If you took Mounjaro and later developed a serious gastrointestinal problem, a Mounjaro lawsuit is likely available to you through a federal multidistrict litigation in Philadelphia, where thousands of claims against Eli Lilly have been consolidated. Plaintiffs allege the company failed to warn patients and doctors that tirzepatide, the active ingredient in Mounjaro and Zepbound, could cause injuries well beyond ordinary nausea. The first bellwether trials are expected in mid-to-late 2026, and no settlements have been reached.1Drugwatch. Mounjaro Lawsuit
Which Injuries the Lawsuits Cover
The core legal theory is failure to warn. Plaintiffs say Eli Lilly knew or should have known about serious risks and did not put them on the label clearly enough or soon enough. A Master Complaint filed in December 2024 pulled the common claims together, and they fall into several categories:
- Gastroparesis, a condition where the stomach cannot empty food normally, sometimes called stomach paralysis.
- Pancreatitis, including severe forms such as necrotizing pancreatitis.
- Gallbladder disease, including cases requiring surgical removal.
- Intestinal blockages and ileus, where the bowel stops moving food.
- Vision loss from non-arteritic anterior ischemic optic neuropathy (NAION), sometimes described as an eye stroke.
- Blood clots, including deep vein thrombosis and pulmonary embolism.
The first widely reported case, filed August 2, 2023 by Jaclyn Bjorklund, described vomiting so severe she lost teeth and needed repeated emergency care after taking Mounjaro and Ozempic.2NBC News. FDA adverse event data has supported the signal. An analysis of the FAERS database from 2022 through early 2024 identified more than 37,800 adverse event reports tied to tirzepatide, with gastrointestinal disorders making up a large share and “impaired gastric emptying” flagged as unexpected and not then on the label.4National Library of Medicine. It Is an MDL, Not a Class Action
Online you will see this called a “Mounjaro class action.” It is not. It is a multidistrict litigation, which works differently in a way that matters to your pocket. In a class action, one outcome binds everyone and any recovery is divided. In an MDL, each person keeps their own individual case; only the pretrial work is consolidated so thousands of similar suits don’t duplicate discovery and expert fights.6Motley Rice. Mounjaro Lawsuit Information If you file, your injuries and your medical records drive the value of your claim.
The federal MDL is In re: Glucagon-Like Peptide-1 Receptor Agonists (GLP-1 RAs) Products Liability Litigation, MDL 3094, created by transfer order on February 2, 2024 in the Eastern District of Pennsylvania.7Judicial Panel on Multidistrict Litigation. MDL 3094 Transfer Order After Judge Gene E.K. Pratter died in June 2024, the case was reassigned to Judge Karen S. Marston.8Law360. Ozempic MDL Gets New Judge After Judge Pratter’s Death The MDL isn’t Mounjaro-only; it covers the whole GLP-1 class, including Ozempic, Wegovy, Rybelsus, Trulicity, and Zepbound. As of June 2026, roughly 3,763 cases were pending across those drugs.9U.S. District Court, Eastern District of Pennsylvania. MDL 3094 Case Information
If your injury is vision loss rather than a stomach or pancreas problem, you are looking at a different docket. In December 2025, the judicial panel created MDL 3163 specifically for NAION claims, also before Judge Marston, keeping those scientifically distinct cases on their own track.10Judicial Panel on Multidistrict Litigation. MDL 3163 Transfer Order New Jersey state courts have also centralized GLP-1 claims in Bergen County, with a separate track for vision loss, so some cases proceed in state rather than federal court.11New Jersey Courts. Where the Case Stands in 2026
The MDL is in late pretrial. Discovery, expert fights, and summary judgment briefing are the current work. Bellwether trials, meaning a handful of representative cases picked to try first so both sides can see how juries react, are expected in mid-to-late 2026, though specific dates had not been publicly set as of June 2026.12MDL Update. MDL 3094 Glucagon-Like Peptide-1 Receptor Agonists
A few milestones have shaped what a filed case now has to look like:
- In August 2025, Judge Marston ruled that gastroparesis claims must be backed by objective diagnostic testing rather than a clinical impression alone. For the strongest cases, that means a scintigraphy (gastric emptying) study showing more than 10% food retention at four hours.12MDL Update. MDL 3094 Glucagon-Like Peptide-1 Receptor Agonists
- A Daubert hearing on plaintiffs’ causation experts was held May 14, 2025, with the deadline for Daubert motions on expert testimony on April 28, 2026.13Wisner Baum. Mounjaro Lawsuit
- Expert depositions were due by March 27, 2026, and summary judgment motions by April 16, 2026, with briefing running through July 2026.1Drugwatch. Mounjaro Lawsuit
Eli Lilly also persuaded the court to split pretrial into phases, with the first phase focused on whether the drug’s label was adequate and whether federal preemption applies. Discovery into the company’s marketing practices was deferred until those threshold questions are resolved.
