Rapper Diddy’s Case: Sentence, Appeal, and Pardon Request

Sean “Diddy” Combs was convicted in July 2025 on two federal counts under the Mann Act — transportation to engage in prostitution — and acquitted of the far more serious charges of racketeering conspiracy and sex trafficking by force, fraud, or coercion. The Diddy rapper case ended with a 50-month prison sentence, a $500,000 fine, and five years of supervised release. Combs is serving that sentence at FCI Fort Dix in New Jersey, has appealed to the Second Circuit, and continues to face dozens of civil lawsuits alleging sexual misconduct.¹²

The Federal Charges

Federal agents arrested Combs in New York City on September 16, 2024. The next day, prosecutors in the Southern District of New York unsealed a three-count indictment: racketeering conspiracy, sex trafficking by force, fraud, or coercion, and transportation to engage in prostitution. Combs pleaded not guilty.³⁴

A superseding indictment in April 2025 added two more counts covering 2021 through 2024: a second sex trafficking count and a second Mann Act count. The original charges covered conduct from 2009 to 2018. The racketeering count treated “Combs Enterprises” — his media, music, fashion, and spirits companies — as a criminal organization operating from 2004 through 2024.⁵

Prosecutors alleged that Combs arranged, directed, and recorded elaborate sexual performances he called “Freak Offs,” which could last for days and involved commercial sex workers moved across state and international lines. According to the indictment, employees stocked hotel rooms with narcotics, baby oil, lubricant, extra linens, and lighting. The government said Combs kept control over victims through physical violence, threats to their careers, drug distribution, financial leverage, and recorded sex videos used as blackmail. The racketeering count listed predicate acts including kidnapping, arson, bribery, forced labor, narcotics distribution, and obstruction of justice.⁶

Homeland Security Investigations searched Combs’ Miami and Los Angeles homes in March 2024 and seized more than 1,000 bottles of baby oil and lubricant, narcotics, firearms and ammunition (including three AR-15s with defaced serial numbers), and numerous electronic devices.⁷

The Trial and the Split Verdict

Jury selection began May 5, 2025, before Judge Arun Subramanian in Manhattan. Opening arguments started May 12, and Casandra “Cassie” Ventura took the stand as the prosecution’s lead witness on May 13. She testified over four days about a decade-long relationship marked by physical violence, forced participation in drug-fueled sexual performances with male sex workers, and Combs’ use of recordings as, in her words, “a constant source of blackmail.” She described a 2016 assault at the InterContinental Hotel in Los Angeles that was captured on surveillance video, and an alleged 2018 rape.⁸

A second accuser, testifying under the pseudonym “Jane,” said she was pressured into sexual encounters with male escorts and coerced into transporting drugs. Former security supervisor Eddy Garcia testified that Combs paid a $100,000 bribe to obtain the 2016 hotel surveillance footage. The prosecution rested on June 24, 2025.⁹

The defense, led by Marc Agnifilo and Teny Geragos, called no witnesses. Combs confirmed to the judge that not testifying was his own decision.¹⁰ Geragos told jurors the case involved “voluntary, adult choices made by capable adults and consensual relationships.” Cross-examinations highlighted affectionate text messages from the accusers, inconsistencies with prior statements, and, in one instance, hotel invoices that placed Combs somewhere other than where a witness said an assault occurred. Judge Subramanian noted that evidence “blew a hole through the direct testimony.”¹¹

In closing, Agnifilo conceded the physical abuse. “We own the domestic violence,” he told the jury, while arguing it did not meet the threshold for federal sex trafficking or racketeering.¹

On July 2, 2025, after more than 13 hours of deliberation, the jury of eight men and four women returned a split verdict. Guilty on two Mann Act counts — one tied to Ventura, one to Jane. Not guilty on racketeering conspiracy and both sex trafficking counts. Gasps and cheers broke out in the courtroom when the racketeering acquittal was read. Combs knelt on the floor. Judge Subramanian denied bail, and Combs stayed in custody pending sentencing.¹¹²

The 50-Month Sentence

Judge Subramanian sentenced Combs on October 3, 2025, to 50 months in prison, five years of supervised release, and a $500,000 fine. Prosecutors had asked for more than 11 years. The defense had asked for 14 months, which would have amounted to time served.²

The judge called Ventura and Jane “brave survivors” and told Combs he had “abused the power and control with women you professed to love.” He said the sentence was meant to signal that “violence against women is met with real accountability,” and that “a history of good works cannot wash away the record in this case.”¹³

