Mitchell’s 29-page complaint, filed November 17, 2021, in Los Angeles Superior Court, named Baldwin, producers including Rust Movie Productions LLC and Thomasville Pictures LLC, armorer Hannah Gutierrez Reed, assistant director David Halls, and property master Sarah Zachry.3Deadline. The core allegation is that Baldwin “intentionally, without just cause or excuse, cocked and fired the loaded gun” when the scene being prepared did not call for the weapon to be discharged. The complaint also described broader safety breakdowns on the production: ammunition carts left unattended, crew members using firearms for unauthorized target practice, prior accidental discharges of blank rounds, and workers walking off the job to protest conditions before the fatal incident.4The Hollywood Reporter. Mitchell brought claims for assault, battery, intentional infliction of emotional distress, and negligence against Baldwin and the producer defendants.

The claims have been tested in stages, with different outcomes against different defendants.

Producers: Most Claims Withdrawn, Negligence Remains

In July 2022, Los Angeles Superior Court Judge Michael E. Whitaker dismissed Mitchell’s assault and intentional-infliction-of-emotional-distress claims against producer Anjul Nigam and his company, finding she had not alleged sufficient facts to show the producers knew Baldwin would aim and fire the weapon toward her.5Los Angeles Times. By late August 2022, her legal team agreed to drop the assault, battery, and intentional infliction of emotional distress counts against the production companies to “streamline the pleadings,” leaving a negligence claim against the producers.6The Hollywood Reporter. Baldwin: Stays in the Case, Punitive Damages Preserved

The claims against Baldwin personally went further. On November 1, 2022, Judge Whitaker denied Baldwin’s motion to be dismissed from the lawsuit and denied a joint motion by Baldwin and his production company, El Dorado Pictures, to strike Mitchell’s claim for punitive damages. The court allowed Mitchell to proceed against Baldwin on assault, intentional infliction of emotional distress, and negligence theories, and kept punitive damages in play, citing allegations of “despicable conduct carried out with a willful and conscious disregard of the rights or safety of others.”7Deadline. Ammunition Suppliers: Out of the Case

In April 2024, Judge Maurice A. Leiter granted a motion to quash service filed by PDQ Arm and Prop, LLC and Seth Kenney, removing them from Mitchell’s case.8Rulings.law. Mamie Mitchell v. Rust Movie Productions, LLC, et al., 21STCV42301

Where Mitchell’s Case Stands Now

Several civil suits arose from the shooting, and Mitchell’s is separate from all of them. The Hutchins family wrongful death suit brought by Matthew Hutchins and their son was settled in October 2022 and approved by a judge in June 2023, with Matthew Hutchins becoming an executive producer and production resuming.9ABC News. Mitchell was not part of the June 2025 crew settlement, and reporting on the Svetnoy trial does not indicate her case has been consolidated with it. How the Criminal Cases Affect Her Suit

The criminal proceedings ran on a separate track and did not resolve Mitchell’s civil claims. Armorer Hannah Gutierrez Reed was convicted of involuntary manslaughter in March 2024, sentenced to 18 months, and paroled in May 2025.13The Guardian. Regulatory Findings That Echo Her Allegations

Mitchell’s allegations about the set’s safety culture were largely mirrored by state regulators. In April 2022, New Mexico’s Occupational Health and Safety Bureau issued the maximum fine allowed under state law, $136,793, against Rust Movie Productions LLC, citing “plain indifference” to the welfare of cast and crew and finding that managers had failed to follow firearm protocols, ignored crew complaints, and failed to address two prior blank-round misfires. The bureau also found that armorer Gutierrez Reed was “overburdened,” limited to eight paid days as armorer while also assigned duties as a props assistant, and had been “rebuffed” when she raised the issue.16NPR.
