NBA Sued for Cutting Middleman From Emirates Deal

The NBA Emirates sponsorship lawsuit is a breach-of-contract case brought in March 2025 by California pharmaceutical executive Paul Edalat, who says the league promised him a 10% commission for helping broker a partnership with Emirates airline in 2014 and then cut him out when the deal was finalized a decade later. Edalat is seeking damages exceeding $500,000, though his attorney has valued the underlying sponsorship at $60 million or more. The NBA denies any agreement ever existed and has moved to dismiss.¹

How Edalat Says He Got Involved

In March 2014, Kiki VanDeWeghe, then the NBA’s senior vice president of basketball operations, contacted Edalat and asked him to help open a channel to Emirates airline. The lawsuit says VanDeWeghe sought him out because of his “deep ties” to business and government figures in the Middle East. The NBA’s existing airline sponsorship with Delta was near expiration, and the league was looking around.¹

According to the complaint, VanDeWeghe verbally promised Edalat and his company, Liwa North America, a 10% commission on any resulting sponsorship and on any future partnership between the NBA and Emirates.² Edalat’s attorney, Tucker Byrd of Byrd Campbell P.A., argues oral contracts for services already performed are enforceable under Florida law.

Edalat points to documentary evidence. A May 1, 2014 letter on NBA letterhead, signed by VanDeWeghe to Emirates President Timothy Clark, stated that “Liwa North America and CEO Paul Edalat has provided this introduction and will continue to assist in seeing the process through.” An earlier email from VanDeWeghe told Edalat: “The timing could not be better… We would like you to relay our interest to Timothy Clark, President of Emirates.”¹

Edalat then flew to Dubai in May 2014 to meet Boutros Boutros, Emirates’ divisional senior vice president for corporate communications, marketing, and brand, who oversees the airline’s sponsorship deals globally.³ He got in through a Dubai contact named Zaki Kada, who connected him to Salem Ghanem Al-Marri, Emirates’ head of planning, aeropolitical, and industry affairs.¹

Why Nothing Happened for Nearly a Decade

Talks continued into 2015. A “highly confidential” email cited in the complaint shows Edalat and VanDeWeghe discussing a potential $6 million sponsorship. NBA Deputy Commissioner Mark Tatum also emailed Edalat that year: “We are still very interested in having a discussion with Emirates about a partnership. Let’s set up a call or meeting to discuss.” Two senior NBA business executives met with Edalat about the potential deal.¹

Then the discussions stalled. The NBA renewed with Delta Air Lines in 2015 on a 10-year agreement. Edalat says he had no further contact with the league on the Emirates matter between 2015 and 2024.¹

The 2024 Deal That Triggered the Lawsuit

In February 2024, the NBA announced a multiyear global marketing partnership with Emirates. The airline was named the “Official Global Airline Partner of the NBA” and the inaugural title sponsor of the rebranded Emirates NBA Cup. Emirates also became the first-ever referee jersey patch partner in league history, with branding debuting at the 2024 All-Star Game. The deal covered the WNBA and NBA G League as well.⁴

Emirates executive Boutros Boutros told CNBC in February 2024 that the airline estimates the partnership will generate “$500 million a year in advertising revenue.”⁵ Edalat says he saw none of it.

What Edalat Is Asking For

The complaint, filed in Orange County Circuit Court in Florida in March 2025, was designated a “Complex Case” and later transferred to federal court in the Southern District of New York.⁶¹

The formal filing seeks damages exceeding $500,000, but the real stakes are much larger. A pre-suit letter from Edalat’s attorney to the league pegged the Emirates sponsorship at “$60 million plus other unknown economic benefits.”¹ A 10% commission on that figure alone would run into the millions. Neither the NBA nor Emirates has publicly confirmed the deal’s exact value.

The NBA’s Response

The league denies any compensation agreement ever existed. An April 2024 letter from an NBA lawyer, responding to Edalat’s initial claim, stated: “Any interactions Edalat may have had with Emirates and a member of the NBA’s Basketball Operations group in 2014 have no relevance to the Emirates partnership that the NBA directly negotiated and announced a decade later.”¹ Byrd characterized the league’s initial reaction more bluntly: “Who are you? We have no idea who you are. Don’t bug us.”²

In its motion to dismiss, the NBA argued the complaint contains “virtually no details about the terms of this supposed agreement” and rests on “only vague allegations of an oral agreement.” The league also said the complaint “confirms he provided no services whatsoever between 2015 and 2024 with respect to any deal between the NBA and Emirates.”¹

The league further disputes that it needed a middleman at all. It notes Emirates had already sponsored NBA games in China in 2012 and 2013, and cites 2013 reports of direct discussions between the two organizations before VanDeWeghe ever contacted Edalat.¹

The VanDeWeghe Question

A central wrinkle is that Kiki VanDeWeghe ran basketball operations, not the NBA’s business or sponsorship side. His portfolio covered officiating, rule changes, player discipline, and team communication.⁷ He joined the league office in April 2013 as a vice president, was elevated to senior vice president later that year, and became executive vice president in August 2015.⁸

The league leans on that distinction, framing Edalat’s 2014 contacts as interactions with “a member of the NBA’s Basketball Operations group” with no bearing on a sponsorship the business side later negotiated. Edalat counters with the NBA-letterhead letter to Emirates’ president and the follow-up email from Deputy Commissioner Mark Tatum, arguing the engagement went well beyond an informal introduction by one executive.

Edalat’s Separate SEC Case

Edalat’s credibility carries baggage. In September 2022, the Securities and Exchange Commission sued him, his company Vivera Pharmaceuticals, and an affiliate called Sentar Pharmaceuticals, alleging an offering fraud that raised roughly $6.6 million from 63 investors between 2018 and 2020.⁹

The SEC alleged Vivera told investors it held an “exclusive global license” for sublingual drug-delivery technology used for CBD and THC products, when in fact the licensor, Sentar, was controlled by Edalat and had already conveyed the same license elsewhere. After Vivera lost a 2020 court challenge over that competing claim, it kept paying Sentar. The SEC said $4.5 million in “licensing fees” flowed to Sentar and then to accounts Edalat controlled, funding personal expenses including a $425,000 luxury car and down payments on two homes. The complaint also noted a prior FDA consent decree barring Edalat from manufacturing or distributing dietary supplements.¹⁰

In November 2025, a California federal judge granted the SEC an early win, finding the defendants “misled investors about the company’s rights to key cannabinoid drug-delivery technology and about how investor money would be spent.”¹¹

Where the Case Stands

As of early 2026, Edalat v. NBA is active in the Southern District of New York. The NBA’s motion to dismiss is pending. No trial date has been set, and there is no public sign of settlement talks. Byrd has said he wants to take the case to trial.¹

The case turns on two questions. Can an alleged verbal commission agreement from 2014 entitle someone to a cut of a deal signed a decade later? And is the documentary trail Edalat has produced — the letter to Timothy Clark, the emails from VanDeWeghe and Tatum — enough to prove that agreement existed at all?
