Shanda Vander Ark Trial: Verdict, Sentencing, and Appeal

Shanda Vander Ark’s trial ended on December 15, 2023, when a Muskegon County jury found her guilty of first-degree murder and first-degree child abuse in the starvation and torture death of her 15-year-old son, Timothy Ferguson. Judge Matthew Kacel sentenced her on January 23, 2024, to life in prison without the possibility of parole, plus 50 to 100 years for the child abuse conviction.¹ Her motion for a new trial was denied in June 2026, and a separate appeal to the Michigan Court of Appeals remains pending.²

What the Jury Heard

The case was tried in Muskegon County Circuit Court, with Assistant Prosecutor Heather Bloomquist leading the state’s case. Prosecutors presented evidence that Vander Ark, who believed Timothy was faking his autism, confined him to a small closet under the basement stairs and inflicted escalating punishments during the final months of his life. Those punishments included locking the refrigerator and food cabinets, feeding him bread soaked in extremely hot sauce, forcing him into ice baths, and depriving him of sleep.³ When he was found unresponsive on July 6, 2022, Timothy weighed 69 pounds. An autopsy attributed his death to malnourishment and hypothermia, and the medical examiner ruled it a homicide.

Vander Ark had installed a surveillance camera, motion sensors, and alarms in the closet to monitor Timothy’s movements. Investigators recovered a MicroSD card from the camera. Judge Kacel ruled the footage too “horrific” to show the jury directly; instead, a police lieutenant described its contents from the stand, including video of Vander Ark dragging Timothy onto a tarp on the closet floor, calling him “pathetic,” and clamping his mouth shut while he struggled to breathe.⁴⁵

Text messages between Vander Ark and her older son, Paul Ferguson, detailed punishments she ordered him to carry out. One asked whether he would “pour hot sauce onto Timothy’s private parts”; Paul testified he refused that instruction, calling it “beyond cruel as everything else was.”⁶ Another text, sent the day before Timothy died, told Paul to offer Timothy “some pizza rolls” if he could sit up by himself, adding, “Don’t tell him its only two, and I’m okay if they are frozen rather than cooked.”⁴ A bottle of hot sauce labeled “Elijah’s Xtreme Regret,” made with Trinidad Scorpion and Carolina Reaper peppers, was found in the home and entered as an exhibit. Paul testified that in the hours before Timothy’s death, he placed the boy in an ice bath for approximately nine hours at his mother’s direction. After Timothy was found unresponsive, 18 minutes passed before anyone called 911, and Vander Ark and Paul initially told investigators Timothy had been on a “hunger strike.”

The Defense and the Manslaughter Concession

Defense attorney Fred Johnson did not contest the underlying abuse. He argued instead that the killing was not premeditated, telling the jury in closing that Vander Ark “committed manslaughter … but didn’t intend to.”⁷ Johnson later testified that the volume of evidence against his client was “massive,” and that every expert he consulted offered opinions that would have supported a guilty verdict, with one describing Vander Ark as a “monster.”⁸ That concession later became the centerpiece of Vander Ark’s post-conviction claims.

Verdict

Vander Ark was not present for closing arguments or the reading of the verdict. The defense described a “significant downturn in her mental health” during trial, and she left the courtroom. The jury returned guilty verdicts on both counts on December 15, 2023.⁴

Sentencing

At the January 23, 2024 sentencing, Judge Kacel imposed life without parole for the murder count and 50 to 100 years for first-degree child abuse. Addressing Vander Ark from the bench, he said: “I’ve been trying now for this entire case to wrap my mind around how somebody could do something so horrific, not only to another human being but to their own child. … You intentionally and systematically tortured this child. Let’s call it what it is: It’s torture.”⁹

Paul Ferguson’s Plea

Paul Ferguson pleaded guilty to first-degree child abuse in December 2023 and was sentenced on February 26, 2024, to 30 to 100 years in prison.¹⁰ Judge Kacel rejected his claim that he acted solely under his mother’s control, calling the abuse a “collaborative effort.”

Motion for a New Trial

Through appellate attorney Ronald D. Ambrose, Vander Ark asked the trial court to grant her a new trial on two grounds. She argued she had been mentally incompetent during trial, describing herself as having been in a “catatonic state,” and she argued Johnson provided ineffective assistance of counsel by conceding manslaughter without her permission.⁸

In July 2025, Judge Kacel rejected the competency claim. He found that Vander Ark had knowingly and voluntarily waived her right to be present during portions of trial, that being “understandably distressed” was not the same as being “mentally incompetent to stand trial,” and that trial recordings showed her appearing “calm” and “collected” during much of the proceedings.¹¹ He did grant an evidentiary hearing, known in Michigan as a Ginther hearing, on the ineffective-assistance claim.

The hearing began in November 2025 and reconvened in March 2026. Johnson testified that he had not received Vander Ark’s permission to make the manslaughter concession in closing. Even so, Judge Kacel denied the motion in an eight-page ruling on June 10, 2026, concluding that “the evidence of (Vander Ark’s) guilt in this case was overwhelming” and that, assuming Johnson was deficient, “the court cannot find that there is reasonable probability the correction of those errors would have resulted in a different outcome.”²

The Pending Appeal

Separately from the new-trial motion, Vander Ark filed a direct appeal to the Michigan Court of Appeals in March 2024. In April 2025, Judge Mark T. Boonstra granted a motion extending the deadline for the appellant’s brief to May 26, 2025.¹² As of June 2026, that appeal remains pending.²

Who Timothy Was

Timothy Ferguson had autism with speech and motor impairments and was being home-schooled at the time of his death.¹³ He had been sent by his father, Eric Ferguson, from Oklahoma to live with Vander Ark in Michigan in May 2021, pulled out of school days before he would have finished his freshman year. He died roughly 14 months later. Custody records in Oklahoma had, years earlier, limited Vander Ark to three hours of supervised visitation per month; Oklahoma child welfare authorities had recommended terminating her parental rights, but the termination did not go forward after she agreed to let Eric maintain custody.¹⁴
