Nursing home lawsuit settlements average roughly $406,000, with individual outcomes ranging from five-figure payouts for minor injuries to eight-figure verdicts in cases involving death or egregious misconduct.1Ben Crump Law. How Much Money Is a Nursing Home Abuse Settlement Plaintiffs recover some form of compensation in about 88% of cases, and fewer than 12% ever reach trial.2The Berberian Firm. How Nursing Home Abuse Settlements Work What a particular case is worth depends far more on the specifics than on the average.
Typical Settlement Ranges by Type of Claim
Settlement values track closely with what happened to the resident. Medication errors and large-scale neglect tend to produce the highest payouts; fractures and infections generally settle for less. The ranges below reflect reported case results.
- Medication errors: roughly $914,000 to $4.1 million. One case involving an 87-year-old resident who died after a facility failed to administer life-sustaining medication for 26 days settled for $910,000. A separate medication error suit produced a $5.5 million jury verdict.3Berman & Riedel, LLP. Nursing Home Abuse Case Results4Senior Justice Law Firm. Case Results
- Bedsores and pressure ulcers: roughly $500,000 to $2.8 million in settlements. A retrospective analysis of 141 pressure-ulcer malpractice cases found that when nursing homes were held liable, the mean payout was about $4 million. A Los Angeles jury awarded $7.75 million for Stage IV ulcers involving sepsis and failure to reposition.5National Library of Medicine. Pressure Ulcer Malpractice Cases Analysis6Helbock Law. Stage 4 Bedsore Lawsuit Settlement Amounts
- Falls: commonly $100,000 to $620,000 for non-fatal injuries, with much higher outcomes in fatal cases. A California jury awarded $20.5 million in 2024 to the family of an 84-year-old man who died after multiple falls in an assisted living facility. Between 50% and 75% of nursing home residents experience at least one fall each year.7LawFirm.com. Nursing Home Falls and Fractures
- Malnutrition and dehydration: typically $500,000 to $1 million, with much larger verdicts when facilities show extreme indifference. A Kentucky jury awarded $42.75 million after a 92-year-old veteran died from severe dehydration just nine days after admission, including $40 million in punitive damages.8Sokolove Law. Nursing Home Dehydration
- Wrongful death: wide range, from about $200,000 in straightforward cases to millions when systemic failure is proven. In Michigan, reported wrongful death results have ranged from $200,000 for a hospice bedrail entanglement to a $5.2 million assisted living verdict.9Buckfire Law. Nursing Home Abuse Settlements
- Elopement (wandering): one-third of elopement cases result in death, often from exposure. A 2026 California verdict reached $110 million after a dementia patient wandered outside and died. A Michigan case involving a dementia patient who froze to death after walking through an unlocked door settled for $875,000.10Nursing Home Abuse Center. Nursing Home Elopement11Buckfire Law. - Sexual abuse: generally $710,000 to $3 million. Evidence can be difficult because many victims have cognitive impairments that complicate identifying the perpetrator. An Illinois jury awarded $2.25 million to a 78-year-old resident sexually assaulted by an aide.12O’Connor Law Group. Nursing Home Negligence
According to VerdictSearch data, the average nursing home abuse verdict is approximately $2.36 million, with a median payout of $750,000.13Nursing Home Law Center. What Drives a Settlement Up or Down
No two nursing home cases settle for the same amount. The spread between a $100,000 outcome and a multimillion-dollar one usually comes down to a few variables.
Severity of harm is the biggest driver. Permanent disability, amputation, and death produce far larger payouts than recoverable injuries. A bedsore that heals in weeks is worth a fraction of one that progresses to Stage IV, exposes bone, and leads to sepsis.14Nursing Home Abuse Center. Nursing Home Abuse Settlements
Strength of evidence matters almost as much. Medical records, staffing logs, state inspection reports, and incident reports form the backbone of any claim. When records show that a facility was already cited for the same deficiency that caused a resident’s injury, case value climbs. Gaps in documentation or weak expert testimony work the other way, and the defense offers less.15Peterson, Revilla, & Gentry. Factors That Affect Nursing Home Neglect Settlements Falsified care logs are especially damaging: missing entries, impossible timestamps (such as medication charted while the resident was hospitalized), contradictory staff notes, and backdated charts all surface during review.16Rafferty Domnick Cunningham & Yaffa. Documenting Nursing Home Abuse: Building a Strong Legal Case
Facility conduct can open the door to punitive damages. Falsified logs, documented understaffing for profit, and evidence that administrators knew about dangerous conditions all support punitive awards. Approximately 17% of nursing home abuse cases include punitive damages.1Ben Crump Law. How Much Money Is a Nursing Home Abuse Settlement In Florida, punitive damages require proof by clear and convincing evidence that the defendant acted with gross negligence or intentional misconduct, and when intentional misconduct is proven, statutory caps on punitive damages do not apply.17Rafferty Domnick Cunningham & Yaffa. Nursing Home Abuse Cases: How Punitive Damages Can Make a Difference
Insurance coverage sets a practical ceiling. Independent nursing homes typically carry $1 million to $3 million in liability coverage, while large corporate chains may carry $5 million to $25 million or more.18Victims Lawyer. Average Elder Abuse Nursing Home Settlement in California 2026 Guide A jury can award any number it chooses, but plaintiffs can only collect what the defendant can actually pay. Reaching a corporate parent for additional coverage generally requires piercing the corporate veil, which demands evidence that the parent dominated the subsidiary’s finances and that the structure was used to shield assets rather than serve a legitimate business purpose.19Downey Law. Nursing Home Structure
Jurisdiction shapes the whole landscape. About 29 states impose some form of cap on medical malpractice damages, and these caps often apply to nursing home cases.20Miller & Zois. Malpractice Damage Caps Five states have constitutional provisions prohibiting caps on general tort damages: Arizona, Arkansas, Kentucky, Pennsylvania, and Wyoming.21Center for Justice and Democracy. Caps on Compensatory Damages, State Law Summary In capped states, jury awards above the limit are reduced by the court, which pulls the settlement range down with them.
