Mynd Management Lawsuit Update: DRE Settlement and Tenant Suits

Mynd Management, the Oakland-based property management company that merged with Roofstock in 2024, has faced one formal state regulatory action, at least two individual lawsuits, and a steady flow of tenant and owner complaints. The most consequential Mynd Management lawsuit-adjacent matter was a California Department of Real Estate disciplinary case that ended in a 2022 settlement involving license suspensions, monetary penalties, and audit cost repayments over trust account shortages.

California Department of Real Estate Discipline

On March 10, 2021, the California Department of Real Estate filed a formal Accusation (No. H-12497 SF) against Mynd Management, Inc. and its designated broker officer, Darryl John Willis.1California Department of Real Estate. Trust accounts hold client money — security deposits, rent, and owner disbursements — and California law requires brokers to safeguard those funds.

The DRE also alleged that Willis was not an authorized signer on six trust accounts despite being the designated broker, that Mynd failed to obtain required written permission before allowing account balances to drop below accountability thresholds, and that the company collected undisclosed compensation from Wells Fargo Bank in the form of “earnings credits” tied to trust account balances. The agency further alleged that Willis failed to exercise reasonable supervision over Mynd’s property management operations.1California Department of Real Estate. The 2022 Settlement

Mynd and Willis did not fight the charges. They entered a Stipulated Settlement and Order, adopted by the Real Estate Commissioner on March 14, 2022, and effective April 18, 2022.2California Department of Real Estate.   • A 60-day suspension of both Mynd’s corporate broker license and Willis’s individual license, with 30 days stayed on the condition that each paid a $1,500 monetary penalty and committed no further violations within two years.
  • An indefinite suspension of Willis’s license unless he completed a continuing education course on trust fund accounting and handling.

Mynd kept its license. The action remains on its regulatory record.

Individual Lawsuits

Two lawsuits against Mynd have documented outcomes in the available court records.

Wells v. Mynd Management (Santa Clara County, 2021)

Kyle Wells filed a small claims complaint against Mynd in Santa Clara County Superior Court in December 2021. The case was categorized as a commercial and trade dispute in the $5,001 to $10,000 range; the docket does not detail the specific allegations.3PlainSite. Kyle Wells v. A satisfaction of judgment was filed on September 8, 2022, confirming full payment.

Mims v. Mynd Property Management (Texas, 2023)

Taliah Mims filed an adversary proceeding against Mynd Property Management in the Northern District of Texas Bankruptcy Court in December 2023. The case was classified under “injunctive relief.” Mims filed a notice of dismissal in February 2024, and the court closed the case on February 20, 2024.5PACER Monitor. Mims v. Tenant and Owner Complaints

Mynd holds an A+ rating with the Better Business Bureau and has been accredited since 2017.6Better Business Bureau. Mynd BBB Business Profile The complaints filed there, however, describe recurring problems.

Tenants have reported slow or incomplete repairs, including allegations of black mold, leaking roofs, weak deck railings, broken locks, and fire hazards from clogged dryer vents. Some tenants alleged that properties advertised as “rent-ready” were missing basic features like kitchen cabinets and required cleaning the company never performed. On the financial side, tenants have alleged that Mynd withheld security deposits for damage that predated the move-in, charged unauthorized move-out fees for lawn mowing and cleaning, debited bank accounts without authorization, and delayed or failed to send promised refunds. Others reported being blocked from paying rent through the online portal or having partial payments rejected. Property owners have their own grievances. In an August 2025 BBB complaint, an owner alleged that Mynd collected a month of rent owed to the owner after a property sale, then issued a check that bounced because of a reporting discrepancy, and that follow-up efforts were met with a month of silence. That complaint was eventually marked resolved. Who Mynd Is Now

Mynd was founded in 2016 and is headquartered in Oakland, California. In June 2024, it merged with Roofstock, a single-family rental investment platform founded in 2015.8PR Newswire.
