Scott Farris: Finding His Father’s Remains and Trial Testimony

Scott Farris is the son of Gary and Melody Farris who discovered his father’s charred remains in a burn pile on the family’s Cherokee County, Georgia, farm in July 2018 and later served as a key prosecution witness at his mother’s murder trial. He was never charged, indicted, or named as a formal suspect by law enforcement, though Melody Farris repeatedly accused him of being the real killer, including at her sentencing.

How Scott Farris Found His Father’s Remains

On July 5, 2018, Scott walked to a burn pile roughly 80 to 100 yards from the family home on Purcell Lane. “I walk up and look, and I start seeing bones,” he later testified.¹ He reported the discovery to police the same day. DNA analysis later confirmed the badly charred remains as those of his father, Gary Wayne Farris, a 58-year-old commercial real estate attorney.²

A bullet was lodged in Gary’s rib cage, and a spent bullet matching it was recovered from the basement floor of the home, along with blood spots on the basement stairs and floor. The Georgia Bureau of Investigation Crime Lab confirmed Gary’s DNA on the bullet found inside the house.²

Why Investigators Cleared Him

Cellphone tracking data placed Scott miles away from the farm during the window prosecutors identified as the time of the killing and body movement. On the morning of July 4, 2018, Gary’s Android phone moved from the house to the burn pile and back between roughly 7:58 a.m. and 9:05 a.m. Investigators determined Melody was the only person at the home during that window, while Scott’s phone showed him elsewhere.³

Prosecutors called Scott as a witness, not a person of interest. Nothing in the reporting from the case indicates that law enforcement ever considered him a formal suspect. Detective Daniel Hayes, who worked the case, later called his mother’s accusations against him “off-the-wall claims” that were “not provable.”³

His Testimony at the Trial

Scott took the stand over two days in October 2024 during his mother’s trial in Cherokee County Superior Court. His testimony was described as tearful. He told jurors about tensions in the household caused by his mother’s long absences, her spending of his father’s money, and her affair with Tennessee farm equipment salesman Roy “Rusty” Barton.³

Asked directly whether he killed his father, Scott answered, “I absolutely did not murder my father.”³ He also pushed back on the suggestion he had a financial motive. He denied being a “mooch,” describing his role running day-to-day operations on the ten-acre farm and living in an apartment above the barn as a mutually beneficial arrangement with his father. He testified that Gary had once told him to hold onto his credit “as if his life depended on it.”⁴

Scott was one of three of the Farris children who testified against their mother, along with Chris and Emily. Only the youngest daughter, Amanda, supported Melody during the trial.⁵

The Defense’s Attempt to Point at Him

Defense attorneys John Luke Weaver and Michael Ray offered Scott as an alternative suspect. They noted that .38 caliber ammunition, the caliber used to kill Gary, was found in Scott’s loft apartment, and that he was the only family member who owned guns.⁴ They argued his room had been cleaned with a “magic eraser” and that investigators never properly searched his living space for blood traces.⁶ The defense attributed the blood inside the house to a dog bite on Gary’s ankle and challenged the reliability of the cellphone tracking data.

The jury rejected that theory. On November 4, 2024, Melody Farris was convicted on all five counts: malice murder, felony murder, aggravated assault, concealing the death of another, and making a false statement.²

Melody’s Sentencing Accusation and Scott’s Response

At her sentencing on December 5, 2024, Melody Farris turned to the courtroom and said, “I know Scott killed his father.” She claimed she had concealed the “true murderer’s identity” for six years out of maternal loyalty, alleged that Scott had failed a polygraph test, and said she had witnessed him leaving the burn pile.⁶ She also claimed Gary had been planning to cut Scott off financially, giving him a motive to kill and “set your mother up” so he could inherit everything.³

Judge David Cannon Jr. interrupted her, telling her the sentencing was not the place to relitigate the case or introduce new evidence. He sentenced her to life in prison with the possibility of parole after 30 years, plus five concurrent additional years for concealing a death and making false statements. He also barred her from contacting family members unless they initiated contact.⁷

Scott responded publicly, calling his mother’s statement “one last turn of the knife” meant to ruin his life because the trial did not end in her acquittal. No reporting in the case indicates that law enforcement confirmed the polygraph allegation or reopened any inquiry into Scott.³

Where Things Stand

Scott Farris has never been charged in connection with his father’s death. Melody Farris remains incarcerated and continues to maintain her innocence and blame her son. She will not be eligible for parole until 2054, at age 94.⁷

In March 2026, CBS launched a six-episode podcast titled “Blood Is Thicker: The Farris Wheel,” hosted by “48 Hours” correspondent Peter Van Sant. It features an hour-long prison interview with Melody in which she again accuses Scott, and it also includes an interview with Scott himself.⁸ Van Sant described Melody as “tough as nails,” “self-absorbed,” and “angry,” while noting that a jury and the legal system found her guilty.⁹ As of mid-2026, no formal appeal has been publicly reported.¹⁰
