protections and a higher burden of proof.5Constitution Annotated. Inherent Powers Over Contempt and Sanctions A missed hearing can trigger either, and some judges impose both.

What to Do in the Next Few Days

Speed matters here more than in almost any other legal situation. Every day you wait makes the problem harder to fix.

If you have a lawyer, call them today. They can contact the court and opposing counsel, find out what orders were entered, and start building a strategy. If a bench warrant is out, your lawyer can sometimes arrange a voluntary surrender rather than letting police pick you up. Judges notice the difference.

If you do not have a lawyer, call the court clerk’s office. Ask what happened at the hearing, what orders were entered, and whether a warrant was issued. Get copies of any orders so you know exactly what you are dealing with. This is the moment to seriously consider hiring an attorney. The process for undoing a default order is technical, and the stakes of getting it wrong are high.

Start collecting proof of why you missed the hearing right now. Hospital records, discharge papers, a letter from a doctor, a police report from an accident, a death certificate for a family member — whatever documents the reason. Without paper, you are asking the judge to take your word, and your credibility is not at its peak the day after you failed to show up.

Filing a Motion to Set Aside the Order

To undo an order entered in your absence, you file a motion to vacate, sometimes called a motion to set aside. It is a formal written request explaining why you missed the hearing and asking for another chance to be heard.

What You Have to Show

Two things, usually. First, a legitimate reason for the absence. Courts call this excusable neglect or good cause. A documented medical emergency, a serious accident, a death in the immediate family, or proof you were never properly notified of the date will qualify. Forgetting, mixing up the date, or deciding the hearing was not important will not. Under federal rules, excusable neglect is a recognized ground for relief from a judgment or order.6Legal Information Institute. Federal Rules of Civil Procedure Rule 60 – Relief from a Judgment or Order

Second, many courts also require a meritorious defense. The idea is that reopening the case would be pointless if you would lose anyway. You do not have to prove your defense will win, but you need to show the outcome is not a foregone conclusion. In a debt case, that might mean showing partial payment, disputing the amount, or raising a limitations problem.

How the Motion Is Filed

The motion has two parts: a written argument explaining why relief is warranted, and a sworn statement — an affidavit or declaration — setting out the facts. Attach your proof as exhibits. File with the court clerk, pay any filing fee, and formally deliver copies to the other party or their attorney. The court then sets a hearing where both sides argue whether the default order should stand.

How Long You Have

Do not sit on this. Federal rules require the motion to be filed within a reasonable time, and for excusable neglect, the outer limit is one year after the order was entered.6Legal Information Institute. Federal Rules of Civil Procedure Rule 60 – Relief from a Judgment or Order State courts often have similar or shorter windows. Waiting months makes it much harder to convince a judge you took it seriously. In practice, filing within days or weeks gives you the best chance.

Two situations change the deadline. If you were never properly served with the show cause order, longer limits or no limit at all may apply, depending on your jurisdiction. And if the underlying judgment is void — for instance, because the court had no jurisdiction over you — the one-year cap does not apply, though the motion still must be filed within a reasonable time.6Legal Information Institute. The Failure-to-Appear Defense in Criminal Cases

If you are charged with federal failure to appear, there is a specific defense available. You can avoid conviction by proving three things: uncontrollable circumstances prevented you from showing up, you did not recklessly create those circumstances, and you appeared as soon as the circumstances ended.3Office of the Law Revision Counsel. 18 USC 3146 – Penalty for Failure to Appear All three elements matter. If you were hospitalized but waited two weeks after discharge to contact the court, the defense collapses. The burden is on you.

If the Hearing Hasn’t Happened Yet

If you are reading this before the date passes because you are worried you cannot attend, request a continuance now. Courts grant continuances far more readily than they undo default orders after the fact. You will need to show good cause: a medical condition, a conflict with another court date, a family emergency, or needing more time to find a lawyer. If both sides agree to the new date, approval is much more likely. If the other side opposes, you file a formal written motion. Call the clerk early to learn your court’s specific procedure and deadlines. Even an emergency same-day filing or informal call is better than an empty chair. Judges may be frustrated by a late request. They will be much more frustrated by no request at all.
