Randy Rosen: Body Brokering Scheme, Guilty Plea, and 10-Year Sentence

Randy Rosen is a former Beverly Hills surgeon who ran a body brokering scheme that paid recruiters to deliver vulnerable addicts to his surgical center for medically unnecessary procedures, which he then billed to insurers for hundreds of millions of dollars. He pleaded guilty to insurance fraud in August 2022 and was sentenced to ten years in state prison. At least 35 of his patients died during the course of the scheme, many from overdoses.

How the Scheme Worked

From roughly June 2017 through May 2019, Rosen and his girlfriend Liza Vismanos paid “body brokers” to find patients in Southern California sober living homes, AA meetings, and on the street. Brokers paid those patients between $400 and $2,500 to turn over their insurance cards and submit to procedures at Wellness Wave, Rosen’s Beverly Hills surgical center.1Orange County Register. The procedures included naltrexone implant surgeries, cortisone injections, and other treatments the patients did not need. The naltrexone implants were not FDA-approved. Addiction specialists have warned that without proper follow-up care, such implants can actually raise the risk of fatal overdose, because patients sometimes consume higher quantities of opioids trying to overcome the drug’s effects. Prosecutors said Rosen provided no follow-up care.2Mercury News. Doctor’s Life of Luxury Built on Backs of Drug Users, Prosecutors Say

Rosen also required patients to undergo unnecessary drug tests and routed them to Lotus Laboratories in Los Alamitos, a toxicology lab owned by Vismanos. California law prohibits physicians from referring patients to facilities in which they have a financial interest.3Orange County District Attorney. The Scale of the Billing

Prosecutors said Rosen and Vismanos billed 18 insurance companies about $676 million for the procedures and tests, ultimately collecting tens of millions in reimbursements.4Los Angeles Times. Beverly Hills Surgeon Pleads Guilty to Insurance Fraud The collected figure shifted over the case. The Orange County District Attorney’s office cited roughly $52 million at the time of the arrest warrants,3Orange County District Attorney. Rosen worked at an extraordinary pace. He reportedly performed as many as 72 procedures in a single day, some lasting barely a minute, and required patients to go under general anesthesia for simple outpatient implants so he could bill more. In text messages recovered by investigators, Rosen told a broker his hourly billing rate worked out to about “$120k” and joked about billing for MRIs that showed no actual findings. Prosecutors said the couple used the proceeds to fund a lavish lifestyle that included a $3.2 million mansion.1Orange County Register. Patient Deaths

At least 35 patients tied to the scheme died, many from overdoses, according to investigators.6NBC Los Angeles. Beverly Hills Doctor and Companion Charged in Alleged $52 Million Insurance Fraud Scheme One identified victim was Brennen Berry, who was 22 when he died in February 2018 from an overdose of heroin laced with fentanyl. Two months earlier, Rosen had given Berry a naltrexone implant and billed insurance $59,000; Berry had been paid $1,000 to undergo the procedure. His mother, Debbie Berry, told reporters her first question upon learning about the fraud charges was whether Rosen would face manslaughter charges.2Mercury News. Prosecutors pursued insurance fraud rather than homicide, citing the difficulty of establishing a direct causal link between the implants and later overdoses. Orange County District Attorney Todd Spitzer said Rosen “used vulnerable sober living patients as an ATM machine to make a buck” and “didn’t care about his patients; he only cared about making as much money as possible.”5Becker’s ASC Review. Threats Against a Witness

The text messages pulled by investigators also included alarming statements about a cooperating witness. After Rosen learned that a body broker named Josiah Shafer was working with authorities, he allegedly wrote “better he dies than gets arrested” and “hopefully he will go on a bender and that will be it.” Other messages attributed to Rosen said he would “literally have him killed.”1Orange County Register. Charges and Co-Defendants

Rosen and Vismanos were arrested on June 30, 2020, and initially held on $52 million bail.3Orange County District Attorney. Beverly Hills Surgeon, Girlfriend Charged With Stealing Nearly $52 Million in Insurance Fraud Scheme Rosen was charged with 88 felony counts across two cases, one for health insurance fraud and another for workers’ compensation fraud. The counts included creating false insurance documents, submitting fraudulent claims, withholding material facts, conspiracy to commit unlawful patient referrals, and money laundering, with aggravated white-collar-crime enhancements for losses exceeding $500,000. A crime-bail-crime enhancement was added because Rosen allegedly committed the offenses while out on bail from a 2016 case.7Orange County District Attorney. A Controversial Pretrial Release

Rosen’s time awaiting trial became its own flashpoint. In December 2020, after he contracted COVID-19 in the Orange County jail, Judge Sheila Hanson released him to his 9,000-square-foot, $14 million Brentwood mansion on electronic monitoring. His defense cited his age and health conditions, including chronic obstructive pulmonary disease, coronary artery disease, and high blood pressure. Spitzer called the release “the theater of the absurd” and argued “the criminal justice system shouldn’t have one set of rules for people who are wealthy and a separate set of rules for people who aren’t.” Prosecutors noted Rosen was a flight risk facing more than 80 years in prison and had previously committed crimes while out on bail.9Mercury News. In February 2021, the court approved Rosen’s transfer to the Huntington Beach City Jail under a “pay-to-stay” program at roughly $100 per night, or about $3,000 a month, where he was housed separately from the general population. Gregory Chris Brown, a criminal justice professor at Cal State Fullerton, called such programs a form of “unequal justice.” Spitzer called Rosen “a master manipulator” using his skills to “manipulate the system for his own benefit.”10Orange County Register. Loss of His Workers’ Compensation Practice

The California Department of Industrial Relations issued an Order of Suspension barring Rosen from the workers’ compensation system. The order, signed by Administrative Director George Parisotto on January 11, 2023, was required under Labor Code section 139.21, which mandates suspension of any provider convicted of a qualifying felony.13California DIR. A Wider Crackdown on Body Brokering

Rosen’s prosecution was among the largest to emerge from a broader push against body brokering and sober living fraud in Southern California. The Orange County District Attorney’s office formed a Sober Living-home Investigation and Prosecution task force in 2018 to target the addiction treatment industry.14Orange County District Attorney.
