Post-Judgment Asset Discovery: Debtor Exams and Subpoenas

Post-judgment asset discovery is the set of legal tools a judgment creditor uses to find out where a debtor’s money and property actually are, so the judgment can be collected rather than framed on a wall. Federal Rule of Civil Procedure 69 sets the baseline: a money judgment is enforced by a writ of execution, and the creditor can take discovery from any person, including the debtor, to locate assets worth pursuing.1Legal Information Institute. Federal Rules of Civil Procedure Rule 69 – Execution No court hands you a check. You find the assets, you choose the enforcement tool, and you drive the collection.

The work usually moves in three stages: public records first, a sworn examination of the debtor second, and targeted subpoenas to banks and other third parties to confirm or extend what you’ve learned. Each stage feeds the next.

Start With Public Records

County recorder offices show deed records, mortgages, and trust deeds, which together reveal real estate holdings and how much equity the debtor actually has after liens. Uniform Commercial Code filings show whether business equipment, inventory, or other personal property has been pledged as collateral. State vehicle registries identify cars, trucks, and boats. The Federal Aviation Administration maintains an aircraft registry for planes and helicopters.2Federal Aviation Administration. Aircraft Registration

Many creditors retain a private investigator or use a subscription database that aggregates these records into one report. The point of this phase is triage. If the debtor has visible equity in a home or a business with real equipment, the judgment is worth pursuing hard. If nothing surfaces, you can decide early whether to spend more on legal fees or wait and renew the judgment later.

Signs of Cryptocurrency Holdings

Crypto doesn’t appear in county records. The Department of Justice recommends starting with the debtor’s bank and credit card statements and looking for payments to or from exchanges such as Coinbase, Kraken, or Gemini. A long alphanumeric string on a statement typically represents a wallet address rather than a conventional account number. U.S.-based exchanges are regulated and keep customer records, so once you identify one the debtor uses, you can subpoena it and request a freeze on the debtor’s wallet to prevent transfers during collection.3U.S. Department of Justice. Investigating the Financial Affairs of a Debtor Who Has Cryptocurrency At the debtor’s examination, ask directly about email addresses used to open wallets, whether private keys sit on a USB drive or phone, and which exchanges they’ve used in the past twelve months.

The Judgment Debtor Examination

When public records don’t tell the whole story, the debtor examination is the strongest tool available. You file an application for an order of examination in the court that entered the judgment, listing the case number, the remaining balance, and the debtor’s full legal name and last known address. Filing fees generally fall in the $40 to $100 range. Most states cap the geography, often requiring the examination to be held within a set distance of the debtor’s home or workplace, so if the debtor lives far from the issuing court you may need to file in a court closer to them. Once a judge signs the order, it becomes a command to appear at a specific date and time.

Serving the Order

Personal service is required. A professional process server or a sheriff’s deputy must hand the papers to the debtor directly; mailing isn’t enough, because the order carries a warning that nonappearance can trigger an arrest warrant for contempt. The court needs proof of delivery. Service fees from law enforcement commonly run between $50 and $125.

What You Can Ask

The debtor testifies under oath, and lying carries perjury exposure. You can ask about bank account locations and balances, sources of income, interests in businesses or partnerships, debts owed to the debtor by third parties, real estate, trust interests, insurance policies, and recent transfers of property. The DOJ’s standard document request to judgment debtors reaches bank statements, canceled checks, stock certificates, tax returns, phone bills, and even passports.4U.S. Department of Justice. Request for Production of Documents to Judgment Debtor

Preparation is the difference between a useful exam and a wasted morning. Know what the public records show before you walk in and use the time to probe the gaps. If the recorder’s office shows a recent property sale, ask where the proceeds went. If bank statements show steady transfers to an unfamiliar account, ask who owns it. You can also demand that the debtor turn over any non-exempt property in their immediate possession, like cash or jewelry.

Bring a Court Reporter

A verbatim transcript, typically $75 to $400 depending on length, locks in the debtor’s sworn answers.5United States Courts. Federal Court Reporting Program If the debtor later claims different assets or different numbers, you have the record to prove it. Without a transcript, it becomes your memory against theirs.

