Oliver Fell Case: Charges, Firing, and Family Lawsuit

Oliver Fell is a former Carlos E. Haile Middle School teacher in Bradenton, Florida, who was arrested on June 2, 2025, after being accused of sending a nude photograph to a 14-year-old student over Snapchat. The Oliver Fell teacher case drew national attention because of a second twist: the student who reported her was suspended by school administrators for making the accusation.¹²

The Charges

Fell, 28, turned herself in to the Manatee County Sheriff’s Office after an arrest warrant was issued. She faces two charges: lewd conduct with a student by an authority figure, a second-degree felony, and transmission of harmful material to a minor, a third-degree felony.³

Florida Statute 800.101 defines an “authority figure” as any person 18 or older employed by, volunteering at, or under contract with a school, and makes it a second-degree felony for that person to solicit or engage in sexual conduct, lewd conduct, or a romantic relationship with a student.⁴

What Investigators Say Happened

According to the probable cause affidavit, Fell began exchanging messages with the student on Snapchat in December 2024. The exchanges escalated, and on or around January 2, 2025, she allegedly sent him a nude photograph.⁵

School resource deputy Sadrac Augustin learned of the allegations on March 3, 2025, when the student came forward. Another student’s phone held a screenshot of a Snapchat exchange with a user named “Oliver” marked by a purple cat emoji. A warrant-authorized search of the victim’s phone turned up a semi-nude photo and two clothed images that matched pictures on Fell’s public Instagram account. On May 12, 2025, detectives received additional records from Snapchat.³⁵

When Deputy Augustin first questioned Fell, she denied that the Snapchat account was hers and denied sending any images.³

Why the Student Was Suspended

The student’s mother, Beverly Hernandez, said school administrators did not believe her son. Rather than investigating, they suspended him for 10 days for making accusations against Fell.²⁶ The probable cause affidavit confirmed that school officials told Deputy Augustin the student was being disciplined for “making accusations” against the teacher.³

Hernandez also said neither the school nor the resource officer reported the allegations to Child Protective Services, and that she ultimately contacted the agency herself.² Under Florida Statute 800.101, knowingly failing to report a violation of the authority-figure misconduct law is a first-degree misdemeanor.⁴

The District’s Delay and Firing

Even after the March 3 report, Fell stayed in her teaching position for more than two months. She was not moved to a role without student contact until May 14, 2025.³ Haile Middle School Principal Irene Nikitopoulos wrote to parents that it had taken “several weeks of investigation to confirm the allegations of the illegal communications,” and that Fell was “immediately reassigned” once law enforcement provided confirmation.²

School Board Chair Chad Choate criticized that timeline publicly, saying Fell should have been placed on paid leave while the investigation was pending.⁷ The School Board of Manatee County voted to fire Fell at a public meeting on June 10, 2025. Hernandez addressed the board during that meeting, repeating her account of the school’s failure to report and her son’s suspension. Interim Superintendent Kevin Chapman announced the district would use a leadership conference to train employees on student safety and strengthen coordination with the Sheriff’s Office.⁶

The Family’s Legal Action

By mid-June 2025, Hernandez’s family had retained the law firm Mallard | Perez and filed a notice of intent to pursue legal action against the School Board of Manatee County. No formal lawsuit had been filed as of that date.⁸

A Wider Problem in Manatee County

Fell’s case was not isolated. A four-month joint investigation by the Bradenton Herald and Suncoast Searchlight, published in December 2025, reviewed personnel files, police reports, and civil lawsuits and found recurring failures in how the Manatee County School District screened employees and responded to misconduct. Reporters found that hiring officials had overlooked red flags on applications, including disqualifying questionnaire answers and out-of-state references that could not be reached. Fell herself had been hired despite disclosing a prior contract non-renewal. A sheriff’s captain quoted in the reporting described “prolonged holes in the reporting system,” and district staff had not received recent Title IX training.⁹

Superintendent Jason Wysong was terminated in May 2025, before the reporting was published, amid the fallout from these cases.¹⁰ His successor, Laurie Breslin, later launched a mandatory training program on staff-to-student misconduct, grooming, and reporting obligations, and said the district “took a closer look after the article.”¹¹
