Motion to Confirm Arbitration Award: Filing, Service, and Enforcement

A motion to confirm an arbitration award asks a court to convert the arbitrator’s private decision into an enforceable court judgment. Without that judgment, an award is essentially a contract: if the losing side refuses to pay, you have no authority to garnish wages, place liens, or seize assets. The confirmation process is streamlined by design, but it has deadlines, service rules, and jurisdictional traps that can sink a winning position if you miss them.

Where to File

Start with the court your arbitration agreement names. The Federal Arbitration Act directs that if the agreement specifies a court, you apply there for the confirmation order.1Office of the Law Revision Counsel. 9 USC 9 – Award of Arbitrators; Confirmation; Jurisdiction; Procedure If the agreement is silent, you can file in the federal district where the award was made, but only if you have an independent basis for federal jurisdiction.

That independence requirement is where many petitioners get tripped up. In Badgerow v. Walters, the Supreme Court held in 2022 that federal courts cannot use a “look-through” approach to find jurisdiction over motions to confirm or vacate under FAA Sections 9 and 10.2Supreme Court of the United States. Badgerow v. Walters, No. 20-1143 You cannot ride into federal court on the back of the underlying dispute’s federal statute. You need diversity of citizenship with more than $75,000 at stake, or a federal question raised by the confirmation petition itself.3Office of the Law Revision Counsel. 28 USC 1332 – Diversity of Citizenship; Amount in Controversy; Costs

When federal jurisdiction is unavailable, state court is the default. Most states have their own arbitration statutes, many patterned on the Revised Uniform Arbitration Act, and state courts will confirm awards under those laws without requiring diversity or a federal question.

Deadlines

Under the FAA, you have one year from the date the award is made to apply for confirmation. That window carries a condition most people miss: it applies when the parties’ agreement states that a court judgment will be entered on the award.1Office of the Law Revision Counsel. 9 USC 9 – Award of Arbitrators; Confirmation; Jurisdiction; Procedure Most well-drafted clauses include that language, but if yours does not, courts disagree on whether Section 9 still gives you a path or whether you must rely on state law.

State deadlines are all over the map. Some states allow up to four years. The Revised Uniform Arbitration Act does not impose a specific deadline for confirmation, though it does set deadlines for motions to vacate or modify. Missing the applicable deadline does not destroy your underlying award, but it does close off the fast-track confirmation process. Your fallback would be a standard breach-of-contract suit to enforce the award, which is slower and more expensive.

Then there is the deadline running against the other side. The FAA gives the losing party just three months from when the award is filed or delivered to serve a motion to vacate, modify, or correct it.4Office of the Law Revision Counsel. 9 USC 12 – Notice of Motions to Vacate or Modify; Service; Stay of Proceedings This matters strategically. If you wait until that three-month window has closed before filing your confirmation motion, the other side’s statutory grounds for challenging the award have already expired. Some practitioners time their filings deliberately for that reason.

Documents You Need to File

The FAA tells you exactly what to put in front of the court clerk. Three categories of documents are required.5Office of the Law Revision Counsel. 9 USC 13 – Papers Filed With Order on Motions; Judgment; Docketing; Force and Effect; Enforcement

  • The arbitration agreement itself, along with documentation of any additional arbitrator or umpire selected during the process and any written extensions of the arbitrator’s deadline to issue the award.
  • The award. Some courts want a certified or authenticated copy, and filing one avoids challenges to authenticity even where the statute does not strictly require it.
  • Every notice, affidavit, and supporting paper used in connection with the application, plus copies of any court orders already issued in the matter.

Beyond the statute, you will typically prepare a notice of motion or petition (terminology depends on jurisdiction), a memorandum of law, a proposed order for the judge, and a supporting declaration establishing jurisdiction and stating that no grounds for vacatur exist. Expect a filing fee. In federal court the standard civil filing fee is $405; state court fees vary.

