Silica Dust Exposure Lawsuits: Payouts, Deadlines, and Engineered Stone

Workers who developed silicosis from cutting, grinding, or polishing engineered stone countertops can sue the companies that made and sold the slabs, and an engineered stone silicosis lawsuit is now one of the fastest-growing product liability claims in the country. Two juries have already returned eight-figure verdicts against manufacturers, hundreds of cases are pending (most of them in California), and Congress is weighing a bill that would retroactively wipe them out.

Who Can Sue and for What

These cases are brought against the manufacturers and distributors of artificial stone slabs, not primarily against the fabrication shops that employed the workers. The defendants named most often are Caesarstone USA, Cambria Company, the Cosentino Group (maker of Silestone), Colorquartz USA, and Hyundai L&C USA.1Sokolove Law. Countertop Silicosis

Plaintiffs typically plead four theories:

  • Design defect — a slab that is more than 90% crystalline silica cannot be fabricated without releasing dangerous dust, so the product is unreasonably dangerous for its intended use.
  • Failure to warn — manufacturers did not adequately disclose the silica hazards of fabrication on labels or in instructions to shops.
  • Negligence and misrepresentation — companies marketed the material as “pure natural quartz” while downplaying the health risks and failed to support safer work practices.2PR Newswire. • Strict liability — the manufacturer can be held responsible for harm the product caused regardless of intent.3Poulsen Law. Silicosis Manufacturer Liability

Manufacturers have taken the position that worker safety is the fabrication shop’s job and that the product is safe when proper precautions are used.4Public Health Watch. California Silicosis Ban Lung Disease Stone Countertops Juries so far have not accepted that argument. In the Colorado trial, the jury specifically found that the plaintiff’s employer had followed OSHA protocols written for natural stone and had been misled by the defendants’ failure to warn about the different hazards of the engineered product.

Why Workers’ Compensation Is Not Enough

Workers’ comp is no-fault but pays only medical costs and partial wage replacement, with nothing for pain and suffering. In California, only about 7% of confirmed engineered stone silicosis patients had their care paid through workers’ compensation, in part because many fabrication workers are classified as independent contractors and never qualify.5U.S. Congress. California Silicosis Surveillance Report A third-party suit against the manufacturer is what lets a sick worker reach full compensatory damages, including future medical costs (lung transplants cost millions), lost earning capacity, and pain and suffering.6Gerber Elkins Law. What These Cases Have Been Worth

The first jury verdict in a U.S. engineered stone silicosis case came in Los Angeles County Superior Court in the summer of 2024. Gustavo Reyes Gonzalez, a 34-year-old fabricator who had cut artificial stone for nearly two decades, developed progressive massive fibrosis and underwent a double lung transplant in February 2023. A jury awarded $52,437,366 against Caesarstone USA, Cambria Company, and Color Marble. Thirty-four manufacturers had originally been named; 29 settled before trial and two obtained summary judgment, leaving three to face the verdict.7Public Health Watch. Landmark Results Against Artificial Stone Manufacturers Total Over $78 Million for Workers With Fatal Silicosis

In April 2026, a Denver jury returned the second major verdict. Tyler Jordan, a 31-year-old former fabricator diagnosed with artificial stone silicosis and silica-caused chronic kidney disease, was awarded $17,450,000: $7.6 million in economic damages, $1.65 million in non-economic damages, $7.6 million for physical impairment, and $600,000 in loss of consortium to his wife. The jury assigned 32% of fault to Cambria for misrepresentation and 3% to Hyundai USA LLC for negligence and misrepresentation.2PR Newswire. Reported outcomes outside those two trials vary widely. A $7.6 million award went to the family of a worker who died of respiratory failure, a $2 million payout resolved a case in which silicosis progressed to lung cancer, and Cosentino paid $1.2 million to settle a 15-year dispute with five Spanish stonemasons over Silestone labeling after a judge found the company had failed to adequately disclose the product’s 95% silica content. Cosentino said that settlement should not be generalized to other cases.9Etheno Stroff Law. Silicosis Lawsuit10KBB Focus. Cosentino Settles 15-Year Legal Dispute Around Dangers of Silestone

No individual number predicts another individual case. Damages track disease severity (silicosis, progressive massive fibrosis, kidney involvement, cancer, death), the need for and timing of a lung transplant, the plaintiff’s age and earnings, and the strength of the evidence against each defendant.