Defense attorneys pointed to untreated trauma from the childhood murder of Combs’ father and severe drug addiction. Combs apologized in court to Ventura and Jane, calling his past actions “disgusting, shameful and sick.” In a letter to the judge on the eve of sentencing he wrote, “I lost my way. My downfall was rooted in my selfishness. I have been humbled and broken to my core.”²¹⁴

Ventura’s attorney, Douglas Wigdor, said the sentence “recognizes the impact of the serious offenses he committed.” Agnifilo called the 50-month term “unconstitutional” and said he would appeal.²

The Appeal

Combs filed his notice of appeal on October 21, 2025. The Second Circuit granted a motion to expedite, and a three-judge panel heard two hours of oral argument on April 9, 2026.¹⁵

The central argument concerns what lawyers call “acquitted conduct.” The defense contends that Judge Subramanian relied on evidence of fraud and coercion — the very allegations the jury rejected in acquitting Combs of sex trafficking and racketeering — when he chose the sentence, and that this inflated the term to roughly four times the average for comparable Mann Act convictions.¹⁵ Combs also argues the Mann Act should be read narrowly to exclude paying someone to watch, and raises a First Amendment claim that the recorded encounters were protected expression.¹⁶

The government responds that the sentence was below the federal guidelines range and consistent with other Second Circuit cases. Circuit Judge William J. Nardini described the matter as an “exceptionally difficult case.” The panel had not ruled as of mid-2026.¹⁵

Where Combs Is Now

After roughly 14 months at the Metropolitan Detention Center in Brooklyn, Combs was transferred on October 30, 2025, to FCI Fort Dix, a low-security federal prison in New Jersey. His lawyers had asked for the placement to give him access to substance abuse treatment and to keep him closer to family.¹⁷

He is enrolled in the Bureau of Prisons’ Residential Drug Abuse Treatment Program, its most intensive rehabilitation track, which can shave up to a year off a sentence. He also works as a chaplain’s assistant, maintaining the religious library and cleaning the chapel office. In early November 2025 he was disciplined for making a three-way phone call in violation of prison rules; officials recommended a 90-day loss of phone and commissary privileges.¹⁷

As of June 2026, the Bureau of Prisons lists his projected release date as February 23, 2028, moved up from the original projection in line with credits earned through the drug program.¹⁸

The Pardon Request

A member of Combs’ defense team confirmed in August 2025 that his camp had contacted the Trump administration about a presidential pardon.¹⁹ President Trump publicly acknowledged the request in October 2025 and again in January 2026, and said he was “not considering it,” pointing to what he called “terrible statements” Combs had made about him during his political campaigns.²⁰

Civil Lawsuits Still Pending

The criminal verdict did not resolve the civil claims against Combs, and those claims are numerous. He faces at least 70 civil lawsuits alleging sexual misconduct, with alleged incidents spanning 1991 through 2024.¹⁸²¹²²

The mass litigation has run into procedural hurdles. Buzbee stepped back from federal cases in the Southern District of New York because he is not licensed to practice there, though co-counsel continued those cases. At least two suits were dismissed, including one where the plaintiff would not comply with an order to reveal her identity. Combs’ team has said many filings are driven by “media headlines” rather than legal merit.²³

The lawsuit that set the entire chain of events in motion was filed by Cassie Ventura on November 16, 2023, and settled the next day. Ventura later testified at trial that the settlement was $20 million.²⁴²⁵

Other notable civil matters include a September 2024 suit by Dawn Richard, formerly of Danity Kane, alleging sex trafficking, sexual assault, and false imprisonment during her years working for Combs; a June 2026 suit by a plaintiff using the pseudonym “John YH Roe,” a former child actor who alleges Combs sexually assaulted him in 2007 at a Hollywood Hills networking event when he was a minor;²⁶ and a $100 million defamation suit Combs brought against NBCUniversal over the documentary Diddy: The Making of a Bad Boy. A New York State Supreme Court judge dismissed that suit in April 2026, ruling it was “inconceivable” the documentary caused additional reputational damage given Combs’ existing legal troubles and his own courtroom admissions.²⁷

Separately, the Los Angeles County District Attorney’s Office is reviewing two sexual assault investigations involving Combs, based on separate reports the LAPD and the L.A. County Sheriff’s Department presented in the fall of 2025 concerning allegations by music publicist Jonathan Hay about incidents in 2020 and 2021.²⁸

Combs has denied all allegations of sexual assault. His spokesperson, Juda Engelmayer, has said: “Mr. Combs has never sexually assaulted anyone.”²⁶
