The Relationship and the Threats Before Her Death
Franklin met Reginald Potts Jr. by chance on the street in May 2006 and entered a casual, non-exclusive relationship with him. By mid-2007 she had discovered his criminal background and infidelity. Potts refused to accept the breakup. He responded with a profanity-laden email and a stream of voicemails. In one, he told her, “I could erase you, and I should have somebody come over there and get you now.” In another: “if you do anything else, if I hear anything else, I will erase your a***. About a week before she disappeared, she emailed Potts to tell him she had filed a police report and planned to seek an order of protection. Neighbors and security guards at her building saw Potts lurking around the property in the days that followed. Potts already had a documented history of violence against women. His ex-wife, Nathaly Figueroa, later testified that he had hit her in the face while she was driving, tried to suffocate her with a pillow, and struck her hard enough to make her ear bleed. Another former girlfriend, Ina Dorsey, testified that he choked her with both hands while holding their infant and pushed her down stairs. How She Disappeared and Was Found

On September 19, a Calumet City police officer found boxes of her work-related prescription drug samples neatly stacked in the parking lot of a nearby golf course.8Chicago Sun-Times. How Investigators Tied Potts to the Killing
Surveillance footage from Franklin’s building showed the two of them entering the parking garage together shortly before noon on September 18, 2007, and returning to the garage around 1:00 p.m. Cell phone tower records showed the phones belonging to Potts and Franklin pinging off the same locations from about 7:00 a.m. that morning until after 10:00 p.m. that night, tracing a route from downtown Chicago south to Calumet City and Hammond, Indiana. After Franklin vanished, her phone sent cryptic text messages to friends and family and placed 911 calls with no voices, only background music and noise, from near Potts’s own condominium building around 10:15 p.m. Prosecutors alleged Potts used her phone to send the texts and make a fake dinner reservation to suggest she was still alive.4Illinois Courts. Potts’s alibi collapsed when detectives interviewed his associate Hugh Echols in December 2007. Echols initially said he had spent that evening shopping with Potts at a Target on Roosevelt Road. Confronted with Target surveillance footage showing him at the store without Potts, Echols admitted lying and said Potts had actually called him around 9:15 p.m. asking to be picked up at a gas station in Hammond, Indiana, near the state line.4Illinois Courts. Why the Case Took Eight Years to Reach Trial
The case, filed in the Circuit Court of Cook County as No. 08-CR-06600, spent more than eight years in pretrial proceedings. Prosecutors said the average murder trial in that jurisdiction takes about two years. Potts stretched the timeline by cycling between representing himself and retaining private attorneys: he chose self-representation twice and hired three different private lawyers before a judge finally appointed a public defender.11Chicago Tribune. Assistant State’s Attorney Maria McCarthy told the trial judge, “Potts is very smart, so this ‘aw-shucks, I didn’t know what I was getting into’ is absolutely false. Potts also picked up additional felony charges in the Cook County Jail for allegedly assaulting sheriff’s deputies and destroying property.12NBC Chicago. The Trial and Guilty Verdict
The trial opened in October 2015 before Cook County Judge Thomas Gainer Jr. The prosecution’s case was circumstantial. There was no DNA or fingerprint evidence linking Potts to the killing, and investigators noted that Franklin’s car had been wiped clean. Prosecutors also introduced Potts’s history of domestic violence as propensity evidence, with testimony from Nathaly Figueroa and Ina Dorsey. The defense argued the case was entirely circumstantial and “riddled with doubt,” pointing to the absence of physical evidence and to the fact that the medical examiner had initially been unable to determine a cause of death. The Life Sentence
At the sentencing hearing in early 2016, Franklin’s family described what the killing had cost them. Her mother, Maria Maner, told the court that the death had destroyed the family and that Nailah’s father’s health deteriorated until he died four years into the pending case, of what the family called a broken heart. On March 8, 2016, Judge Gainer sentenced Potts to life in prison without the possibility of parole. He called Potts a “cold, calculating, conniving, coward of a con man.”1Chicago Sun-Times. The Appeal
Potts appealed to the Illinois Appellate Court, First District, in case No. 1-16-1219. He argued the trial court should have suppressed the historical cell-site location information obtained without a warrant, relying on the U.S. Supreme Court’s 2018 decision in Carpenter v. United States. He also raised defective jury instructions, ineffective assistance of counsel, prosecutorial misconduct, and the trial court’s refusal to allow a post-trial witness to testify without publicly revealing the witness’s identity.4Illinois Courts.
