Roundup Lawsuit Legal Marketing Campaigns: Settlement and Verdicts

The Roundup lawsuit is a mass tort over claims that the weed killer’s active ingredient, glyphosate, causes non-Hodgkin lymphoma and related cancers, and as of mid-2026 it sits at a decisive moment: Bayer, which bought Monsanto in 2018, has proposed a $7.25 billion class settlement to resolve current and future claims, and the U.S. Supreme Court is expected to rule by early July on a case that could block most future failure-to-warn suits. Bayer has reported facing roughly 65,000 claims across state and federal courts, with about 4,511 cases still pending in the federal multidistrict litigation (MDL 2741) before Judge Vince Chhabria in the Northern District of California.1Reuters. What the Lawsuits Claim

Plaintiffs allege that long-term exposure to Roundup caused their non-Hodgkin lymphoma or a related blood cancer, and that Monsanto failed to warn users of the risk. The scientific anchor for those claims is a March 2015 classification by the International Agency for Research on Cancer, a branch of the World Health Organization, labeling glyphosate “probably carcinogenic to humans” based on limited evidence in humans, sufficient evidence in animals, and strong evidence of genotoxicity.3IARC/WHO. IARC Monograph on Glyphosate

The U.S. Environmental Protection Agency disagrees, maintaining that glyphosate is “not likely to be carcinogenic to humans.” The EPA is currently updating that evaluation after a federal appeals court vacated the agency’s 2020 interim review in June 2022 and told it to better explain its findings; the EPA has said withdrawing that review does not mean the underlying conclusion is wrong.4EPA. Glyphosate

A June 2025 peer-reviewed study in Environmental Health added to the dispute. Researchers with the Global Glyphosate Study gave rats glyphosate and two Roundup formulations at doses regulators currently consider safe and reported increased rates of benign and malignant tumors at multiple sites, including leukemia and liver, skin, and mammary tumors. The investigators said the results support IARC’s 2015 classification.5Springer Nature. Who Can File a Roundup Lawsuit

Eligibility is specific. Claimants generally need a confirmed diagnosis of non-Hodgkin lymphoma or a related cancer such as chronic lymphocytic leukemia or mantle cell lymphoma. The diagnosis must come at least a year after Roundup use began, and most firms look for several years of regular use starting in or after 1990.7Goldwater Law Firm. Roundup Lawsuit Eligibility

State statutes of limitations also apply and vary widely, running as short as two years in California and Texas and three years in New York.8Rueb Stoller Daniel. How to Join the Roundup Lawsuit Once a firm accepts a case, it collects medical records, proof of Roundup purchase or workplace exposure, and witness statements, and uses expert testimony from doctors and toxicologists to link exposure to the diagnosis. Cases are then filed individually in state court or consolidated into the federal MDL. Most firms work on contingency, so clients pay nothing unless they win or settle.7Goldwater Law Firm. One boundary to note: Bayer began transitioning its U.S. residential Roundup products to non-glyphosate formulations in 2023. Agricultural and professional glyphosate products are still on the market, but the home-use product sold in recent years may not contain glyphosate at all.9Bayer. Managing the Roundup Litigation

The $7.25 Billion Proposed Settlement

In February 2026, Bayer proposed a $7.25 billion class action settlement designed to resolve both existing claims and claims from people who might develop cancer in the future after using Roundup. Bayer would pay into a fund over as long as 21 years, and the deal would allow the company to keep selling Roundup without cancer warnings.10Bayer. Projected individual payouts vary by exposure type, age at diagnosis, and severity. Agricultural and industrial workers diagnosed with aggressive cancer before age 60 could average roughly $165,000. Residential users aged 60 to 77 with less aggressive illness might receive about $20,000, and those diagnosed at 78 or older about $10,000.11ABC7 News. The deal has drawn heavy opposition. A Missouri state court judge granted preliminary approval in March 2026, but more than 100 class members and at least a dozen health care companies filed objections, and lawyers from 14 firms representing nearly 20,000 plaintiffs asked the court to delay approval, arguing the agreement was negotiated without adequate input and pushed through too quickly.9Bayer. Objectors removed the case to federal court in May 2026, but on June 17, 2026, U.S. District Judge Henry Edward Autrey sent it back to Missouri state court, where Judge Timothy Boyer is scheduled to rule on final approval on July 9, 2026. The Supreme Court Case That Could End Future Claims

