Mystery at Ascot Estates: The Brett Parker Double Murder Case

The Brett Parker double murder case ended with Parker, an Irmo, South Carolina bookie, convicted in May 2013 of killing his wife Tammy Jo Parker and his longtime gambling partner Bryan Capnerhurst inside the family’s Ascot Estates home on April 13, 2012. He had told deputies it was a home invasion and that he shot Capnerhurst in self-defense. Investigators concluded he shot his wife first, then killed his friend to frame him, chasing an insurance payout worth close to a million dollars. He is serving two consecutive life sentences without the possibility of parole.

What Happened at 12 Tackeria Court

Brett and Tammy Parker lived in a five-bedroom home on a one-acre lot in the Ascot Estates subdivision of Richland County, near Irmo. At 12:42 p.m. on April 13, 2012, Brett called 911 to report a home invasion. Deputies found Tammy, 44, dead in an upstairs bathroom and Bryan Capnerhurst, 46, dead in a storage alcove near a safe. Both had been shot multiple times in the upper body.¹ A 9mm pistol was in Capnerhurst’s hand, and investigators also recovered Brett Parker’s Taurus Judge revolver.²

The Self-Defense Story Parker Told

Parker said he had been in a bathroom when Capnerhurst arrived to collect a gambling debt of roughly $21,300. He claimed he heard gunshots, found Tammy collapsed, and was then confronted by an armed Capnerhurst who demanded he open a safe in the attic. He said he reached a hidden revolver and shot Capnerhurst to save himself.³

His attorneys considered invoking South Carolina’s Stand Your Ground law but abandoned the idea. The statute requires that the person claiming its protection not be engaged in unlawful activity, and Parker had run an illegal sports betting business out of the house for decades.³

How Investigators Broke the Story

Autopsy findings, cell phone records, forensic analysis, and home security video reshaped the case. Richland County Sheriff Leon Lott said the evidence showed Tammy Parker was shot first, directly contradicting Brett’s account.⁴ Security footage recorded Capnerhurst arriving at the home at 12:31 p.m., just eleven minutes before the 911 call.²

Smaller details also didn’t fit. A toilet seat was left up in the downstairs bathroom where Parker said he had been. Items inside Capnerhurst’s gym bag looked staged, with ammunition and a magazine clip placed conspicuously on top.² Lott said the evidence did not match Parker’s story “at all.”⁴

On July 20, 2012, three months after the killings, Brett Parker turned himself in and was charged with two counts of murder. Circuit Court Judge DeAndrea Benjamin denied bond. Prosecutors pointed to a $500,000 mortgage, $100,000 in personal debt, and potential insurance and retirement gains topping $1.2 million as evidence of both motive and flight risk.⁵⁶

Who the Victims Were

Tammy Jo Parker was a former singer with the Columbia-area band JumpStart who left the band to work in pharmaceutical sales. She and Brett had two children, thirteen-year-old Brooke and five-year-old Zack.⁷⁸

Bryan Capnerhurst was Brett’s longtime friend and assistant in the sports betting operation. He was in financial trouble at the time, reportedly owing about $25,000. He had told his wife that Parker’s home safe held $80,000 to $100,000. It actually contained only a couple hundred dollars.⁸

Why Prosecutors Said He Did It

Parker had been a bookie for roughly thirty years and, by his own admission, one of the Midlands’ leading gambling operators. He had also been betting his own money badly. Prosecutors said he owed more than $170,000; defense witnesses put the figure closer to $101,000.⁸

Family accountant Ben Staples testified that Tammy held life insurance and investments worth more than $1 million, including an $868,000 life insurance policy naming Brett as sole beneficiary. Staples told jurors he had “no doubt” Parker killed both victims to get at those funds.⁸

Prosecutors also introduced evidence of an affair with a 29-year-old bank teller, Lindsay Mullins. Text messages, plus security camera footage of Mullins leaving an hourly-rate motel where Parker had booked a room, filled in the timeline. Mullins testified that she and Parker had a sexual encounter at the motel and exchanged flirtatious texts on the day of the murders.⁸ She also said Parker told her he wanted to leave his wife but that a separation would be financially difficult.⁹

The theory prosecutors laid out was straightforward: Parker killed Tammy to solve his money problems and then killed Capnerhurst to create a cover story, placing the gun used on Tammy in Capnerhurst’s hand to prop up the self-defense claim.⁸

The Trial and the Life Sentence

The trial began in May 2013 and ran more than three weeks. Fifth Circuit Assistant Solicitor Luck Campbell prosecuted, arguing Parker shot Tammy multiple times before killing Capnerhurst when he arrived for what prosecutors called a planned meeting. Defense attorney Dave Fedor argued his client was not intelligent enough to execute such a plot, calling him “no Einstein.” Campbell told the jury not to be deceived.¹⁰

Parker’s fourteen-year-old daughter Brooke testified for the defense, saying she had seen her father hand a gun to Capnerhurst for “safety” and protection. On cross-examination, prosecutors questioned whether Parker had coached her from jail.⁸

On May 28, 2013, the jury returned a unanimous guilty verdict after roughly three hours. Judge DeAndrea Benjamin sentenced Parker to two consecutive life terms without the possibility of parole.¹⁰ Tammy’s mother, Libby Carswell, spoke after sentencing. “I loved him, I really did. Until he murdered my daughter,” she said. “How could you kill the mother of your children? If you loved my daughter, you wouldn’t have killed her, you could have walked away.”⁸

The Federal Gambling Case and a Brady Problem

The murder investigation also opened up the family gambling business. In September 2013, four months after the murder conviction, Brett Parker, his father Jack Parker, and associate Douglas Taylor were tried together in federal court on charges of running an illegal gambling business under 18 U.S.C. § 1955. All three were convicted after a three-day trial. Jack Parker received five months of community confinement, five months of house arrest, and $3,000 in fines.⁸¹¹

Prosecutors had built that gambling case in part on testimony from Ben Staples, the same accountant who testified at the murder trial. Within 48 hours of the gambling verdicts, the SEC filed a civil fraud complaint against Staples, alleging he and a son had run a scheme starting in 2008 that targeted terminally ill patients and netted about $6.5 million. Federal prosecutors had learned of the SEC investigation before the gambling trial and did not disclose it. Defense attorney Dave Fedor said that if they had known, “I think we could have crucified him. I don’t think he was truthful.”¹²

In June 2015, the Fourth Circuit Court of Appeals vacated the gambling convictions of Jack Parker and Douglas Taylor and remanded their cases, holding that the government violated its obligations under Brady v. Maryland by failing to disclose the SEC investigation. Staples was the only witness offering direct evidence that Tammy Parker had actively participated in the gambling operation, an element of the charge.¹¹ The Brady ruling addressed the federal gambling convictions of the co-defendants; it did not disturb Brett Parker’s state murder conviction.

Appeals and Where Brett Parker Is Now

Parker’s murder conviction took a separate appellate path. He challenged the trial court’s jury instructions on circumstantial evidence and its decision to allow certain expert testimony. In an unpublished opinion filed December 30, 2015, the South Carolina Court of Appeals affirmed the conviction on all grounds.¹³

As of 2021, Brett Parker remained in prison serving his two consecutive life sentences.¹⁴ Brooke and Zack were placed in the care of their paternal grandparents, Linda and Jack Parker.⁸
