Pusch & Nguyen Settlement: Refiling, Rebrand, and Perjury

The lawsuit between Anthony Pusch and Chi-Hung David Nguyen, co-founders of the Houston personal injury firm Pusch & Nguyen, began in July 2024 as a $1 million dispute over a bank withdrawal and a trademark filing, settled within weeks, and then reignited in 2025 into a broader fight over the firm’s brand and finances that remains unresolved. The Pusch and Nguyen lawsuit is now set for trial on July 20, 2026, in Harris County’s 281st District Court, after Nguyen admitted in May 2026 to giving false testimony about how he financed a competing office building.

How the 2024 Suit Started and Ended

Pusch and Nguyen founded the firm as a 50-50 partnership in 2018. In 2021, Anthony’s father, Gerard Pusch, took a 10% stake, cutting each founder to 45%.¹ In June 2024, Nguyen told Pusch he wanted out, citing disagreements over firm spending.²

Dissolution talks failed. In late July 2024, Anthony and Gerard Pusch sued Nguyen in the Harris County 165th District Court for $1 million. The complaint alleged Nguyen had pulled $1 million from the firm’s account without authorization on July 8, 2024, disparaged Pusch to staff and business partners, tried to recruit employees to a competing firm, and registered the firm’s slogan “WE PUSH YOU WIN” as a trademark in his own name, a registration granted on October 10, 2023.¹ The Puschs also alleged that Prosper, a company run by Nguyen’s brother Chi-Dung “John” Nguyen that handled client intake, had received disproportionately large payments from firm revenue.³

On July 24, 2024, Judge Ursula Hall issued a temporary restraining order barring Nguyen from the firm’s corporate accounts and from contacting Pusch.² Nguyen counterclaimed on July 31, denying the allegations. He said the firm had received a large settlement in November 2023, that both partners had agreed each could take a $1 million distribution, and that he disclosed his June 2024 withdrawal to Pusch in advance. He also alleged that Pusch’s commercial litigation docket had produced unexplained expenses and cash flow problems, and that he had gone without distributions in 2023 to keep the firm solvent.⁴

The case ended fast. On August 29, 2024, both sides signed a joint order of nonsuit without prejudice. Neither party received damages, and within weeks the two attorneys appeared together on a new I-45 billboard declaring that “nothing can break up this lawyer band.”⁵

The 2025 Refiling, Injunction, and Rebrand

The reunion collapsed. By April 2025, the partners were back in court in cause number 2025-27753 in the 281st District Court of Harris County, before Judge Christine Weems.⁶ The second round focused on the firm’s trademarks and branding.

On October 2, 2025, Judge Weems issued a temporary injunction against Nguyen. The order barred him from the firm’s computer systems, online accounts, and revenue, prohibited him from using the slogans “We Push You Win” and “Avocados At Law,” and required him to transfer the relevant trademark registrations to the firm by October 31, 2025. The court also ordered the firm to phase out Nguyen’s name and likeness from its advertising by October 12, 2025, and to notify clients that he was no longer affiliated with the practice.⁶

Pusch rebranded the practice as Pusch & Wynne, adding Houston personal injury attorney Bob Wynne as the new named partner. Nguyen’s lawyers objected in an October 8, 2025 filing, arguing that “Wynne” is a homophone of “Nguyen” and accusing Pusch of trying to “capitalize on the reputation and goodwill of the Pusch & Nguyen brand.” They wrote: “Plaintiffs suggest that they have managed to add a partner whose surname (‘Wynne’) just so happens to be a homophone of ‘Nguyen.’ What are the odds?”⁶ Pusch’s side maintained the firm was within its rights.

Nguyen launched his own practice, The Nguyen Injury Law Firm, handling personal injury, trucking, and wrongful death cases in Houston.⁷

The Trademarks Are on Hold

Nguyen appealed the trademark transfer part of the injunction. In case number 14-25-00932-CV, the Fourteenth Court of Appeals in Houston issued a temporary stay on October 28, 2025, and after briefing, granted the stay for the full duration of the appeal on November 14, 2025. That order blocks enforcement of the requirement that Nguyen hand over the “WE PUSH YOU WIN,” “AVOCADO AT LAW,” and “AVOCADOS AT LAW” marks.⁸

On a separate track, Pusch & Nguyen Law Firm, PLLC filed a cancellation proceeding at the U.S. Patent and Trademark Office on November 1, 2025, seeking to cancel the “WE PUSH YOU WIN” registration (Registration No. 7190654), which is still listed under Chi Hung Nguyen’s name.⁹

The Perjury Admission and Client Loan

The biggest development came in 2026. At an April 8, 2026 emergency hearing, Pusch’s attorney Rodney Drinnon introduced text messages recovered from a firm-issued computer that allegedly showed Nguyen had covertly taken a $2 million loan from Chassity Murray, a former Pusch & Nguyen client, to buy a $2.525 million office building on the Gulf Freeway for his new firm. Murray had been represented by Pusch & Nguyen in a 2021 lawsuit against a New Jersey trucking company that was dismissed with prejudice in November 2023.¹⁰

The messages allegedly showed Nguyen telling his brother John to delete electronic records of the transaction and working to hide the loan source from Pusch and the court. In earlier testimony on June 24, 2025, David and John Nguyen had said the property was purchased “outright with investments from family members.”¹⁰

At a hearing on May 19, 2026, Nguyen admitted in court to giving false testimony about the funding. He acknowledged the $2 million loan from Murray, admitted to helping counsel her on setting up an LLC to facilitate the transaction, and admitted opening a new bank account to keep the loan hidden from Pusch. Judge Weems warned Nguyen that he had admitted to perjury and advised him of his right to invoke the Fifth Amendment.¹¹

Pusch’s attorney argued the client loan also violated Texas Disciplinary Rule of Professional Conduct 1.08, which bars lawyers from business transactions with clients without written disclosure and independent legal advice. Nguyen first said he was unaware of the rule, then acknowledged he was.¹¹

Where Things Stand Now

The trial court case is still active. Judge Weems has set trial for July 20, 2026, to decide final relief.⁶ The appellate stay on the trademark transfer order remains in effect pending further action from the Fourteenth Court of Appeals.⁸ Nguyen changed counsel in March 2026, when Beck Redden withdrew; he is now represented by Land Murphy.¹⁰

Pusch’s firm operates as Pusch & Wynne Accident Injury Lawyers at pushwin.com, though as recently as late 2025 some digital properties still showed Nguyen’s name and likeness.¹² Nguyen continues to run The Nguyen Injury Law Firm in Houston.¹³ No settlement has been announced, and the perjury admission has not, on the record available, produced a separate criminal referral or bar disciplinary ruling.
