What NV Energy Did Wrong
Starting around 2002, NV Energy rolled out a lower rate for multifamily residential customers, meaning people living in apartments, condos, townhomes, and duplexes. Roughly 43,000 of those accounts were never actually switched to the new, cheaper rate. They stayed classified as single-family residential and kept paying more. The utility didn’t come forward on its own. The problem surfaced only after affected customers complained to state regulators about receiving small, inadequate refunds.4The Nevada Independent. Most affected customers, about 37,500 accounts, are in Southern Nevada. Another 7,800 are in Northern Nevada.6Nevada Current. NV Energy first tried to limit refunds to six months of overcharges, citing a 1980-era tariff rule. That would have paid out under $2 million total to more than 80,000 people. State regulators rejected that reading. One caveat worth knowing: customers overcharged between 2002 and 2017 may receive refunds based on estimates rather than exact billing records, because NV Energy says it doesn’t have detailed data from those earlier years.9KTNV. How and When You’ll Get Paid
How the money reaches you depends on whether you still have service:
- If you are a current NV Energy customer, your refund will be applied as a credit on your power bill.
- If you are a former customer, a check will be mailed to your last known address.

Under the order, refunds had to start going out within 120 days of the February 24, 2026 decision and must be complete within 210 days, putting the final deadline around late September 2026. Of the roughly $63 million, about $57.3 million represents new money on top of smaller refunds NV Energy had already begun issuing in late 2024 and early 2025 before pausing them when the regulatory investigation opened. Guardrails Built Into the Settlement
The Public Utilities Commission didn’t just order refunds. It also required NV Energy to hire a third-party auditor to verify that every misclassified customer was correctly identified, to submit a certificate confirming refunds went out, and to launch a customer education program covering rate classifications and how to read a bill.9KTNV. Nevada lawmakers also passed Assembly Bill 452 in 2025, signed by Governor Joe Lombardo, which requires utilities in the state to fully refund overcharged customers with interest whenever billing errors occur.11KTNV. Not the Same as the Demand Charge Lawsuits
If you’ve been reading about NV Energy in court, you may be seeing a separate fight. In September 2025, the PUCN approved a “daily demand charge” that will bill Southern Nevada residential and small business customers partly based on their highest 15-minute period of electricity use each day, at 14 cents per kilowatt. The commission also changed how rooftop solar net metering credits are calculated for Northern Nevada systems installed after October 2025.12Utility Dive. Vote Solar, represented by Earthjustice, filed a petition for judicial review in Carson City on November 26, 2025. Nevada Attorney General Aaron Ford’s Bureau of Consumer Protection filed a similar challenge in Clark County on December 10, 2025, adding a dispute over $2.7 million in affiliate charges being passed on to ratepayers.13KTNV. That litigation is about future rates, not past overcharges. Nothing about it changes the $63 million refund process.
The One Actual Class Action Against NV Energy
The overcharge case is often called a class action in casual reporting, but the real class action to bear the name was filed a decade earlier. In January 2016, two Las Vegas residents, John Bamforth and Stanley Schone, sued on behalf of roughly 15,000 Nevada solar customers after the PUCN approved rules in December 2015 that tripled monthly grid maintenance fees from $12 to $40 and cut net metering compensation to about a third of the retail electricity price.16PV Tech.
