Whether you can still sign up for a Mr. Cooper class action lawsuit depends on which case you mean. The largest one, a multistate mortgage servicing settlement worth more than $91 million, closed to new claims on March 3, 2025, and paid out in November 2025. A separate pay-to-pay fee settlement received final court approval in April 2024. Two other cases, one over the 2023 data breach and a newer one over prepayment penalties, are still in litigation with no settlement and no claims process yet. Here is where each case stands and what, if anything, you can still do.
The Multistate Servicing Settlement Is Closed
This was the big one. In December 2020, attorneys general from all 50 states and D.C., 53 bank regulators, and the Consumer Financial Protection Bureau filed parallel actions against Nationstar (Mr. Cooper’s former name) over mortgage servicing practices between 2011 and 2017. The combined settlements required Mr. Cooper to pay more than $91 million: roughly $73 million in CFPB-directed redress to over 40,000 borrowers, a $1.5 million civil penalty, and about $5.8 million in state-level direct payments.1Consumer Financial Protection Bureau. Who Qualified
Two groups of borrowers were eligible:
- Borrowers whose loans were transferred in bulk to Nationstar between February 1, 2011 and December 18, 2017, where the loan became 30 days delinquent within 90 days of transfer and the borrower ultimately lost the home to foreclosure. The property had to have been the borrower’s primary residence when the loan was originated.
- Borrowers whose property was inspected by Nationstar between June 24, 2011 and December 29, 2017, wrongly determined to be vacant, and had the locks changed, where the borrower either requested access within 30 days or a follow-up inspection within 90 days found the property occupied.3National Nationstar Settlement. The Pay-to-Pay Fee Settlement
McFadden et al. v. Nationstar Mortgage LLC challenged the convenience fees Mr. Cooper charged borrowers who made mortgage payments over the phone, sometimes as much as $19 per transaction. The plaintiffs argued the fees violated federal law and the D.C. Protecting Consumers from Unjust Debt Collection Practices Act.6Tycko & Zavareei LLP. The Data Breach Case Is Still Pending
Between October 30 and November 1, 2023, a cyberattack on Mr. Cooper exposed personal information, including Social Security numbers and bank account details, for about 14.7 million people. In July 2025, Judge Godbey allowed the plaintiffs’ negligence and breach of implied contract claims to proceed, finding that the risk of identity theft was enough to establish standing. He dismissed claims for breach of express contract, unjust enrichment, invasion of privacy, and breach of confidence. The court set a March 13, 2026 deadline for rulings on class certification.11National Mortgage Professional. Judge Allows Key Claims in Mr. Cooper Data Breach Case to Proceed
As of mid-2026, there is no settlement. There is no claim form to fill out and no sign-up. If you received a breach notification letter, you do not need to do anything now to preserve your rights as a potential class member. Watch for a notice from a court-appointed administrator if and when a class is certified or a settlement is reached.
The Prepayment Penalty Case Is Brand New
In April 2026, a proposed class action was filed in the Northern District of Texas alleging that Mr. Cooper overcharges borrowers on mortgage prepayment penalties. In Michael E. Kasaba LLC v. Nationstar Mortgage LLC, the plaintiff claims the company interprets “anniversary date” in loan agreements as the first payment due date rather than the loan funding date, which pushes borrowers into higher penalty tiers. In the named plaintiff’s case, that allegedly meant a 5% penalty of roughly $19,748 instead of a 4% penalty of about $15,799.12Mortgage Professional America. The complaint alleges breach of contract, unjust enrichment, and violations of California and Texas consumer protection statutes, with estimated aggregate damages over $5 million. An amended complaint was filed May 12, 2026, after the court flagged jurisdictional issues, and Mr. Cooper had not responded as of mid-June 2026.13PACER Monitor.
