The Ryze coffee lawsuit that drew the most attention was a November 2023 class action over the company’s subscription billing, but it was voluntarily dismissed within a week of being moved to federal court. Since then, Ryze Superfoods has also dropped a set of health claims after a National Advertising Division inquiry and settled one of two California Proposition 65 actions over lead in its products. None of these matters produced a ruling that Ryze did anything unlawful, but together they map the consumer-protection issues customers have raised about the brand.
The Subscription Class Action Was Filed and Then Dropped
In November 2023, Jessica Younger filed a class action against Ryze Superfoods LLC in Los Angeles County Superior Court, case number 23STCV27561.1UniCourt. Younger v. On February 1, 2024, Ryze removed the case to the U.S. District Court for the Central District of California, where it was docketed as Case No. 2:24-cv-00868 before Judge Hernan D. Vera. One week later, on February 8, 2024, Younger voluntarily dismissed the case under Federal Rule of Civil Procedure 41(a)(1). Truth in Advertising’s tracker still listed the matter as pending as of June 2026, so a refiled or related state action may exist.2Truth in Advertising. Ryze Class Action What the public records do show is that the federal case ended without any decision on the merits.
Why Customers Keep Complaining About Billing
The dismissed lawsuit sits on top of a much larger volume of consumer complaints. Ryze, Inc.’s Better Business Bureau profile shows 892 total complaints over the past three years, with 278 closed in the most recent 12 months. The complaints follow a consistent pattern. Customers describe believing they were making a one-time purchase and then discovering they had been enrolled in auto-ship. Some say they avoided creating an account or skipped subscription checkboxes at checkout but were still charged on a recurring basis. Others report a cancellation flow of about ten pages, with prompts to “skip” or “reschedule” shipments instead of ending the subscription. Ryze has consistently told the BBB that it never intends to be “misleading or predatory,” attributes enrollment disputes to customer selections at checkout, and points out that a “Buy Once” option is offered alongside discounted subscription pricing. In practice, the company has often issued full refunds, confirmed cancellations, and told customers they do not need to return product they received. If you were charged for a subscription you did not intend to start, the BBB record suggests refunds are frequently granted when customers escalate.
Ryze Dropped Its Advertised Health Claims After an NAD Inquiry
On September 11, 2025, the National Advertising Division of BBB National Programs published the results of an inquiry into Ryze’s online advertising for two products.6BBB National Programs. Ryze Superfoods NAD Decision
For Mushroom Coffee, the NAD looked at express claims that the product provided “all-day energy,” “sharper focus,” “healthier digestion,” “better immune support,” and “better sleep.” For Mushroom Matcha, the NAD examined whether the advertising implied appetite-suppressing benefits comparable to GLP-1 agonist drugs such as Ozempic and Mounjaro, “without the side effects.”7NutraIngredients. Ryze did not provide evidence to substantiate the claims. The company told the NAD it had “permanently discontinued all the challenged express claims” and was “modifying the presentation of its advertising claims.”6BBB National Programs. Ryze Superfoods NAD Decision Because the claims were withdrawn before a merits review, the NAD never made a formal determination on whether they were truthful or supported. For compliance purposes, the voluntary discontinuation is treated as if the NAD had recommended removal. Two California Proposition 65 Actions Over Lead
Ryze has also faced two separate actions under California’s Proposition 65, which requires businesses to warn consumers about significant exposures to chemicals known to cause cancer or reproductive harm.
The first was brought by Environmental Health Advocates, Inc. (EHA), which served Ryze with a 60-day notice in August 2024 alleging that Mushroom Overnight Oats contained lead without an adequate Prop 65 warning. Ryze settled in April 2025. The company agreed to pay a $2,000 civil penalty, split between the state’s Office of Environmental Health Hazard Assessment and EHA, plus $20,500 in attorney fees and investigation costs. Ryze also agreed not to sell covered products in California that expose consumers to more than 0.5 micrograms of lead per day, the state’s safe harbor threshold, without a compliant warning. A second Prop 65 notice was filed on November 15, 2024, by a different enforcer, Keep America Safe and Beautiful, represented by Seven Hills LLP. That notice named both Ryze, Inc. and Ryze Superfoods LLC and concerned lead in powdered mushroom drink mixes.11California Office of the Attorney General. Ryze now displays a Prop 65 warning on its website, acknowledging that some ingredients “may contain naturally occurring lead.” The company has told the BBB that its Prop 65 labeling is provided “out of an abundance of caution” rather than because the product is unsafe.5BBB. What This Means If You Buy Ryze
No court has found Ryze liable for anything. The subscription class action was dismissed at the plaintiff’s own request before any decision. The health-claims inquiry ended when Ryze dropped the claims rather than defend them. One lead action settled on financial and compliance terms; the other has no public resolution.
Practically, that leaves three things for a customer to know. Read the checkout carefully if you only want a single order, because the volume of BBB billing complaints, and Ryze’s willingness to refund them, suggests the subscription flow catches people. Do not treat the marketing language about energy, focus, digestion, immunity, sleep, or appetite as backed by human clinical evidence; the company withdrew those specific claims rather than substantiate them. And if you are in California, expect to see a Prop 65 lead warning on the product.
