School Bus Accident Lawsuit: Deadlines, Damages, and Settlements

A school bus accident lawsuit is a civil claim brought on behalf of someone injured in a crash involving a school bus, and it can be filed against the driver, the school district, a private transportation contractor, the bus or parts manufacturer, a maintenance company, or another motorist, depending on who was at fault. The single most important thing to know up front: if a public school district is a defendant, you likely have only a few months, not years, to file a formal notice of claim, and missing that deadline usually ends the case no matter how badly your child was hurt.

Who You Can Sue

More than one party is often responsible for a single school bus crash. The possible defendants include:

  • The bus driver, if the driver was speeding, distracted, impaired, or otherwise negligent.
  • The school district, when it employs the driver. The district answers for the driver’s on-the-job negligence under vicarious liability, and can face direct claims for negligent hiring, inadequate training, poor vehicle maintenance, or ignoring warnings about a driver’s fitness.1Justia. School Bus Accidents
  • A private bus company such as First Student when the district contracts out transportation. The contractor usually bears primary liability for its driver, and the district can still be sued if it failed to vet the contractor or monitor its safety record.1Justia. School Bus Accidents
  • The bus or component manufacturer, if a defect caused or worsened the crash. Under strict liability, you don’t have to prove carelessness, only that a defect existed and caused injury.1Justia. School Bus Accidents
  • A maintenance contractor whose sloppy repairs or missed inspections contributed to a failure.
  • Another motorist whose negligence caused the collision, including a driver who illegally passed a stopped school bus.2JT&N Law. School Bus Accident Settlement New York
  • A government body responsible for dangerous road design or unsafe bus stop placement.1Justia. School Bus Accidents

A district cannot wash its hands of a crash just by outsourcing transportation. In Settles v. Incorporated Village of Freeport, a New York court held that transporting schoolchildren is “inherently dangerous,” making the school’s safety duties nondelegable.3Education Expert. School Bus Accident Liability, Negligence, and Standards of Care Guidelines

School buses also carry a higher legal duty of care than ordinary vehicles. In many states they are classified as common carriers, which means the driver is held to a stricter safety standard that reflects the vulnerability of child passengers.4Maggiano Law. My Child Was Injured in a School Bus Accident, What Now One important wrinkle: in Michigan and other states that follow the Governmental Tort Liability Act model, a driver employed by a government district is only liable for “gross negligence,” meaning conduct so reckless it shows substantial disregard for whether injury occurs. A private contractor’s driver is held to the ordinary negligence standard.5Neumann Law Group. School Bus Accidents

The Deadline That Kills Most Cases: Notice of Claim

School districts are government entities, and sovereign immunity still shields them from suit unless specific procedural steps are followed. Nearly every state requires a formal notice of claim before a lawsuit against a district can proceed, and the window is far shorter than the regular personal injury statute of limitations.

Some states soften the immunity in other ways. Georgia considers the district’s immunity waived up to the limits of any motor vehicle insurance it purchased under O.C.G.A. §33-24-51.8John Foy & Associates. Is the School System or the Bus Driver Responsible in a School Bus Accident Virginia goes further: state law declares immunity is not a bar to suit against a school board, with recovery capped at the amount of collectible insurance in force.9Virginia Code Commission. Title 22.1, Chapter 12, Article 2

How Long a Child Has to Sue

Every state gives minors extra time to file through “tolling” rules that pause the clock until the child reaches a certain age. The catch is that tolling usually does not extend the government notice-of-claim deadline, which is what trips up most families.

  • New York: The three-year personal injury statute of limitations is tolled until the child turns 18, so a minor has until age 21 to sue. The 90-day notice of claim against a government entity is not tolled by infancy.10WKSM Law. Can You Sue if Your Child Was Injured on a School Bus in NYC
  • Michigan: Tolled until age 18 under MCL §600.5851, after which the standard three years applies. The six-month government notice still must be met by the parent or guardian.7K-Law. School Bus Accidents
  • Illinois: Child injury claims generally run eight years, extending to the child’s 22nd birthday if the child has a disability.11McCready Law. Chicago Child Injury Lawyer
  • California: The two-year personal injury statute is tolled until age 18, but the six-month government claim deadline overrides that extension and applies to children’s claims against public districts.12Tim Wright Law. Legal Help for Child Injuries in School Bus Accidents, California

A parent’s own claims for medical expenses and loss of a child’s services are generally subject to adult deadlines and are not tolled by the child’s minority.10WKSM Law. Can You Sue if Your Child Was Injured on a School Bus in NYC

What You Can Recover

A school bus accident lawsuit can seek:

  • Medical expenses, past and future, including emergency care, surgery, rehabilitation, medication, mobility aids, and long-term nursing care.13Motley Rice. Bus Passenger Injury Lawsuit
  • Lost wages, including a parent’s lost income from caring for an injured child, and a child’s future lost earning capacity if the injuries are permanent.13Motley Rice. Bus Passenger Injury Lawsuit
  • Pain and suffering, covering physical pain, emotional distress, scarring, and reduced quality of life.13Motley Rice. Bus Passenger Injury Lawsuit
  • Wrongful death damages when the crash is fatal, including loss of the deceased’s support, funeral expenses, pre-death medical bills, and the survivors’ mental anguish.13Motley Rice. Bus Passenger Injury Lawsuit