If the Debtor Doesn’t Appear

A properly served debtor who ignores the order can be held in contempt. Courts can issue a bench warrant, impose daily fines, award your attorney fees, and in extreme cases jail the debtor until they comply. This is one of the few corners of civil practice where arrest is on the table, and judges don’t treat it lightly. The possibility alone pulls cooperation out of debtors who were otherwise silent.

Subpoenas to Banks, Employers, and Other Third Parties

Debtor testimony is only as reliable as the debtor. Subpoenas to banks, employers, brokerages, and other custodians produce independently verified data the debtor cannot shade. Federal Rule of Civil Procedure 45 lets a party command any person to produce documents or electronically stored information, and state rules follow a similar pattern.6Legal Information Institute. Federal Rules of Civil Procedure Rule 45 – Subpoena

A subpoena duces tecum to a bank can pull monthly statements, deposit records, wire details, and check images. A payroll subpoena to an employer produces gross wages, deductions, and benefit elections. A brokerage subpoena can surface investment accounts the debtor never mentioned. Identify the correct custodian of records at each institution so the subpoena reaches someone authorized to respond.

Notice and Objection Windows

Before serving a document subpoena, give notice to the debtor and any other parties. Under the federal rules, the recipient can object in writing within 14 days of service or before the compliance deadline, whichever is sooner.6Legal Information Institute. Federal Rules of Civil Procedure Rule 45 – Subpoena If the debtor thinks the request sweeps too broadly or invades privacy, they can move to quash. If the objection window closes without challenge, the third party must deliver the records by the return date. State notice periods vary but follow the same structure.

In federal proceedings, a subpoenaed witness is entitled to a $40 daily attendance fee plus mileage at the federal travel rate.7Office of the Law Revision Counsel. 28 USC 1821 – Per Diem and Mileage Generally Document-only subpoenas usually don’t require anyone to appear in person, which keeps costs down.

Assets You Can’t Reach

Discovery is only useful if the asset is collectible. Federal and state law shield several categories, and chasing exempt property wastes money and can draw sanctions if a court sees it as harassment.

ERISA-qualified retirement plans, including 401(k)s and pensions, are broadly protected. Plan assets are held in trust separate from the employer’s business, and the statute specifically bars assignment or alienation of pension benefits.8U.S. Department of Labor. FAQs About Retirement Plans and ERISA9Office of the Law Revision Counsel. 29 USC 1056 – Form and Payment of Benefits Funds rolled from a 401(k) into an IRA typically keep that protection. The main exception is a qualified domestic relations order in a divorce.

Social Security benefits are protected from levy, garnishment, attachment, or other legal process by private creditors.10Office of the Law Revision Counsel. 42 USC 407 – Assignment of Benefits Veterans’ benefits, military pay and survivor benefits, federal retirement and disability payments, federal student aid, and FEMA assistance share that shield. When a bank receives a garnishment, it must review the account for direct-deposited federal benefits and automatically protect up to two months’ worth. Anything above that cushion is reachable. The automatic protection only applies to direct deposits; if the debtor cashed a paper check into the account, they must prove the exempt source themselves. Social Security and SSDI can still be garnished for back taxes, federal student loans, and child or spousal support. Supplemental Security Income stays protected even against government debts.11Consumer Financial Protection Bureau. Can a Debt Collector Take My Federal Benefits

Every state offers some homestead protection for equity in a primary residence, and the amounts range from a few thousand dollars to unlimited protection in a handful of states. In federal bankruptcy, the exemption is $31,575 for an individual as of April 2025, and married couples can double it.12Office of the Law Revision Counsel. 11 USC 522 – Exemptions Outside bankruptcy, state law controls, and the variance is dramatic.

Wages are partially protected. For ordinary consumer debt, garnishment cannot exceed 25% of disposable earnings, or the amount by which weekly earnings exceed 30 times the federal minimum wage, whichever yields a smaller garnishment.13Office of the Law Revision Counsel. 15 USC 1673 – Restriction on Garnishment Child and spousal support orders can reach 50% to 65% depending on circumstances. Some states apply tighter caps, so the federal rule is a floor, not a ceiling.

