Real Estate Commission Lawsuits: Settlements, Payouts, and Claims

The real estate commission lawsuits began with a $1.8 billion jury verdict against the National Association of Realtors in October 2023 and have since produced more than $1 billion in settlements, a rewrite of how agent commissions work, and a pending federal appeal that is currently blocking any money from reaching home sellers. If you sold a home during the eligible period, you may be entitled to a share of the settlement funds, but claim deadlines for most of the settlements have already passed and distributions are on hold until the Eighth Circuit rules.

The Verdict That Set Everything in Motion

On October 31, 2023, a jury in the U.S. District Court for the Western District of Missouri returned a verdict of nearly $1.8 billion against NAR, Keller Williams, and HomeServices of America in a case commonly called Sitzer/Burnett.1IVAOR. The plaintiffs, home sellers, argued that NAR’s “Participation Rule” forced them to pay the buyer’s agent commission as a condition of listing on a Multiple Listing Service. Because sellers had no practical alternative to MLS listing, the rule effectively locked in inflated commission rates. The jury agreed.

What Changed for Buyers and Sellers

The most consequential result of the litigation is not the money but the rule changes, which took effect on August 17, 2024.3NAR. NAR Settlement FAQs Two shifts matter most:

  • Listing brokers can no longer offer compensation to buyer brokers on the MLS.3NAR. NAR Settlement FAQs
  • Agents working with buyers must sign a written agreement with the buyer before touring any home, spelling out the agent’s compensation in specific, non-open-ended terms. That agreement must include a conspicuous disclosure that commissions are not set by law and are fully negotiable.3NAR. NAR Settlement FAQs4Florida Realtors. These rules apply regardless of whether the appeal reverses any settlement, and they are unlikely to be rolled back.

The Settlements and Who Paid

Rather than face trebled damages, NAR settled on March 15, 2024, agreeing to pay $418 million. Judge Stephen R. Bough granted final approval on November 26, 2024.5Hagens Berman. The other major settlements bring the total above $1 billion:7Real Estate Commission Litigation. NAR Settlement

A separate nationwide class action, 1925 Hooper LLC v. NAR in the Northern District of Georgia, produced $44.05 million more: eXp ($34 million), Weichert ($8.5 million), Atlanta Communities ($800,000), and Higher Tech/Mark Spain Real Estate ($750,000). A separate case, Tuccori v. At World Properties, targets the buyer side of the equation rather than sellers. NAR agreed to pay $52.25 million into a settlement fund, spread over several years with the majority due after June 2028.13NAR. Who Can Claim, and How Much

To share in the seller-side settlements, a person must have sold a home listed on an MLS in the United States during the eligible date range and paid a commission to a real estate brokerage. For the Hooper class, the eligible dates are October 31, 2019 through July 22, 2025.15ClassAction.org. Real Estate Broker Commissions Hooper Settlement

Most claim deadlines have passed. The NAR and HomeServices claim deadline was May 9, 2025.16Real Estate Commission Litigation. Individual payouts are expected to be modest. One estimate placed the average at roughly $13 per claimant, given a potential eligible class of 21 million to 50 million home sellers. The distribution plan, once proposed, is expected to weight payouts by the amount of commissions each seller paid, so sellers of higher-priced homes will likely receive more than that average.19CNET. Why No One Has Been Paid Yet

No settlement money has gone out because objectors to the Burnett-related settlements appealed after final approval, and until those appeals are resolved, funds cannot be distributed.7Real Estate Commission Litigation. Objectors argued the settlement amount was inadequate for a nationwide class, calling the expected payouts “pennies on the dollar,” and challenged the defendants’ claims that paying more would risk bankruptcy, calling it a “corporate trick” and arguing the lower court never reviewed the defendants’ financial records.6Real Estate News. Appellants Have Their Final Say About Commissions Settlements Some appellants also objected to provisions that force sellers to release their separate claims as homebuyers, arguing those buyer-side claims involved different facts and damages.20Bloomberg Law. Counsel for NAR and the other settling defendants responded that the settlements represent a necessary compromise to avoid the “economic destruction” of the defendants, and that NAR believes the underlying antitrust claims are “legally flawed.”20Bloomberg Law. If it vacates them, separate litigation, including the Moehrl case in Illinois, could be revived and add years of proceedings.6Real Estate News. Hooper distributions are expected approximately 30 days after any remaining appeals are resolved or July 31, 2026, whichever comes later.12Nationwide Real Estate Commission Settlement. Nationwide Real Estate Commission Settlement

How Commissions Have Actually Moved

Since the new rules took effect, the average buyer-agent commission has declined modestly. National averages dropped from 2.45% in the fourth quarter of 2023 to 2.36% in the fourth quarter of 2024. The shift has been uneven. Commissions on homes priced above $1 million fell to 2.17%, while commissions on homes under $500,000 actually ticked upward to 2.46%.21The Mortgage Reports. Many sellers still cover buyer-agent fees, especially in competitive markets where attracting offers matters. In a survey, 51% of agents said they expect commissions to decline further over the next year, while only 5% expect growth.21The Mortgage Reports. Real Estate Commissions Dip After NAR Lawsuit

A Note for VA and FHA Buyers

If sellers stop paying buyer-agent commissions, buyers using government-backed loans could face out-of-pocket costs they cannot easily finance. The Department of Veterans Affairs addressed this on August 10, 2024, by temporarily allowing VA borrowers to negotiate and pay buyer-broker fees directly, a reversal of longstanding VA policy.22VA. What Else Is Still Open

The Moehrl case in the Northern District of Illinois, filed before Burnett, received class certification in March 2023 and originally sought damages exceeding $13 billion. It has been resolved in pieces through settlements with individual defendants, and litigation against remaining defendants continues.11Cohen Milstein. Moehrl v. The Department of Justice is pursuing a separate antitrust investigation focused on NAR’s Participation Rule and its Clear Cooperation Policy.25Justia. National Association of Realtors v. United States On January 13, 2025, the Supreme Court denied NAR’s petition seeking to block the probe.26Virginia Realtors. Supreme Court Denies NAR’s Request for Review of DOJ Investigation In a statement of interest filed in the Burnett case on November 24, 2024, the DOJ asked the court to clarify that approval of the private settlement does not shield NAR from future government enforcement, and expressed concern that the mandatory buyer-broker agreement requirement could itself limit competition.27Cohen Milstein.