New York imposes an extra hurdle for pain and suffering. Under Insurance Law §5102(d), the injury must meet a “serious injury” threshold, which includes a fracture, a permanent consequential limitation, or significant impairment of daily activities for at least 90 of the first 180 days after the accident.2JT&N Law. Settlement Ranges and Real Case Results

Payouts in school bus cases swing enormously with the severity of the injuries and the identity of the defendants. One industry analysis put typical ranges at $5,000 to $25,000 for minor injuries like bruises and strains; $25,000 to $100,000 for fractures and concussions; $100,000 to $400,000 for serious injuries like herniated discs; and $1 million to $5 million or more for catastrophic injuries, paralysis, traumatic brain injury, and wrongful death.14Richman Law. Bus Accident Settlement

A few real outcomes illustrate the spread:

In March 2026, the family of a sixth-grade girl from Rockton, Illinois, reached a $52 million settlement with the insurers for driver Allen Pelton, Helm Group Inc., and Civil Constructors Inc. The girl was crossing to board a First Student bus in January 2025 when Pelton allegedly ignored the activated stop arm, warning lights, and crossing arm and struck her. She suffered a traumatic brain injury and now requires 24-hour care and a wheelchair. About $39 million was allocated to the student and $12.7 million to family-related expenses. The lawsuit remains pending against First Student Inc. and Rockton School District 140.15WIFR. Family, Rockton School District Student Hit at Bus Stop Receive $52M Settlement

In January 2017, Orange Unified School District in California paid $10 million to settle claims by five students injured in an April 2014 crash. The district’s driver, Gerald Rupple, lost consciousness due to undisclosed pulmonary hypertension, and the bus veered into trees with 11 children on board. One student with a traumatic brain injury received $4 million; the remaining $6 million was divided among the other four plaintiffs. The suit alleged supervisors had ignored coworker reports about Rupple’s health three months before the crash.16Voice of OC. $10 Million Settlement for Students Injured in Anaheim Hills School Bus Crash17ABC7. Smaller cases follow the same pattern. A Brooklyn pedestrian struck by a left-turning school bus who suffered a femur fracture, a herniated cervical disc requiring fusion surgery, and three fractured ribs settled for $1.35 million after jury selection.18Block O’Toole & Murphy. $1,350,000 for Pedestrian Injured in School Bus Accident Another Brooklyn case, involving a driver whose minivan was struck by a school bus and who needed two spinal surgeries, settled for $1.49 million.19Block O’Toole & Murphy. $1,490,000 for a Car Accident Victim With Neck and Back Injuries At the low end, a 17-year-old passenger who suffered neck and back strains in a crash settled for $15,000 after counsel located additional insurance coverage beyond the initial $5,000 offer.20Sauter Sullivan. $15,000 Settlement Awarded in Accident on a School Bus

Why Cases Against Districts Often Pay Less

Many states cap the money recoverable from a government entity, and those caps compress what you can collect from a school district even when the injuries are severe. Colorado limits recovery to $350,000 per person and $900,000 per occurrence. Texas caps state claims at $250,000 per person, with local government claims capped at $100,000. California and Arizona do not cap compensatory damages against the state, though punitive damages against government entities are almost universally prohibited.21Mercer Williams Law. State Sovereign Immunity and Tort Liability Chart

Caps generally do not apply to a private bus company co-defendant. That is a large part of why the Rockton case produced $52 million from the private motorist’s and companies’ insurers while the claim against the district and First Student remains unresolved: the private carriers were the deep pocket not subject to a government cap.

Court Approval When the Plaintiff Is a Child

When the injured person is a minor, parents cannot simply sign a settlement and cash the check. Courts in virtually every jurisdiction must approve the deal to make sure it is fair and that the money is safeguarded until the child reaches adulthood.

In New York, a judge conducts an “infant compromise hearing” regardless of the settlement amount or whether both sides agree.10WKSM Law. Can You Sue if Your Child Was Injured on a School Bus in NYC In New Jersey, the process involves appointing a guardian ad litem, filing a petition to compromise the claim, and a non-adversarial “friendly hearing” under Rule 4:44. If the child is 14 or older, the court usually requires their affidavit or testimony consenting to the terms. Approved funds are typically placed in a trust such as the Surrogate’s Intermingled Trust Fund, or in a structured settlement until the child turns 18.4Maggiano Law. Act Fast on Evidence

Onboard surveillance video, GPS data, and event-recorder information are routinely overwritten on short cycles. Driver personnel files, training records, vehicle maintenance logs, and inspection reports are not required to be preserved indefinitely. Attorneys handling these cases typically send immediate formal preservation demands to the school district, the bus company, and any maintenance contractor to lock down this material before it disappears.2JT&N Law. School Bus Accident Settlement New York Those same maintenance and inspection records are often decisive in a product liability claim against a manufacturer, where the question of whether a defect is a design, manufacturing, or post-sale maintenance problem turns on the paper trail.22Stephen Babcock Law. A Guide to Legal Liability in School Bus Accidents

Between the short government notice windows, the risk of evidence being overwritten, and the stricter negligence standard that applies to public-employee drivers in many states, the first few weeks after a school bus crash matter more than almost any later step in the case. If a public district may be a defendant, treat the notice-of-claim clock as the first deadline that has to be met, not the lawsuit filing date.
