The Rodriguez settlement most people are searching for is one of two class actions: Rodriguez v. Professional Finance Company, Inc., a $2.5 million data breach case in federal court in Colorado, or Rodriguez v. National Credit Center, LLC, a $30 million case in Nevada over inaccurate OFAC screening reports used in vehicle financing. Both have been finally approved. Payments in the PFC case began in April 2026. The National Credit Center case received final approval on October 14, 2024, with distribution moving forward after any appeals.
Rodriguez v. Professional Finance Company (Data Breach)
Professional Finance Company (PFC), a Greeley, Colorado debt-collection agency serving healthcare providers and other clients, was hit by a ransomware attack in February 2022. Who Qualifies and What You Get
The class of roughly two million people is split by the type of data compromised.
- SSN Subclass (about 1.3 million people), whose Social Security numbers were potentially accessed: up to $500 in reimbursement for documented out-of-pocket losses (identity theft, credit repair fees), 24 months of “Identity Defense Complete” credit monitoring through CyEx, and an additional $50 cash payment for anyone who lived in California at the time of the breach under the California Consumer Privacy Act.
- Non-SSN Subclass (about 700,000 people), whose Social Security numbers were not involved: 24 months of “Identity Defense Plus” identity monitoring through CyEx.
The $2.5 million pays claims, attorneys’ fees, service awards, and administrative costs. If approved claims exceed what remains, individual payouts are reduced pro rata. Rodriguez v. National Credit Center (OFAC Screening)
National Credit Center, LLC (NCC) is a Nevada company that facilitates access to credit reports and related products from the three major credit bureaus. Its OFAC screening product checks consumer names against the U.S. Treasury’s Specially Designated Nationals list, which flags people and entities (such as suspected terrorists and narcotics traffickers) that American businesses may not do business with.7NCC Direct. The lawsuit alleges NCC’s screening falsely flagged hundreds of thousands of ordinary consumers as possible OFAC matches when they applied for vehicle financing, delaying or derailing purchases in violation of the Fair Credit Reporting Act. Who Qualifies and What You Get
The class includes anyone for whom NCC sold a report to a third party between May 8, 2020, and June 11, 2024, that identified the person’s name as similar to a name on the OFAC list.9Rodriguez OFAC Settlement. Class Notice
Each class member is estimated to receive a pro rata payment between $38 and $42. Class members who experienced specific harm from an inaccurate screen (significant emotional distress, embarrassment, or a delayed or denied transaction) could file a separate claim for up to $1,500 with documentation. Attorneys’ fees are capped at $10 million from the $30 million fund, and the named plaintiff’s service award is capped at $25,000.
