Northwestern Class Action Lawsuit Settlements and Payouts

Northwestern University’s class action settlements include a $43.5 million payout in a financial aid antitrust case and a $4 million agreement to resolve COVID-era tuition claims, alongside confidential settlements with former football players and former head coach Pat Fitzgerald over the program’s hazing scandal. A separate class action over the university’s employee health plan is still pending. The $43.5 Million Financial Aid Antitrust Settlement

The largest class action payout from Northwestern comes out of Henry, et al. v. Brown University, et al., filed January 9, 2022, in the U.S. District Court for the Northern District of Illinois before Judge Matthew F. Kennelly.1CourtListener. Henry v. Brown University The suit accused Northwestern and sixteen other elite universities of operating what the plaintiffs called a “price-fixing cartel” through the 568 Presidents Group, using a shared “Consensus Methodology” to calculate financial need in a way that reduced aid awards for roughly 200,000 students.2Berger Montague. The universities had operated under a temporary antitrust exemption in Section 568 of the Improving America’s Schools Act of 1994, but that exemption required every participating school to admit students on a strictly need-blind basis. Plaintiffs argued the exemption did not apply because some members considered applicants’ finances. In August 2022, Judge Kennelly agreed the case could proceed, holding that if even one school failed the need-blind requirement, the immunity failed for every member.3Temple University 10-Q. All seventeen universities eventually settled. Northwestern’s $43.5 million was the second-largest individual settlement, behind Vanderbilt’s $55 million. Who Qualifies and When Payments Are Coming

To claim from any of the settlements in this case, you must have been a U.S. citizen or permanent resident who enrolled full-time as an undergraduate at one of the seventeen defendant universities during the applicable class period, received at least some need-based financial aid, and paid tuition, fees, room, or board that was not fully covered by non-loan financial or merit aid. One point worth understanding: class members can recover from the combined settlement pool regardless of which of the seventeen schools they attended. A Yale graduate can share in the Northwestern money, and vice versa.

As of early 2026, no payments had gone out. Settlement class counsel filed a motion asking the court to authorize distribution beginning March 9, 2026. The settlement administrator has estimated that if roughly half of the 200,000 eligible class members file claims, the average check will come to about $2,000.6Financial Aid Antitrust Settlement. The $4 Million COVID-19 Tuition Refund Settlement

Northwestern separately agreed to a $4 million settlement covering students who paid for in-person education during the spring, summer, and fall 2020 quarters, when the university shifted to virtual learning. The class covers full-time students enrolled in degree-conferring programs at Northwestern’s U.S. campuses during those three quarters whose tuition was not fully funded by the university. The settlement received preliminary approval, with the final approval hearing scheduled for August 7, 2026, before Judge Lindsay C. Jenkins. Football Hazing Settlements

Beginning in 2023, dozens of former Northwestern football players filed lawsuits describing sexualized hazing rituals, forced nudity, and racist taunts within the program. Plaintiffs’ attorneys identified 81 athletes with relevant information.10ESPN. Northwestern Working to Settle Hazing Lawsuits

In April 2025, the university reached a provisional settlement with a group of student plaintiffs. A university spokesperson said the agreement would “fully resolve the student plaintiffs’ claims” against both the school and former head coach Pat Fitzgerald. Pat Fitzgerald’s Wrongful Termination Settlement

Fitzgerald, fired in July 2023, sued Northwestern for breach of contract, defamation, and intentional infliction of emotional distress, seeking $130 million and maintaining he had no knowledge of any hazing.12ABC 7 Chicago. Financial terms were not disclosed. Northwestern acknowledged in a joint statement that extensive discovery “did not establish that any player reported hazing to Coach Fitzgerald or that Coach Fitzgerald condoned or directed any hazing,” and said it had implemented new training and reporting measures.13Northwestern University. Employee Health Plan Class Action (Still Pending)

One major class action against Northwestern has not settled. On June 20, 2025, two former employees filed Barbic et al. v. Northwestern University et al. (Case No. 1:25-cv-06849) in the Northern District of Illinois, alleging violations of the Employee Retirement Income Security Act. The plaintiffs claim Northwestern’s employee health plan offered a “premium” PPO tier that was “financially dominated” by a lower-cost “value” tier, meaning participants paid higher fees without meaningful added benefits.14Bloomberg Tax. As of April 2026, the court denied Northwestern’s motion to dismiss, and the case is moving forward.16Law360. Northwestern Can’t Escape ERISA Fight Over Health Offerings No class has been certified and no settlement exists.

What Isn’t a Northwestern Settlement

Two categories may come up in searches but do not produce money for Northwestern class members. A second financial aid antitrust case, Hansen et al. v. Northwestern University et al., targeting 40 universities and the College Board over the CSS Profile’s treatment of noncustodial parent income, was dismissed by Judge Sara L. Ellis on September 24, 2025. The dismissal was without prejudice, so plaintiffs could refile an amended complaint, but no settlement has been reached.17Justia. Hansen et al v. Several individual lawsuits against Northwestern, including a wrongful death and discrimination suit filed by the estate of Feinberg professor Jane Wu, a retaliation suit by former Gender and Sexuality Resource Center director Matt Abtahi, and separate athletics-related suits, are not class actions and would not produce payments to a broader group.19Daily Northwestern.
