Shanda Vander Ark Case: Trial, Sentence, and New Trial Ruling

The Shanda Vander Ark case is a Michigan murder prosecution in which a Norton Shores mother was convicted of first-degree murder and first-degree child abuse for starving and torturing her 15-year-old disabled son, Timothy Ferguson, to death in July 2022. She is serving life in prison without the possibility of parole, and in June 2026 a judge denied her motion for a new trial. A separate appeal to the Michigan Court of Appeals remained pending as of mid-2026.¹

How Timothy Ferguson Died

Timothy Ferguson died on July 6, 2022, at his family’s home on Marshall Road in Norton Shores, Michigan. He was 15. He had autism along with speech and motor impairments. When officers arrived, they found him in an ice bath and in restraints. He weighed 69 pounds.

Dr. Joyce DeYoung, the medical examiner, ruled the death a homicide caused by malnourishment and hypothermia. She testified that Timothy was “extremely emaciated,” had “no body fat,” and that his body was “breaking down.”²

The Pattern of Abuse

Prosecutors described a prolonged campaign directed by Shanda Vander Ark and carried out with her older son, Paul Ferguson. Timothy was home-schooled and largely confined to the house. Vander Ark monitored him through surveillance cameras even when she was away at work as a law clerk.³

The refrigerator and food cabinets were locked. When Timothy was fed, meals were often bread or bread soaked in hot sauce. He was forced to eat and then forced to vomit. Prosecutors told the jury he was subjected to ice baths as punishment, restrained with shackles and zip ties, and deprived of sleep.⁴

Text messages between Vander Ark and Paul Ferguson anchored the state’s case. In them, the two discussed their belief that Timothy was “faking” his disabilities, including his inability to walk, and they planned punishments. One message read, “I think we need to actually feed him.”⁵ Other messages directed Paul to pour hot sauce on Timothy’s genitals and to taunt him with food such as a frozen pizza roll.⁶

Vander Ark’s Legal Background

Vander Ark had built a legal career before her arrest. She earned a bachelor’s degree in paralegal studies from Liberty University in 2016, enrolled at Western Michigan University’s Cooley Law School in 2018 on a full scholarship, graduated in 2021, and passed the Michigan bar exam on her first attempt. She worked as a law clerk for Muskegon County Circuit Judge Annette R. Smedley and later for Newaygo County Circuit Judge Robert Springstead, earning $19.23 per hour under a contract that ran from August 2021 through September 2022.³

The Trial and Verdict

Vander Ark was charged with open murder and first-degree child abuse. Her trial took place in December 2023 in Muskegon County Circuit Court before Judge Matthew Kacel, with Assistant Prosecutor Heather Bloomquist for the state and Muskegon County public defender Fred Johnson representing her.⁷

Paul Ferguson, who had pleaded guilty to first-degree child abuse under an agreement that spared him from murder charges, testified against his mother. He said he carried out the abuse under her instructions and that she had convinced him Timothy was “faking” his inability to walk and was on a “hunger strike.”²

Vander Ark took the stand in her own defense. She denied intending to kill Timothy, tried to shift blame to Paul, and told the jury she had “gaps in her memory.” Photographs of Timothy’s body were graphic enough that jurors and witnesses became visibly ill in the courtroom.⁶

On December 15, 2023, the jury found her guilty of first-degree murder and first-degree child abuse.²

Sentences for Both Defendants

On January 23, 2024, Judge Kacel sentenced Vander Ark to life in prison without the possibility of parole for the murder conviction and 50 to 100 years for first-degree child abuse. The child-abuse term exceeded sentencing guidelines. The judge said the departure was warranted by the “amount of torture” Timothy endured, telling her from the bench, “This wasn’t punishment. … You tortured him.”²

Paul Ferguson, 21 at sentencing, pleaded guilty to one count of first-degree child abuse in December 2023. In exchange for his plea and his testimony, prosecutors agreed not to pursue additional charges, including murder.⁸ On February 26, 2024, he was sentenced to 30 to 100 years in prison. Guidelines had suggested 9 to 15 years.⁴

The Motion for a New Trial

Vander Ark, represented by new counsel Ronald Ambrose, moved for a new trial on two theories: that she had been mentally incompetent during her trial, and that Fred Johnson had provided ineffective assistance of counsel.

The Competency Argument

Ambrose argued Vander Ark had experienced a “significant downturn in her mental health” during trial and that the proceedings should have been paused for a mental health evaluation.⁹ Bloomquist called it a “feigned bout of incompetence” designed to “undermine a jury verdict,” pointing to Vander Ark’s legal training.

In July 2025, Judge Kacel rejected the competency claim. He found Vander Ark had “knowingly and voluntarily” waived her right to be present for portions of the trial, and noted that being “understandably distressed” is not the same as being mentally incompetent. Trial recordings, he said, showed her “calm” and “collected” until she faced difficult questions from the prosecutor. He called her claims of memory loss about the waiver “self-serving” and “convenient.”⁹

The Ineffective Counsel Argument

Kacel did allow an evidentiary hearing, known in Michigan as a Ginther hearing, on the ineffective-assistance claim. The core complaint was Johnson’s decision during closing arguments to concede that Vander Ark had “committed manslaughter” — a concession she said she never authorized.¹⁰ She also alleged Johnson visited her in jail only twice in the month before trial and refused to pursue a theory that Timothy had been attempting suicide by dehydration.¹¹

At the hearing, Vander Ark testified for nearly an hour under questioning by Bloomquist and blamed her convictions on others, including the Muskegon County jail, her ex-husband, and Timothy himself, whom she accused of “causing chaos” and “stress.” Johnson defended his strategy, telling the court that given surveillance footage, co-conspirator testimony, and the text messages, he had chosen to focus on premeditation and to concede to a lesser offense to reduce her exposure to a murder conviction. He cited her bar-exam performance and judicial clerkships as context for the strategic choices they made together.¹²

The June 2026 Ruling

On June 10, 2026, Judge Kacel issued an eight-page opinion denying the motion in full. He wrote that “the evidence of [Vander Ark’s] guilt in this case was overwhelming,” and concluded that even assuming trial counsel had been deficient, “the court cannot find that there is reasonable probability the correction of those errors would have resulted in a different outcome.”¹

Where the Case Stands

Vander Ark remains in prison serving life without parole. Her separate appeal to the Michigan Court of Appeals, filed in March 2024, was still pending as of mid-2026. Paul Ferguson filed a motion in August 2024 to correct what he argued was an invalid sentence and to seek resentencing; no hearing had been scheduled on that motion as of mid-2026.¹
