Shanda Vander Ark’s Crime Scene: Abuse, Life Sentence, and Appeal

The Shanda Vander Ark case is the Michigan prosecution of a Norton Shores mother who tortured and starved her 15-year-old disabled son, Timothy Ferguson, to death in July 2022. A Muskegon County jury convicted her of first-degree murder and first-degree child abuse in December 2023, and in January 2024 she was sentenced to life in prison without the possibility of parole.¹

Who Timothy Ferguson Was

Timothy Ferguson was 15 years old. He had autism, a speech impairment, and a motor impairment, and he lived with his mother, Shanda Vander Ark, and his older brother, Paul Ferguson, in Norton Shores, a community in Muskegon County, Michigan.² His disabilities made him dependent on the very people who would be convicted of killing him.³

How Timothy Died

On July 6, 2022, Norton Shores police responded to a report of a suspicious death at the Vander Ark home. Officers found Timothy in a small room under the basement stairs, lying on a tarp that had been used as a bed.⁴ He weighed 69 pounds. An officer described him as “skin and bones.”⁵

There was an 18-minute gap between the moment Vander Ark and Paul Ferguson found Timothy unresponsive and the 911 call. On that call, they told the dispatcher Timothy had been on a “hunger strike.” Prosecutors later proved that story was fabricated.⁴ Vander Ark was arrested that same morning.⁶

The autopsy listed the cause of death as malnourishment and hypothermia. The manner of death was ruled a homicide.³

The Abuse Inside the Home

The investigation and trial revealed months of escalating torture directed by Timothy’s mother. Vander Ark locked the refrigerator and food cabinets so Timothy could not eat. When he was fed, it was bread, or bread soaked in hot sauce as punishment. After Timothy ate remnants of a bun crust from a discarded hamburger on one occasion, she directed Paul Ferguson to force him to vomit.⁵

He was forced into prolonged ice baths. In the hours before Timothy’s death, Paul Ferguson allegedly kept him in an ice bath for roughly nine hours.⁴ Timothy was also deprived of sleep and kept in restraints, including leg irons. At trial, Vander Ark claimed the shackles had been purchased by Paul on her Amazon account without her knowledge.⁵

The house was rigged with cameras, motion sensors, and alarms so Vander Ark and Paul could track Timothy’s movements. One motion sensor was attached directly to his body.⁷ Video evidence showed Vander Ark dragging Timothy into the closet where he was kept, and at one point holding his mouth shut while telling him he did not need to breathe through his mouth.⁴

Text messages read at trial included a request from Vander Ark asking Paul to pour hot sauce on Timothy’s genitals. Paul testified that he refused, calling the request “beyond cruel.”⁷ Other messages showed the pair discussing Timothy’s inability to walk and dismissing his worsening symptoms as “faked.”⁵ After Timothy died, Vander Ark told Paul to lie to police and say the boy had been on a hunger strike.

The Trial and the Vomiting Incident

Vander Ark’s trial took place in December 2023 in Muskegon County Circuit Court before Judge Matthew Kacel.⁶ The most widely reported moment came on December 14, 2023. During cross-examination, Muskegon County Chief Trial Prosecutor Matt Roberts questioned her for about four hours about the text messages detailing punishments she had ordered, then showed her photographs of Timothy taken in the hours before his death. She vomited on the witness stand.⁸ She did not appear in court the following day.⁴

The jury found her guilty of both first-degree murder and first-degree child abuse.¹

Life Sentence Without Parole

Vander Ark was sentenced on January 22, 2024. Judge Kacel imposed the mandatory life-without-parole sentence for the murder conviction and an additional 50 to 100 years for the child abuse conviction.¹ From the bench, he told her: “You intentionally and systematically tortured this child. Let’s call it what it is: It’s torture.”⁹ The judge said he did not believe she had specifically intended to kill Timothy, but added, “You planned to continue to torture him. This wasn’t punishment. You tortured him.”⁵

Paul Ferguson’s Role and Sentence

Paul Ferguson, Timothy’s older brother, was charged with first-degree child abuse. He pleaded guilty in December 2023 and testified against his mother at trial, describing his role as “something close to Stockholm Syndrome” and confirming that the hunger-strike account given to 911 dispatchers had been fabricated at her direction.¹⁰

He was sentenced on February 26, 2024, to a minimum of 30 years and a maximum of 100 years in prison. Reading a letter to the court, he said, “If I could do it all again and do it right, I would,” and asked for mercy. Judge Kacel was not persuaded, telling him: “I don’t believe that you’re sorry. I don’t believe you have any empathy.” The judge added that Ferguson “is one step away from becoming a psychopath like his mother.”¹¹

Appeals and Motion for a New Trial

Vander Ark filed an appeal with the Michigan Court of Appeals in March 2024, which remains pending. She also filed a motion for a new trial, arguing she had been in a “catatonic state” during portions of the original trial and that her trial attorney had been ineffective, including by pursuing a manslaughter defense without her consent.⁶

Judge Kacel rejected the competency argument, characterizing her behavior as a “feigned bout of incompetence” and calling her memory-loss claims “self-serving.” He found she had “knowingly and voluntarily” waived her right to be present at portions of the trial.¹² On June 10, 2026, he issued an eight-page ruling denying the motion in full. On the ineffective-assistance claim, he wrote: “The evidence of [Vander Ark’s] guilt in this case was overwhelming. Assuming [Vander Ark’s trial attorney] was deficient, the court cannot find that there is reasonable probability the correction of those errors would have resulted in a different outcome.” Vander Ark remains in prison serving her life sentence.⁶
