Nikki Birth Control Lawsuit: Blood Clots and Closed U.S. Litigation

If you took Nikki birth control and suffered a blood clot, stroke, or gallbladder injury, a lawsuit against the manufacturer is unlikely to succeed in the United States. Nikki is a generic version of Bayer’s Yaz, made by Lupin Pharmaceuticals, and it contains the same drospirenone formulation that drove more than 18,000 lawsuits and roughly $2 billion in settlements against Bayer. But a 2011 Supreme Court decision largely shields generic drug makers from failure-to-warn claims, and the federal litigation that resolved the drospirenone cases closed in January 2019. What Nikki Is

Nikki is a combination oral contraceptive containing drospirenone, a synthetic form of progesterone. Lupin Pharmaceuticals manufactures it as a generic equivalent of Yaz. Other generics in the same family include Ocella and Gianvi (Barr Laboratories, distributed by Teva), Syeda, Loryna, Vestura, and Zarah.1Drugs.com. Why You Generally Can’t Sue Lupin Over Nikki

The Supreme Court’s 2011 decision in PLIVA, Inc. v. Mensing held that generic manufacturers cannot be sued under state law for failure to warn. Federal regulations require a generic maker to use the exact same label as the brand-name drug, so a state-law claim demanding a stronger warning is pre-empted by federal law.3Justia. PLIVA, Inc. v. Mensing That ruling covers Lupin’s Nikki along with the other drospirenone generics, and it channels most failure-to-warn liability back to Bayer as the brand-name manufacturer.

Practically, that means women injured while taking Nikki have had far narrower legal options than women who took Yaz or Yasmin. Some plaintiffs in the broader drospirenone litigation did name generic makers alongside Bayer, but the pre-emption defense has been the dominant barrier for those claims.

The Blood Clot Risk Behind the Lawsuits

All combination birth control pills carry some risk of blood clots. Studies published in the late 2000s indicated drospirenone pills carried a higher risk than older formulations. The FDA estimated that roughly 10 out of every 10,000 women taking a drospirenone pill would develop a blood clot over one year, compared with about 6 out of 10,000 women taking an older contraceptive containing levonorgestrel.4Women’s Mental Health. In April 2012, the FDA ordered updated labels for Yaz, Yasmin, Beyaz, Safyral, and all their generic equivalents, including Nikki. The revised label stated that some epidemiologic studies had found up to a three-fold increase in blood clot risk for drospirenone users compared with users of older progestins, while other studies found no additional risk.5FDA. The Yaz and Yasmin Settlements

In October 2009, the U.S. Judicial Panel on Multidistrict Litigation consolidated thousands of individual lawsuits into In re: Yasmin and Yaz (Drospirenone) Marketing, Sales Practices and Products Liability Litigation, MDL No. 2100, in the U.S. District Court for the Southern District of Illinois before Judge David R. By early 2016, Bayer had agreed to pay approximately $2 billion across more than 18,000 U.S. lawsuits without admitting wrongdoing.9Drugwatch. Yaz Settlements The settlements were organized by injury:

  • Blood clot injuries (DVT and pulmonary embolism): about $2.04 billion to resolve roughly 10,300 claims. Early 2012 settlements averaged around $220,000 per claim.9Drugwatch. Yaz Settlements

The U.S. Litigation Is Closed

The Plaintiffs’ Steering Committee disbanded on November 20, 2018. Judge Herndon issued a final order recommending termination of MDL 2100 on December 18, 2018, and the MDL closed on January 4, 2019, with more than 19,000 lawsuits resolved.12Drugwatch. The Canadian Class Action

Canada has an active resolution route, but it does not cover Nikki. Class actions against Bayer Inc. filed in Ontario, Saskatchewan, and Quebec were certified over several years, with Ontario certified in April 2013 and Saskatchewan in September 2015, and produced a proposed settlement fund of CAD $9.05 million. The Canadian settlement covers Canadian residents prescribed Yasmin or Yaz during defined class periods who were later diagnosed with venous thromboembolism, arterial thromboembolism, or gallbladder disease. Maximum individual payouts range from $500 for gallbladder disease to $9,000 for blood clots and $13,500 where a blood clot caused death. Where This Leaves Nikki Users

If you were injured while taking Nikki, the practical picture is narrow. The Yaz/Yasmin settlements are closed, the MDL is terminated, and Lupin as a generic maker is largely protected from failure-to-warn claims under PLIVA v. Mensing. The Canadian settlement is limited to the brand-name pills. The medical risk described in the FDA-mandated label applies to Nikki just as it applies to Yaz, but the legal remedies developed around that risk were built against the brand-name manufacturer.
