MVA Administrative Hearing: Deadlines, Evidence, and Outcomes

An MVA administrative hearing is a civil proceeding in which an independent Administrative Law Judge decides whether the Maryland Motor Vehicle Administration can suspend or revoke your driving privileges. The Office of Administrative Hearings runs these cases, and the judge has no connection to the MVA.1Office of Administrative Hearings. About the Office of Administrative Hearings No jail time is on the table and nothing goes on a criminal record. Your license is what you stand to lose, and the deadline to request the hearing is short enough that waiting a week can cost you the license before you ever see a judge.

What Triggers an MVA Hearing

Three situations put you in front of an ALJ.

The first is points. Maryland tracks moving violations on a two-year rolling basis. Eight points produces a notice of suspension; twelve points produces a notice of revocation.2Maryland General Assembly. Maryland Code Transportation 16-404 – Effect of Accumulated Points Either notice carries the right to a hearing before the action takes effect.

The second is alcohol or drugs. If you refused a chemical breath test at a traffic stop, or your test showed a blood alcohol concentration of 0.08 or higher, the MVA can suspend your license on its own authority. That track runs separately from the criminal DUI case, and the outcomes do not depend on each other.3Maryland General Assembly. Maryland Code Transportation 16-205.1 – Suspension or Disqualification for Refusal to Submit to Chemical Tests for Intoxication

The third is medical fitness. The MVA’s Medical Advisory Board reviews records and recommends whether a driver can safely operate a vehicle. If the MVA proposes to act on that recommendation, you can request a hearing and bring your own medical evidence.4MDOT Motor Vehicle Administration. Medical Review Referrals and Process

The Deadline to Request a Hearing

This is the one piece of the process that forgives nothing.

Points Cases

After the MVA sends a suspension or revocation notice for points, you have 10 days (excluding weekends and legal holidays) to file a written hearing request. Miss it, and the suspension or revocation takes effect automatically at the end of that window.2Maryland General Assembly. Maryland Code Transportation 16-404 – Effect of Accumulated Points

Alcohol-Related Cases

After a DUI stop with a refusal or a 0.08-or-higher reading, two different filing windows exist, and they do very different things. Filing within 10 days of the stop keeps your temporary driving privileges active until the hearing. You can still file up to 30 days from the order of suspension, but any request past day 10 means your suspension begins on day 46 whether or not your hearing has been scheduled.5Maryland General Assembly. Maryland Code Transportation 16-205.1 – Suspension or Disqualification for Refusal to Submit to Chemical Tests for Intoxication Waiting past day 10 means you lose your license before you argue your case.

How to File

The request must be in writing and must be accompanied by a $150 fee paid by check or money order to the Maryland State Treasurer. Medical Advisory Board hearings are the only type exempt from the fee.6Office of Administrative Hearings. Fee Information Include your driver’s license number and the case number from the order of suspension exactly as they appear; a mismatch can get the request rejected.

You can mail the request to the MVA’s Driver Improvement Programs Division or hand it in at an authorized MVA location. With the deadline this tight, hand delivery removes a real risk. Once OAH processes the request, it mails a notice with the date, time, and location. Most hearings sit at OAH’s main office in Hunt Valley, with additional locations in Rockville and Salisbury.7Office of Administrative Hearings. Hearing Locations

Evidence That Moves the Needle

Start by ordering your driving record from the MVA so you see exactly what the ALJ will see. A certified copy is $15, non-certified is $12.8MDOT Motor Vehicle Administration. Fees and Payment Options Errors on the record are easier to challenge when you spot them before the hearing.

In a points case, completing a Driver Improvement Program (a 4-to-8 hour instructional course) before the hearing shows the judge you have already taken corrective action.9MDOT Motor Vehicle Administration. Driver Improvement Program In an alcohol case, completing the 12-Hour Alcohol Education Program plays the same role.10MDOT Motor Vehicle Administration. Alcohol Education Program Finishing these before the hearing, rather than waiting for the judge to order them, reads differently to an ALJ than a promise to enroll later.

Employment evidence matters because the statute governing ALJ authority specifically lets the judge modify or decline a suspension when it would adversely affect your employment or job prospects.11Maryland General Assembly. Maryland Code Transportation 16-405 A letter from your employer explaining that driving is part of the job goes straight to that factor. Character letters and witness statements can help too.

You have the right to subpoena witnesses, including the arresting officer. Subpoena requests must reach OAH in writing at least 15 days before the hearing and must include the case name, OAH case number, hearing date, and the full name and address of each person. The fee is $5 per subpoena, payable to the Maryland State Treasurer. OAH will not grant a postponement based on a late subpoena request.12Office of Administrative Hearings. Requesting a Subpoena

What the Hearing Looks Like

The hearing follows the Administrative Procedure Act for contested cases.13New York Codes, Rules and Regulations. Maryland Code Transportation 12-206 – Conduct of Hearing It is less formal than criminal court but runs on real evidentiary rules, and everyone who testifies is placed under oath.