The Largest Known Verdicts
Verdicts in nursing home cases can dwarf settlement amounts, especially where punitive damages are available. Reported high-end results include:
- $200 million (Florida, 2012): Elvira Nunziata, 92, died after falling down stairs while strapped in her wheelchair at Pinellas Park Care and Rehab Center. The facility knew she tended to wander but failed to monitor her.22Knapp & Roberts. Largest Nursing Home Abuse Verdicts

How Arbitration Clauses Can Change the Math
Many nursing homes slip pre-dispute arbitration agreements into their admission paperwork. If signed, the clause waives the right to sue in court and sends any future dispute to a private arbitrator. The U.S. Supreme Court upheld the enforceability of these agreements in Kindred Nursing Centers v. Clark (2017), ruling 7-1 that the Federal Arbitration Act requires courts to treat arbitration clauses like any other contract.24Quarles & Brady. US Supreme Court Confirms Enforceability of Health Care Arbitration Agreements
The impact on recovery is dramatic. Arbitration produces a defense win rate of about 85%, compared to a 25% defense win rate across jury trials and settlements. Average arbitration awards run approximately $38,900, while 23% of jury verdicts exceed $500,000.25M3 Insurance. Arbitration Agreements in Senior Living
Federal rules provide some protection. Under current CMS requirements, nursing homes cannot require residents to sign an arbitration agreement as a condition of admission. The agreement must be explained in understandable language, both sides must agree on a neutral arbitrator, and residents have 30 days to rescind after signing.26Caring for the Ages. Arbitration Agreements in Nursing Homes Assisted living facilities are not subject to the same CMS restrictions and may include arbitration as a mandatory term of admission.25M3 Insurance. Arbitration Agreements in Senior Living Pulling the admission file and checking for a signed arbitration clause is one of the first things an attorney will do.
What Families Actually Receive After Fees and Liens
Published settlement figures are gross numbers. The money that reaches a family is less.
Nearly all nursing home abuse attorneys work on contingency, charging nothing upfront and collecting a percentage of the recovery only if the case succeeds. The standard rate is roughly 33% if the case settles before litigation and 40% once a lawsuit is filed and the case advances toward trial.27Levi Law. How Much Does It Cost to Hire a Personal Injury Lawyer Some states impose sliding scales for medical malpractice. In New York, attorney fees on malpractice recoveries start at 30% of the first $250,000 and decline to 10% of amounts over $1.25 million.28LoTempio P.C. How Much Does It Cost to Hire a Nursing Home Abuse Attorney
Case costs come out of the gross as well: filing fees, expert witnesses (often $3,000 to $10,000 per expert), court reporters, and medical record retrieval. After fees and costs, outstanding medical liens from Medicare, Medicaid, or private insurers are paid. Attorneys frequently negotiate these liens down by 30% to 50%.27Levi Law. How Much Does It Cost to Hire a Personal Injury Lawyer In wrongful death cases or those involving a vulnerable adult, court approval of the settlement distribution may be required, adding months before any check is issued.29Powers Taylor Law. Deadlines to File
Every state imposes a deadline for filing a nursing home lawsuit, and once it passes, the right to sue is gone. The window ranges from one to six years, though most states set it at two or three years from the date the injury was discovered or should have been discovered.30Nursing Home Abuse Center. Statute of Limitations
Kentucky and Tennessee are shortest at one year. Maine, Minnesota, and North Dakota reach six. California, Florida, Illinois, New York, and Texas fall in the two-to-three-year band. Wrongful death claims sometimes run on a different clock than personal injury claims, and lawsuits against government-run facilities can be limited to as little as one year. Some states extend the deadline when a facility intentionally conceals evidence of abuse; in Illinois, fraudulent concealment can push the limit from two years to five.31Nursing Home Law Center. Illinois Nursing Home Lawsuit Settlements Evidence is also easier to secure early. Records can be altered or lost, and witnesses become harder to locate the longer a family waits.
A Note on COVID-Era Claims
More than 1,000 lawsuits allege that nursing homes failed to follow COVID-19 protocols, contributing to outbreaks that killed tens of thousands of residents.32American Bar Association. Nursing Homes Wield Pandemic Immunity Laws to Duck Wrongful Death Suits These claims do not follow the usual settlement patterns. Several states enacted liability shields: Florida’s statute (F.S. 768.38) grants immunity to defendants who made a good-faith effort to comply with government health guidance, requires plaintiffs to prove gross negligence by clear and convincing evidence, and imposes a shortened one-year statute of limitations.33Florida Legislature. F.S. 768.38 Liability Protections for COVID-19-Related Claims Nursing homes also tried to move these cases to federal court under the PREP Act of 2005, but federal courts broadly rejected that strategy. In Estate of Maglioli v. Alliance HC Holdings (3rd Cir. 2021), the Third Circuit ruled that the PREP Act does not provide immunity from claims based on inaction or general negligence and that these cases belong in state court.34Center for Medicare Advocacy. State Courts Will Decide SNF COVID Suits If a claim involves a pandemic-era death, the applicable state immunity statute and its shortened deadline should be checked before anything else.