Running alongside the settlement is Monsanto Company v. Durnell (No. 24-1068). The U.S. Supreme Court agreed to hear the case in January 2026 and heard oral argument on April 27, 2026, with a decision expected by early July.15SCOTUSblog. Justices Debate Who Gets to Decide That Pesticide Labels Need a Cancer Warning

The question is whether the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) preempts state failure-to-warn lawsuits when the EPA has not required a cancer warning on the label. Monsanto argues that because the EPA approved Roundup’s label without a cancer warning and has concluded glyphosate poses no carcinogenic risk, states cannot impose different labeling requirements through tort suits. John Durnell, who won $1.25 million from a Missouri trial court in a judgment affirmed on appeal in February 2025, counters that Congress never wrote FIFRA to bar juries from deciding whether a product needed a different safety warning.15SCOTUSblog. Justices Debate Who Gets to Decide That Pesticide Labels Need a Cancer Warning

The case arrived at the Court after a circuit split: the Third Circuit held in Schaffner v. Monsanto that FIFRA does preempt state failure-to-warn claims, while the Ninth and Eleventh Circuits reached the opposite result.16Harvard Law Review. Preempting Toxic Torts: Third Circuit Opens Split on Cancer Warnings in Schaffner v. Monsanto More than 100 amicus briefs were filed supporting Monsanto, including from the U.S. Solicitor General, a coalition of 15 states led by Nebraska, a separate group led by Texas with Florida and Ohio, and numerous agricultural and business groups. A coalition of 18 states led by New Mexico filed in support of the plaintiff.17Supreme Court of the United States. Monsanto Company v. John L. Durnell, No. 24-1068

Bayer has said directly that a ruling in its favor could “largely end” the Roundup litigation by making EPA registration a complete defense, and the company’s counsel has argued an adverse Supreme Court ruling could “wipe out” existing claims, a point raised as leverage for the $7.25 billion settlement.9Bayer. Verdicts So Far

The litigation has produced some of the largest personal-injury verdicts in recent years. Weitz & Luxenberg filed the first lawsuit against Monsanto over Roundup and non-Hodgkin lymphoma in fall 2015, and by 2020 Bayer agreed to an approximately $10.9 billion settlement resolving roughly 100,000 claims. Tens of thousands more were filed afterward.18Weitz & Luxenberg. Settlement Reached in Roundup Weed Killer Cancer Litigation13Drugwatch. Roundup Lawsuit

Recent bellwether and state-court verdicts give a sense of jury reactions where cases have reached trial:

  • 2023: A Philadelphia jury awarded $175 million ($25 million compensatory, $150 million punitive) in the first Roundup case tried in that MDL.
  • 2024: A $2.25 billion verdict ($250 million compensatory, $2 billion punitive), the largest Roundup award to date.
  • 2024: A third Philadelphia MDL trial resulted in $78 million ($3 million compensatory, $75 million punitive).
  • 2025: The first Roundup case tried in Georgia produced a $2.065 billion verdict, the largest single-plaintiff injury verdict in that state’s history.19Arnold & Itkin. Roundup Lawsuit Attorney

Punitive damages are typically reduced on post-trial review, so headline numbers rarely survive intact, but the trial outcomes are a major reason Bayer has pushed for a global resolution.

What Happens Next

Two decisions will shape the Roundup lawsuit over the coming weeks. The Supreme Court is expected to rule in Monsanto v. Durnell by early July 2026. A ruling for Monsanto on FIFRA preemption would make it much harder to bring new failure-to-warn claims anywhere in the country. A few days later, on July 9, 2026, Missouri Judge Timothy Boyer is scheduled to rule on final approval of the $7.25 billion class settlement, with an appeal from objecting plaintiffs already on file.1Reuters. For anyone considering a claim, the practical point is time. State statutes of limitations run on their own clock from diagnosis, independent of what the Supreme Court or the Missouri court does, and firms are prioritizing intake through mid-2026 on the expectation that the combined effect of a settlement and a possible preemption ruling could close the window on new filings. If you were regularly exposed to Roundup and later diagnosed with non-Hodgkin lymphoma or a related cancer, confirming your state’s filing deadline is the first thing that matters.
