Is the Check in Your Mailbox Real

A check that arrives unexpectedly isn’t automatically fake. You may have been included in a class action without ever filing anything, especially for settlements where membership is drawn from company records. But scammers do exploit the volume of real settlement mail circulating every year, so it’s worth checking.

Look up the bank printed on the check through the FDIC’s BankFind tool rather than calling any phone number printed on the check itself. Scammers sometimes put fake contact information on convincing-looking checks.17FDIC. Consumer News: How to Detect a Fake Check Check whether the postmark matches the issuing bank’s location. Inspect for security features like watermarks and color-changing ink. If the check is for more money than you expected, or if anyone asks you to send a portion of it back via gift cards, wire transfer, or cryptocurrency, it’s a scam.18Federal Trade Commission. One detail that trips people up: your bank may make the funds available within a day or two, but that doesn’t mean the check has actually cleared. Fake checks can take weeks to bounce, and the bank will pull the money back once they do. If you suspect a fraudulent check, report it to the FTC at reportfraud.ftc.gov and to the U.S. Postal Inspection Service at uspis.gov.19NBC San Diego. If You Filed and Your Check Hasn’t Come

Common reasons for delay are high claim volumes, processing backlogs at the administrator, address errors, and outstanding appeals by objectors. For personal injury settlements specifically, delays often stem from unresolved medical liens. Medicare alone can take 30 to 60 days to provide final lien amounts.20Fund Capital America. Why Is My Post-Settlement Check Taking So Long to Arrive

Contact the settlement administrator directly. Every class action settlement has one, and the contact information appears in the original notice you received and on the settlement website. Companies like Kroll, Epiq, and JND Legal Administration handle most of this work.21Kroll. Settlement Administration If your address has changed since you filed, update it immediately. Administrators use skip tracing and USPS forwarding to find people, but those tools have limits.22Kroll. Ensuring Payment to Class Action Claimants For personal injury cases where an insurance company is dragging its feet, following up with the adjuster and escalating to their supervisor is standard practice. If the delay stretches past 30 days without explanation, filing a complaint with your state’s department of insurance is an option.23Walter Clark Legal Group. Settlement Check Delayed

Cash the Check Before It Expires

Settlement checks have expiration dates printed on the face, and 90 days is common for FTC refund checks.24Federal Trade Commission. Unclaimed money from class actions is often redistributed to other claimants, donated to a nonprofit through what courts call a cy pres award, or eventually turned over to the state as unclaimed property.25Duke University Judicial Studies Center. If your check has already expired, contact the settlement administrator with your original check number and ask about reissuance. You may need to sign a short affidavit confirming the original was never cashed. Some administrators charge a small processing fee, typically $10 to $25, though they sometimes waive it. If the settlement fund has been fully depleted, your state’s unclaimed property office may hold the money. Funds are generally kept for three to five years before being transferred to the state.26Claimyr. What Can I Do About an Expired Settlement Check

A USPS Postmark Change That Affects Mailed Claims

A USPS rule that took effect on December 24, 2025, formalized something that had been quietly happening: postmark dates now reflect when mail is processed at a regional sorting facility, not when it’s dropped in a mailbox or handed to a postal clerk. The gap can be several days.27Federal Register. Postmarks and Postal Possession For people mailing claim forms or opt-out requests by a court deadline, this matters. A form dropped in a mailbox on the deadline date could receive a postmark two or three days later, making it appear late.

If you need to mail something deadline-sensitive, take it to a USPS retail counter and request a hand-stamped postmark, which is free and reflects the actual date you handed it over. Certified mail or a certificate of mailing also provides dated proof.28Kroll. USPS Postmark Changes and Class Action Deadlines Where a settlement allows online filing, use it.