The ALJ opens by reviewing the MVA’s file, which usually contains the officer’s sworn statement, your point history, or your breath test results. You or your attorney then present your evidence, call witnesses, and cross-examine any witnesses the MVA has produced. You can also challenge the accuracy of the MVA’s records and raise mitigating circumstances. The judge asks questions throughout but does not take a side.

The standard of proof is preponderance of the evidence. The MVA has the initial burden of showing grounds for the suspension or revocation; you carry the burden on any affirmative defense you raise.14Library of Maryland Regulations. COMAR 28.02.01.21 – Evidence and Burden of Proof This is a lower bar than “beyond a reasonable doubt,” which means the officer’s sworn statement carries weight unless you have something concrete to answer it.

Possible Outcomes

The ALJ usually announces a ruling at the close of the hearing, and a written order follows by mail.

  • No action. The ALJ finds insufficient grounds and your license stays intact.
  • Modified suspension. The ALJ shortens the period or issues a restricted license that lets you drive to work, school, medical appointments, or alcohol education. This is the outcome the employment-impact statute enables.11Maryland General Assembly. Maryland Code Transportation 16-405
  • Ignition Interlock Program. In alcohol cases, the ALJ may order a breath-testing device installed in your vehicle as a condition of driving. The program runs 180 days for a BAC between 0.08 and 0.15, and one year for a BAC of 0.15 or higher or a test refusal. Removal requires no violations in the final three months.15MDOT Motor Vehicle Administration. Ignition Interlock Program
  • Full suspension or revocation. The ALJ upholds the MVA’s proposed action for the period in the order.

Whatever the result, it goes on your permanent MVA record.

Appealing a Decision You Lost

If the ruling goes against you, the next step is a petition for judicial review in a Maryland circuit court. You have 30 days from the final decision or from the date you received notice of it, whichever is later.16Maryland Courts. Administrative Appeals There are no standardized forms; the petition is drafted under Maryland Rule 7-202.

The circuit court does not retry the case. It reads the administrative record and asks whether substantial evidence supports the ALJ’s findings. If a reasonable person could have reached the same conclusion on that record, the court upholds the decision. Reversing an ALJ ruling is difficult for that reason, and appeals tend to succeed only where there is a clear legal error or a factual finding the record does not support.

Reinstatement After a Suspension

A suspension does not lift itself when the period ends. You apply for reinstatement and pay the MVA. The standard fee is $90 for a non-CDL or CDL license. If the suspension stemmed from a drug or alcohol offense, reinstatement costs $150, and a separate $30 restoration fee may apply.8MDOT Motor Vehicle Administration. Fees and Payment Options

Interlock-program drivers pay more. The enrollment fee is typically $47, which the MVA may waive for drivers receiving medical or food assistance, plus installation and monthly service charges paid to the device provider. Providers must offer a 50% discount on rental rates for drivers on assistance.15MDOT Motor Vehicle Administration. Ignition Interlock Program Between hearing fees, reinstatement, and required programs, the total cost of an administrative suspension often clears $1,000 before insurance effects.

If You Hold a CDL

A commercial license changes the stakes. Federal law imposes a mandatory one-year disqualification from commercial driving for a first major offense, including DUI, test refusal, leaving the scene, or causing a fatality through negligent driving. A second major offense in a separate incident triggers lifetime disqualification.17eCFR. 49 CFR 383.51 – Disqualification of Drivers These penalties apply even when you were driving your personal vehicle at the time.

Federal anti-masking rules also prevent states from hiding traffic convictions from a commercial record through diversion or deferred judgment. Any traffic-control conviction, regardless of what you were driving, must appear on your commercial record; parking, weight, and vehicle-defect violations are the only exceptions.18eCFR. 49 CFR 384.226 – Prohibition on Masking Convictions Plea bargains that can protect non-commercial records are largely off the table for CDL holders.

You Cannot Move Away From the Result

Maryland participates in the Driver License Compact, an interstate agreement under which member states share license suspensions and traffic convictions.19New York Codes, Rules and Regulations. Maryland Code Transportation 16-703 – Driver License Compact A conviction you pick up in another member state gets reported to Maryland, and for the most serious offenses, including DUI, vehicular manslaughter, hit-and-run, and any felony committed with a vehicle, Maryland treats the out-of-state conduct as if it happened here.

The compact runs the other direction too. If an MVA hearing suspends or revokes your license, other member states see that action, and no member state can issue you a new license while the Maryland action remains in effect. Relocating does not reset the clock.
