Rinaudo says every allegation is false. OTK’s second termination notice went out on October 24, 2025, the same day as Schunk’s livestream. The corporate defendants — OTK Media, Mythic Talent Management, and King Gaming Labs — filed a motion to compel arbitration and stay the litigation on December 23, 2025, arguing that Rinaudo’s disputes with them belong in arbitration rather than federal court. Hoyt filed a Rule 12(b)(6) motion to dismiss on February 5, 2026, arguing that his on-stream commentary was constitutionally protected opinion and fair reporting on Rinaudo’s own prior public admissions. Because Rinaudo is a public figure, Hoyt argues, Rinaudo would need to prove actual malice by clear and convincing evidence, which Hoyt says cannot be shown when the commentary repeated and agreed with statements Rinaudo himself had made publicly. Prior Context Rinaudo Is Fighting Against
This is not Rinaudo’s first legal fight tied to sexual assault allegations in the streamer community. In March 2023, Adrianah Lee filed a defamation lawsuit against Rinaudo, OTK, Maya Higa, and CrazySlick seeking over $2 million. That case was dismissed as a nonsuit in late 2024.