Spotting Fraudulent Transfers

Debtors who see a judgment coming sometimes shift assets to relatives, shell companies, or new trusts. The Uniform Voidable Transactions Act, adopted in some form by most states, lets creditors claw those transfers back. Courts weigh circumstantial indicators known as badges of fraud: transfers to family or business insiders, transfers made while a suit was pending, transfers for little or no consideration, and transactions that left the debtor unable to pay their debts. No single factor decides the case; the more that line up, the stronger the claim. If the court voids the transfer, the asset is treated as if it never left.

Watch for these patterns in debtor-exam answers and bank records. Statutes of limitations on fraudulent transfer claims typically run four to six years from the transfer date, so moving quickly matters.

Turning Discovery Into Collection

Finding assets only matters if you can act on them. Three enforcement tools do most of the work.

Wage Garnishment

If the debtor has a job, you can get a writ of garnishment from the court and serve it on the employer. The employer withholds the allowable amount from each paycheck under the federal 25% cap for consumer debts and sends it to you.13Office of the Law Revision Counsel. 15 USC 1673 – Restriction on Garnishment Garnishment continues until the judgment is paid, the debtor leaves the job, or an exemption claim succeeds. For employed debtors it’s the most reliable method, because the money is intercepted before the debtor touches it.

Bank Levy

A bank levy freezes and seizes funds in the debtor’s account. You get a writ of execution from the court and have a sheriff or marshal serve it on the bank. The bank screens for exempt funds like direct-deposited federal benefits, protects those, and turns the rest over to the levying officer. Banks typically charge a processing fee, often $75 to $125. Timing is everything: you capture what’s in the account on the day the writ is served, so a large deposit the day before and a withdrawal the day after can leave you with little.

Judgment Lien on Real Property

Filing a certified abstract of the judgment with the appropriate recording office creates a lien against the debtor’s real property.14Office of the Law Revision Counsel. 28 USC 3201 – Judgment Liens It attaches to real estate the debtor owns in that jurisdiction and covers the full balance plus costs and accrued interest. The lien doesn’t produce cash on its own, but it blocks a clean sale or refinance. When the debtor tries to sell, the title company will flag the lien and insist on satisfying it from the proceeds. For debtors with meaningful equity beyond the homestead exemption, that eventually produces a full payout.

When Assets Sit in Another State

Debtors don’t always keep their property where you sued them. The Constitution requires every state to give full faith and credit to the judicial proceedings of every other state.15Library of Congress. Article IV Section 1 – Full Faith and Credit You can enforce your judgment wherever the debtor has property, but you first have to domesticate it by registering it in that state’s courts.

The Uniform Enforcement of Foreign Judgments Act, adopted by 47 states and the District of Columbia, streamlines registration. File a certified copy of the judgment with the clerk’s office in the county where the debtor lives or has assets. The debtor gets notice and a chance to respond, but cannot relitigate the merits. Objections are limited to procedural issues like original-court jurisdiction or timeliness of the filing. Once entered, the registered judgment is treated like any local judgment, with the same garnishment, levy, and lien tools available.

How Long the Judgment Lasts and What It Earns

Judgments don’t last forever. Most states set an enforcement window of roughly five to twenty years from entry, with renewal available before the deadline. Miss renewal and the judgment can go dormant or expire. A debtor who looks judgment-proof today may own assets worth taking five years from now, so calendar the renewal date the week you win.

In federal court, interest accrues automatically on money judgments at a rate tied to the weekly average one-year constant maturity Treasury yield for the week before entry.16Office of the Law Revision Counsel. 28 USC 1961 – Interest It compounds annually and runs until the judgment is paid. State courts set their own post-judgment rates, which vary significantly. Either way, the amount owed grows while the debtor stalls, and so does the debtor’s reason to settle. When you negotiate or question the debtor at an exam, work from the current total, not the original judgment figure.
