Who Qualifies
The class covers any individual who purchased a qualifying mattress in the U.S. during the roughly seven-year window running from October 1, 2017 through June 30, 2024.2Dapeer Law. Dozens of models across four brands are covered. Commonly listed models include:
- Nectar Classic Memory Foam, Classic Hybrid, Premier, Premier Copper, Luxe Hybrid, Luxe Memory Foam, and Hybrid Original, plus variants with Nectarcool Technology.

The full list of qualifying SKUs and model numbers can be checked at the settlement website. The white tag sewn into the head or foot seam of your mattress carries the SKU or model number you’ll want to match.
What You Get
Every valid claim receives one store voucher per qualifying mattress. The voucher’s dollar value is not fixed. The $9 million Common Voucher Fund is divided by the total number of valid claims, so the amount depends on how many people file. What you need depends on what you have:
- If you received an email notice with a Unique ID and PIN, you can log in with those credentials directly.
- If you didn’t receive a notice but kept documentation, submit a receipt, store record, or photograph of the mattress’s product label showing the SKU or serial number.

The settlement has not yet received final court approval. Payments and vouchers won’t be distributed until after the September 24 hearing, assuming approval.
What the Lawsuit Alleged
The case, Jaime Todd, et al. v. Ashley Furniture Industries, Inc., et al., Case No. 3:24-cv-00615, was filed on August 30, 2024 in the U.S. District Court for the Western District of Wisconsin before Judge William M. Conley.7PACER Monitor. Todd, Jaime, et al v. Ashley Furniture Industries, Inc., et al The defendants are Ashley Furniture Industries, Ashley Global Retail, and Resident Home LLC, the parent of the Nectar, DreamCloud, and Siena brands.
The plaintiffs alleged that a woven fiberglass sock used inside the mattresses as a fire retardant can pass through or escape the outer cover, particularly when consumers unzip and remove that cover to wash it. Once disturbed, the fibers can spread through the home, embed in fabrics and carpeting, and cause skin, eye, and respiratory problems. Court filings describe the particles as “virtually impossible” to remove without professional remediation.8ClassAction.org. All three defendant groups deny wrongdoing and maintain that their mattresses have always complied with applicable safety laws. Resident Home said it settled “to avoid the risk, cost and time associated with continuing the lawsuit,” and stated that all its brands discontinued the use of fiberglass by the end of 2023.3Forbes. A Note on the Separate Nectar Case
A different class action, Aldrich v. Resident Home, LLC, Case No. 5:25-cv-01791, was filed in April 2026 in the U.S. District Court for the Central District of California and targets Nectar-brand mattresses specifically, including the Classic, Premier, Luxe, and Ultra models.9ClassAction.org. Aldrich v. Resident Home Complaint That case is separate from the Todd settlement and has no claim form. Filing in Todd is what makes you eligible for the $9 million voucher fund.