What a Mounjaro Case May Be Worth
No settlement has been reached in any Mounjaro or wider GLP-1 case as of mid-2026.14Motley Rice. Tirzepatide Lawsuit Information Mass settlement is considered unlikely before late 2027 at the earliest, because bellwether trials have not yet happened and both sides typically need those jury verdicts before they’ll move.12MDL Update. MDL 3094 Glucagon-Like Peptide-1 Receptor Agonists
Legal analysts have projected per-plaintiff payouts in the rough range of $150,000 to $700,000 if settlements materialize, with mild cases at the low end, hospitalization-level injuries in the middle, and wrongful death claims at the top.1Drugwatch. Mounjaro Lawsuit Because each case is individual, actual value turns on your medical bills, lost income, severity of injury, and the strength of your records.
Vision Loss Claims
More than 70 federal NAION cases were active as of mid-2026.1Drugwatch. Mounjaro Lawsuit A July 2024 study in JAMA Ophthalmology reported a statistically significant association between GLP-1 drugs and NAION. A follow-up in August 2025 found diabetes patients on semaglutide were more than four times as likely to be diagnosed with NAION, and obesity patients more than seven times as likely.15Class Action Lawyer TN. Zepbound and Vision Loss MDL 3163 is still in early procedural stages, so vision claims are at an earlier point than the gastrointestinal docket.
Eli Lilly’s Defense and the Label Updates
Eli Lilly denies the claims. In court filings, the company argues its labels adequately warned prescribers, that under the learned intermediary doctrine its duty ran to doctors rather than directly to patients, and that federal preemption may have prevented it from unilaterally adding stronger warnings beyond what the FDA approved.16U.S. District Court, Eastern District of Pennsylvania. MDL 3094 Court Filings
The label has in fact changed. A November 2024 update added language on severe gastrointestinal reactions and the risk of pulmonary aspiration during general anesthesia or deep sedation, because the drug delays gastric emptying.17U.S. Food and Drug Administration. Mounjaro Prescribing Information The current label states Mounjaro is not recommended for patients with severe gastroparesis, and the postmarketing section lists acute pancreatitis, hemorrhagic and necrotizing pancreatitis (sometimes fatal), ileus, intestinal obstruction, severe constipation including fecal impaction, alopecia, acute kidney injury, and anaphylaxis.18U.S. Food and Drug Administration. Mounjaro Prescribing Information Plaintiffs say the additions prove Lilly was late to acknowledge risks it should have disclosed sooner. The FDA has also required Lilly to run a postmarketing trial on withholding GLP-1 drugs before surgery to study the aspiration risk, and is separately evaluating reports of suicidal ideation linked to GLP-1 drugs.19U.S. Food and Drug Administration. If You Think You Have a Claim
Pull your records before you call a lawyer. For a gastroparesis claim, Judge Marston’s August 2025 order means you will need objective diagnostic testing in your file. A gastric emptying scintigraphy study showing more than 10% retention at four hours is the standard the court set for the strongest cases. Gather your Mounjaro prescription history, pharmacy records, hospital and ER records, any imaging, and the names of the specialists who diagnosed and treated you. For pancreatitis, gallbladder, bowel obstruction, blood clot, or NAION claims, the diagnostic records from the treating specialist are the backbone of the case.
Statutes of limitations vary by state and are often two to three years from when you knew or should have known the drug caused your injury, so delay carries real risk. Filing into the MDL does not change the individual nature of your case: your records, your injuries, and your damages drive what you recover.
