Robin Howington Case: Shooting, Trial, and Sentence

Robin Howington, a Knoxville, Tennessee mother, was convicted in March 2024 of reckless homicide and five other felonies in the 2019 shooting death of her five-year-old daughter, Destiny Oliver, and sentenced the following month to twenty-two years in state prison without the possibility of parole. The Robin Howington case turned on a shooting she blamed first on a stranger, then on the child’s father, and finally on her two-year-old son.¹²

The Shooting on Balsam Drive

On September 14, 2019, Knoxville police were called to 502 Balsam Drive in Fountain City, where Destiny Oliver had been shot in the chest with a handgun. She was taken to the University of Tennessee Medical Center and pronounced dead.³⁴

Earlier that day, according to a witness, Howington had pulled a gun on Destiny’s biological father in the front yard before he disarmed her. What happened between that confrontation and the fatal shot became the central dispute at trial.³

Three Different Stories

On the 911 call, Howington told dispatchers a “random stranger” had walked in and shot her daughter.¹ When officers arrived, Knoxville Police Officer Andrell Cummings later testified that the scene was “extremely quiet” and Howington was on her phone with a calm demeanor.⁵

Under questioning, she shifted the blame to Destiny’s father, then settled on a third version: that her two-year-old son had found a loaded handgun in a closet and accidentally shot his sister. A text message recovered from her phone also pointed to the toddler.³¹ At sentencing, Judge G. Scott Green said he had “quit counting” the lies Howington told in the aftermath.⁶

The Gun in the Bush and the Phone in the Water

While Howington was still on the 911 line, a neighbor’s surveillance camera captured her leaving the house, wiping the handgun with a rag, and hiding it in a bush.¹⁵

At the hospital, Howington also tried to destroy her cell phone by submerging it in water. She told investigators she was afraid it contained evidence of drug sales, a claim she repeated at trial.⁷⁵

Indictment

A Knox County grand jury returned a six-count presentment on July 1, 2020, charging Howington with felony murder, aggravated child neglect, making a false report, tampering with evidence, and attempted tampering with evidence. She was jailed and unable to post bond, and the case did not reach trial for nearly four and a half years.³

The Trial

Trial began on March 5, 2024, before Judge G. Scott Green in Knox County and ran five days. Prosecutors argued Howington was responsible for her daughter’s death by allowing a two-year-old access to a loaded handgun, and that her efforts to hide the gun, destroy the phone, and cycle through explanations showed consciousness of guilt. Assistant District Attorney Franklin Ammons told jurors Howington had told “so many stories” she could not be believed.⁶

Kyle Osborne of the U.S. Army crime lab testified that gunshot residue was found on the clothing of both Howington and her two-year-old son.⁵

Defense attorney Michael Whalen argued the shooting was a tragic accident caused by the toddler. Howington took the stand on March 7, 2024, and testified she had moved the gun outside after the shooting to prevent further accidental discharges, not to hide it, and that she tried to destroy her phone because she feared police would find evidence of drug dealing.⁴⁵ Whalen told the jury her erratic behavior during the police interview reflected extreme distress and past trauma, including a prior rape by a law enforcement officer that he said made her fearful of police.⁸

The Verdict

On March 8, 2024, after less than two hours of deliberation, the jury convicted Howington on all six counts:⁵

Reckless homicide (Class D felony)
Two counts of aggravated child neglect (Class A felony), one for giving the five-year-old access to a loaded gun and one for giving the two-year-old access
Tampering with evidence (Class C felony), for hiding the gun
Attempted tampering with evidence (Class D felony), for trying to destroy the phone
False reports (Class D felony), for her fabricated claims to police¹

The jury convicted Howington of reckless homicide rather than the original felony murder charge. Under Tennessee law, felony murder requires a killing committed during certain underlying felonies, including aggravated child neglect. The jury had the authority to reduce the charge, and legal analysts said the verdict likely reflected a finding that Howington acted recklessly rather than with the intent tied to the underlying felony.⁹

The Sentence

On April 19, 2024, Judge Green sentenced Howington to a total of twenty-two years in the Tennessee Department of Correction without the possibility of parole.² The tampering conviction carried five years and the attempted tampering conviction carried three; a full breakdown across the remaining counts was not publicly detailed.⁵

Judge Green rejected the defense’s accident theory from the bench. Addressing Howington directly, he said, “You are not the victim in this case. The fact remains, you were responsible for that gun.” He added that he would “never believe” the claim that the two-year-old was solely responsible, calling it a story that “strains credulity.”¹⁰⁵

District Attorney General Charme Allen said in a statement after sentencing that “thanks to the hard work of everyone involved in this case, a small measure of justice was achieved for a little girl whose life was tragically cut short.”²