Serving the Other Side

Service rules under the FAA are stricter than many practitioners expect, and the key variable is where the opposing party is located. If they live or are headquartered in the same district where you file, you serve them or their attorney the way you would serve any motion in that court: personal service, certified mail, or electronic service where permitted.1Office of the Law Revision Counsel. 9 USC 9 – Award of Arbitrators; Confirmation; Jurisdiction; Procedure

If the opposing party is a nonresident of the district, the FAA requires that a U.S. Marshal serve the notice. Courts that have examined the issue have enforced that requirement as written. Hiring a private process server for a nonresident party risks having your confirmation thrown out on procedural grounds. The same marshal-service rule applies to motions to vacate, modify, or correct awards under Section 12.4Office of the Law Revision Counsel. 9 USC 12 – Notice of Motions to Vacate or Modify; Service; Stay of Proceedings Once the opposing party is properly served, the court has jurisdiction over them as if they had appeared voluntarily.

What the Court Does

The court’s role at confirmation is deliberately narrow. The judge does not re-examine the merits, second-guess factual findings, or revisit the arbitrator’s legal reasoning. The question is whether a statutory basis exists to vacate, modify, or correct the award. If not, the court must confirm it.1Office of the Law Revision Counsel. 9 USC 9 – Award of Arbitrators; Confirmation; Jurisdiction; Procedure The word “must” is important; confirmation is not discretionary.

Many motions are granted without a hearing, particularly when the other side does not respond. If opposition is filed, the court may schedule a hearing, but the scope stays limited to the narrow statutory grounds. A successful motion produces a final judgment that mirrors the terms of the award and carries the same weight as a judgment entered after trial.

What the Other Side Can Argue

The opposing party cannot ask the court to review whether the arbitrator got the answer right. Their only real options are statutory, and all of them focus on procedural fairness.

Under Section 10, a court can vacate an award in four situations: when it was obtained through corruption, fraud, or undue means; when the arbitrator showed evident partiality or corruption; when the arbitrator engaged in misconduct such as refusing to postpone a hearing for good cause or refusing to consider relevant evidence; or when the arbitrator exceeded their authority by deciding issues not submitted or failing to issue a complete, final decision.6Office of the Law Revision Counsel. 9 USC 10 – Same; Vacation; Grounds; Rehearing These standards are hard to meet, and courts overturn awards rarely. The bar is set high because the whole point of arbitration is finality.

Short of vacatur, Section 11 allows a court to modify or correct an award for an obvious calculation error, a ruling on a matter not submitted (if removing it does not affect the merits of what was submitted), or a defect in form that does not change the substance.7Office of the Law Revision Counsel. 9 USC 11 – Same; Modification or Correction; Grounds; Order A modification argument may actually work in your favor as the confirming party. A corrected award is still a confirmed one. The real threat is vacatur, which wipes the slate clean and can send the dispute back to arbitration.

Any of these challenges must be served within three months of the award.4Office of the Law Revision Counsel. 9 USC 12 – Notice of Motions to Vacate or Modify; Service; Stay of Proceedings If that window has closed before you file for confirmation, Section 10 and 11 arguments are likely time-barred.

Enforcing the Judgment

Once the court enters judgment, the arbitration award merges into it. From that point you are enforcing a court judgment, not an award, and the full toolkit available to any judgment creditor opens up: wage garnishments, bank levies, property liens, and asset seizure through the court’s enforcement mechanisms.

In federal court, post-judgment interest accrues automatically from the date judgment is entered. The rate is tied to the weekly average one-year Treasury yield published by the Federal Reserve for the week before the judgment date, and it compounds annually.8Office of the Law Revision Counsel. 28 USC 1961 – Interest State courts apply their own post-judgment interest rules, and those vary considerably.

If the losing party’s assets sit in a different state from where the judgment was entered, you will need to domesticate the judgment in that state before executing against those assets. Most states have adopted streamlined procedures for registering a foreign judgment. Where the losing party actively hides assets, post-judgment discovery becomes essential: subpoenas to banks, depositions about asset holdings, and court orders compelling turnover. If assets have been moved into shell entities, some jurisdictions allow alter-ego or fraudulent-transfer claims to reach them. By that stage, the matter has moved well beyond a confirmation motion and into full litigation over collection.
