The first U.S. criminal conviction to rely on DNA evidence distinguishing between identical twins came in August 2025, when a Prince William County, Virginia, jury found Russell Anthony Marubbio guilty of the 1987 rape and abduction of a woman at a Woodbridge gas station. Why Standard DNA Testing Could Not Solve the Case

The Virginia Department of Forensic Science had a male DNA profile from the 1987 evidence kit, but no database match, and the case sat cold for more than three decades.2WTOP. That is the wall forensic science has run into for decades. Identical twins share the same DNA at every short tandem repeat marker used in CODIS and standard forensic panels. Ordinary DNA testing cannot tell them apart, which has historically made cases with identical twin suspects effectively unprovable on DNA alone.

How Somatic Mutation Analysis Identified the Right Brother

In August 2022, Prince William County detectives sent the samples to Parabon NanoLabs in Reston, Virginia, for deep whole-genome sequencing designed to detect somatic mutations.4Prince William Times. Identical twins start from the same genome, but each accumulates a unique pattern of these mutations in some of their cells. How Investigators Got to the Twins

The twins became suspects through genetic genealogy work at the Marshall University Forensic Science Center and Parabon NanoLabs. CeCe Moore, Parabon’s chief genetic genealogist, traced second cousins to a common ancestor from the 1860s, built the family tree forward, and used birth certificates, census records, and yearbooks to narrow the tree to the two Marubbio brothers.5The Guardian. Arrest, Trial, and Sentence

Russell Marubbio was arrested on June 23, 2023, in Palatka, Florida, and charged with rape and abduction with intent to defile. He was 52 at arrest and would have been 17 at the time of the 1987 attack.6News4JAX. The case went to trial in Prince William County Circuit Court before Judge Kimberly A. Irving. Why This Is a Legal First

Courts had turned this kind of evidence away before. In 2017, a Suffolk County Superior Court judge in Massachusetts excluded next-generation sequencing results offered to differentiate identical twin suspects in Commonwealth v. The picture changed in January 2024, when a Kern County, California, court admitted next-generation sequencing evidence for the first time in People v.
