Publix Class Action Lawsuit: Checkout Weights, Wages, and Discrimination

A Publix class action lawsuit can take several forms, and the chain has faced them across three main fronts: consumer pricing and labeling, wage and overtime pay for store employees, and workplace discrimination. The highest-profile recent case, a 2025 federal suit alleging that Publix’s checkout system inflated the weight of sale-priced meats and cheeses, was dismissed in March 2026 and is now on appeal. Older cases have produced far larger payouts, including an $81.5 million gender discrimination settlement and more than $37 million across three overtime actions.

The 2025 Checkout Weight Lawsuit

On February 19, 2025, Florida shopper Wendy Koutouzis filed a proposed class action in the U.S. District Court for the Southern District of Florida alleging that Publix’s point-of-sale system was programmed to inflate the recorded weight of items sold by weight whenever those items were on sale, effectively canceling the advertised discount.1ClassAction.org. The complaint’s central example involved extra lean pork tenderloin bought on sale in January 2025. The package label read 2.83 pounds at $4.99 per pound, which should have rung up to about $14.12. According to the suit, the register recorded 3.96 pounds and charged $19.78, an overcharge of roughly 40 percent.3ClassAction.org. In March 2026, Judge Rodolfo A. Ruiz II dismissed the case without prejudice, finding that Koutouzis lacked standing and had not stated a viable claim. Koutouzis had already received refunds on 18 of the purchases she cited, which the court said “negated any injury that she could have suffered” on those items.4Yahoo Finance. Publix Did Not Overcharge Customers For the rest, she had not alleged that a refund was impossible under Publix’s policies, only that pursuing one was “too onerous” or that she chose not to. The court also found she had been charged the correct price for at least two disputed items and that employees had explained the pricing on others before she bought them.5Supermarket News. If you believe you were overcharged at a Publix checkout, the court’s reasoning in this case points to the practical first step: ask the store for a refund under Publix’s posted policy. The dismissal turned largely on the fact that Publix offered refunds and the named plaintiff had received them.

Overtime and Wage Class Actions

Wage and hour cases have been the most expensive category of class litigation against Publix in the past decade, producing more than $37 million in settlements.

The largest was a $30 million deal reached in February 2015 in Tennessee federal court. Roughly 1,580 department and assistant department managers alleged that Publix underpaid overtime by using a “fluctuating work week” structure and by excluding holiday bonuses and holiday pay from the overtime rate calculation. Publix denied liability and said the challenged policies were no longer in effect.7The Ledger. Publix Settles Overtime Pay Case

In March 2021, Aiuto v. Publix Super Markets, Inc. settled for more than $7.2 million in the Northern District of Georgia. That collective action claimed Publix misclassified meat, deli, and bakery department managers as exempt from overtime even though most of their work involved stocking, cleaning, and serving customers rather than supervisory duties.8ClassAction.org. Publix won the next round. Roberts v. Publix Super Markets, Inc., filed in the Middle District of Florida in October 2023, alleged that hourly assistant department managers worked off the clock before and after shifts, through unpaid meal breaks, and in response to after-hours texts and emails.9Grocery Dive. Publix Lawsuit: Hourly Assistant Managers Overtime In November 2024, the court denied collective certification, finding the claims too individualized and noting that Publix had policies prohibiting off-the-clock work.10Wage Hour Litigation. Employment Discrimination Settlements

Gender: Shores v. Publix

Publix’s largest employment class action came from a 1995 gender discrimination suit in the Middle District of Florida. Twelve female employees alleged the company steered women into dead-end positions, denied them promotions, issued gender-based performance reviews, treated pregnant workers harshly, and punished women more severely than men. The EEOC joined the case. It settled under a consent decree approved on May 23, 1997, for $81.5 million, with about 150,000 female employees eligible to share in the recovery.12Feminist.org. Race: Middleton v. Publix

In April 1997, Black employees and applicants filed Middleton v. Publix Super Markets, Inc., alleging a pattern and practice of racial discrimination in hiring, promotion, compensation, assignment, and termination under Title VII and related statutes.13Civil Rights Litigation Clearinghouse. Middleton v. Publix Super Markets A consent decree approved on July 12, 2001, settled the case for $10.1 million. About $7.7 million went to roughly 15,000 current and former Black employees for promotion and discharge claims dating to 1993, and each of the seven lead plaintiffs received $55,000. Publix denied wrongdoing but agreed to formalize discharge-review procedures, continue a program letting workers register interest in promotions, and maintain goals for diversifying management.14Supermarket News. Religion: EEOC Dreadlocks Case

In September 2017, the EEOC sued Publix in the Middle District of Tennessee, alleging that a Nashville store refused to accommodate a prospective employee who wore dreadlocks as part of his Rastafarian faith. The suit said management required him to cut his hair, rejected his offer to wear a hat, and effectively forced him to quit before his first day.15EEOC. Background-Check Disclosure Settlement

In Erin Knights v. Publix Super Markets, Inc., a job applicant alleged that Publix’s electronic application violated the Fair Credit Reporting Act by bundling the required background-check disclosure with a liability release instead of presenting it as a standalone document. The case settled for about $6.8 million, with final approval in 2014. The class covered 90,633 people who applied for work at Publix and underwent background checks between March 2012 and May 2014. Each class member received roughly $48 after attorneys’ fees. Publix denied wrongdoing.17Cornell eCommons. Class Action FCRA Lawsuit Challenging Employment Background Screening Disclosure Form

Smaller Consumer Suits and Recent Verdicts

Publix has also faced smaller proposed class actions over product labeling, including challenges to its apple cinnamon cereal bars in 2023, a strawberry-watermelon water enhancer in 2022, and the absence of required nutrition labeling on in-store bakery goods in 2021.18ClassAction.org. Not every case against Publix is a class action. In early 2026, a jury awarded a Central Florida woman nearly $4 million in an individual slip-and-fall case at a Kissimmee store, finding Publix 100 percent at fault. Publix has moved for a new trial, arguing the court improperly allowed evidence of what it called “inflated medical bills.”19ClickOrlando.
