If your premature baby developed necrotizing enterocolitis after being fed cow’s milk-based formula in a NICU, NEC lawsuit attorneys handle these claims as individual product liability cases against Abbott Laboratories, maker of Similac, and Mead Johnson, maker of Enfamil. This is a mass tort, not a class action, so each family files a separate lawsuit and compensation is tailored to the specific child’s injuries rather than divided among a group.1TorHoerman Law. Who Qualifies to Bring an NEC Claim
Before a lawyer will take your case, they need to see that a few basic facts line up. Generally, the child must have been born prematurely, been fed cow’s milk-based formula in a NICU setting, and then developed NEC that required medical intervention such as surgery, or that led to severe complications or death.3Fuchsberg Law. NEC Baby Formula Lawsuit Qualifications
The documentation an attorney will want includes medical records confirming the premature birth, hospital records identifying the specific formula administered, records of the NEC diagnosis and treatment, and, eventually, expert testimony connecting the formula to the injury. If you don’t have all of these on hand, that’s normal. A firm handling NEC cases will help retrieve them.
Deadlines to Watch
Statutes of limitations vary sharply from state to state, and they’ve already started to bite. Many states allow two to three years from the date of discovery for product liability claims, and provisions for minors can extend deadlines until a child turns 18. Wrongful death and medical malpractice claims often have shorter windows. New York, for example, allows three years for product liability but only two and a half years for medical malpractice; California allows two years for product liability with a discovery-rule extension.3Fuchsberg Law. Some courts have already granted defense motions to dismiss NEC cases on statute-of-limitations grounds. If you think you may have a claim, the deadline analysis is one of the first things a lawyer will run.
What NEC Attorneys Actually Do in These Cases
Two decisions shape most NEC cases, and both belong to your lawyer: where to file, and how to prove causation.
Federal MDL or State Court
The federal MDL centralizes pretrial work for hundreds of cases, roughly 780 of which remained pending as of mid-2026.4Miller & Zois. Formula NEC Lawsuit It has been a difficult venue for plaintiffs so far. The first three bellwether cases against Abbott ended in defense wins on summary judgment after the court excluded or found insufficient the plaintiffs’ specific-causation evidence.5Motley Rice. State courts, particularly in Illinois and Missouri, have applied different expert-admissibility standards and produced very different results, including several substantial plaintiff verdicts. An Illinois appellate court upheld the consolidation of thousands of NEC cases in Madison County, Illinois, which has become a focal point for plaintiffs’ filings.2TruLaw. Which venue makes sense depends on where your child was treated, where you live, which formula was used, and how the causation evidence in your case looks. Ask any lawyer you interview to explain their venue choice for you specifically.
Causation Experts
Causation evidence has been the decisive battleground in nearly every NEC trial to date. Manufacturers have used Daubert challenges aggressively to try to exclude plaintiffs’ experts, arguing that their methods lack rigor or that their opinions do not fit the specific facts of a given infant’s case.7Lawsuit Information Center. NEC Baby Formula Lawsuits Those challenges succeeded in the first federal bellwethers and failed in the state trials that produced large verdicts.
What this means for hiring counsel: a firm’s access to neonatologists, pediatric surgeons, and life-care planners who can testify credibly and survive a Daubert motion is not an optional extra. It is the case.
Track Record: Verdicts That Signal Experience
Plaintiffs have secured more than $625 million in combined trial verdicts. Looking at who tried them is one way to size up the firms marketing NEC representation.
Gill v. Abbott — $495 million. On July 26, 2024, a St. Louis jury awarded $495 million against Abbott on behalf of Margo Gill’s daughter, Robynn Davis, who developed NEC after being fed Similac. The verdict included $95 million in compensatory damages and $400 million in punitive damages. $60 million against Mead Johnson. In March 2024, a St. Clair County, Illinois jury awarded $60 million to the mother of an infant who died from NEC after being fed Enfamil, the first plaintiff verdict in the litigation. The verdict is under appeal.10TorHoerman Law. Toxic Baby Formula NEC Lawsuit
$31.9 million Connecticut informed consent case. In December 2025, a Connecticut Superior Court awarded nearly $32 million to the parents of Aries-Reign Peterson, a premature infant who died of NEC after being fed bovine-based fortifiers at Yale New Haven Hospital. The court found the hospital failed to obtain informed consent and characterized its conduct as battery under Connecticut law. Attorneys Steve Reck and Austin Johns of Levin, Rojas, Camassar & Reck tried the case.11WFSB. Connecticut Court Awards $32 Million in Baby’s Death at Yale New Haven Hospital12WTNH. MDL Leadership
Judge Pallmeyer appointed a team of plaintiffs’ co-lead counsel to run the federal MDL: Timothy J. Becker of Johnson Becker, Wendy Fleishman of Lieff Cabraser Heimann & Bernstein, C. Andrew Childers of Levin Papantonio, José M. Rojas of Levin Rojas Camassar & Reck, and Diandra S. Debrosse of DiCello Levitt.13U.S. District Court, Northern District of Illinois. Any firm you consider does not have to be on that roster, but it should be able to explain how it works with, or independently of, the MDL leadership.
Fees and Costs
Most NEC attorneys work on a contingency fee basis. You pay nothing upfront, and the attorney collects a percentage of any settlement or verdict. Litigation expenses, including expert witness fees, medical record retrieval, and court costs, are typically advanced by the firm and recouped from any recovery.1TorHoerman Law. Is There a Baby Formula NEC Class Action Lawsuit Specific percentage rates vary by firm and are generally not published. Ask for written fee terms before you sign a retainer agreement, and make sure the agreement spells out what happens to advanced costs if the case does not result in a recovery.
Questions to Ask Before You Hire
A short list of questions worth putting to any firm you interview:
- How many NEC cases have you handled, and have any gone to trial or through significant motion practice?
- Would you file my case in the federal MDL or in a state court, and why?
- Which causation experts do you work with, and how have they held up against Daubert challenges?
- Who at the firm will actually work my case day to day, and who would try it if it goes to a jury?
- What is the contingency percentage, and how are advanced costs handled if we lose?
- What is the statute of limitations for my state and my circumstances, and how quickly do we need to file?
What Compensation Can Cover
Damages in NEC cases can include medical expenses for NICU stays, surgeries, and long-term care; lost wages for parents; pain and suffering for the child and family; and, in cases where the infant died, wrongful death compensation including funeral costs and loss of companionship. Juries have awarded punitive damages where they found the manufacturers’ conduct especially egregious.
No global settlement has been reached as of mid-2026. Industry estimates project that individual case settlements, if they occur, could range from roughly $50,000 to $600,000 for non-fatal injuries, $1 million to $10 million for cases involving permanent disability, and potentially more than $50 million for wrongful death.14Drugwatch. Baby Formula Settlement Bloomberg Intelligence analysts have estimated the combined liability exposure for Abbott and Mead Johnson at approximately $3 billion across all pending and anticipated cases.15Claims Journal. Abbott Formula Liability State court trial verdicts have far exceeded those ranges, though large jury awards are often reduced on appeal or used as leverage in settlement negotiations rather than collected in full.
The next set of trials will shape what any settlement eventually looks like. The Inman v. Mead Johnson bellwether, alleging Enfamil caused the death of an infant named Daniel, is scheduled for July 6, 2026, and would be the first federal MDL case to reach a jury.16Courthouse News Service. Formula May Have Been Cause of Infant Death A second federal bellwether involving a Similac case is scheduled for August 2026. If you’re weighing whether to file, those trial outcomes and the pending statute-of-limitations clocks are the two things a lawyer will want to talk about first.