Where Cases Are Filed and How Long You Have

There is no federal multidistrict litigation consolidating engineered stone silicosis cases as of mid-2026. Suits are proceeding as individual filings and are described as being in relatively early stages overall.11Consumer Notice. Silicosis Lawsuits California is where most of them are concentrated; the state’s silicosis docket is being coordinated under Presiding Judge Sergio C. Tapia II on a model borrowed from asbestos litigation.12Helbock Law. Top Silicosis Lawsuit Settlement Amounts Cambria alone reportedly faces about 400 cases.13KQED. Deadlines are state-specific, and silicosis has a latency period, so most jurisdictions apply a discovery rule: the clock starts when you were diagnosed or reasonably should have known the illness was work-related, not when you were first exposed.14Silicosis.com. Understanding Legal Claim Eligibility California requires personal injury claims to be filed within two years of the date the plaintiff knew, or reasonably should have known, of the injury, its physical cause, and enough facts to suspect wrongdoing by someone else.15Brayton Law. Engineered Stone Quartz Silicosis and Cancer Lawsuit Because the discovery date can be contested, workers who have been diagnosed should not wait to consult counsel.

The Federal Bill That Could End These Lawsuits

The engineered stone industry is pursuing a legislative shield in Washington. The Protection of Lawful Commerce in Stone Slab Products Act, H.R. 5437, was introduced in September 2025 by Representative Tom McClintock (R-Calif.) with 16 Republican cosponsors.16Congress.gov. H.R. 5437 – Protection of Lawful Commerce in Stone Slab Products Act The bill would bar federal and state civil claims against manufacturers and sellers of stone slabs for injuries caused by their products, and it would apply retroactively, which means pending cases could be dismissed if it becomes law.17AFL-CIO. Letter Opposing Legislation Would Shield Manufacturers

On June 3, 2026, the House Judiciary Committee voted 16–7 along party lines to advance it.18Bloomberg Law. Liability Shield for Engineered Stone Makers Advances in House The AFL-CIO is opposing it, arguing it would eliminate the only realistic source of compensation for medical treatment and remove the financial incentive for manufacturers to develop safer materials.17AFL-CIO. Letter Opposing Legislation Would Shield Manufacturers The bill has not become law, but its retroactive design is one reason plaintiffs’ attorneys are urging workers not to delay filing.

Why Engineered Stone Causes Disease So Quickly

Natural granite is roughly 10 to 45% crystalline silica. Engineered stone (often sold as quartz countertop material) can run above 90%.19AIHA. Australia’s New Engineered Stone Ban to Begin in July Cutting, grinding, and polishing it, particularly without water suppression, releases extremely high concentrations of respirable silica dust.

Classic silicosis from mining or sandblasting usually takes 10 to 30 years to develop. Engineered stone silicosis follows a compressed timeline that clinicians call accelerated silicosis, with symptoms sometimes appearing within a few years of first exposure.20BPAC NZ. Silicosis Workers in their twenties and thirties are being diagnosed with progressive massive fibrosis, a stage that can require lung transplantation or prove fatal. A California surveillance program confirmed 296 silicosis cases between 2019 and 2024; 82% were linked to engineered stone, 15 workers died, and 30 received lung transplants.5U.S. Congress. California Silicosis Surveillance Report

For a claim, the fact pattern that fits is straightforward: hands-on fabrication work with artificial stone slabs, dry or minimally wet-cut, over months or years, followed by a diagnosis of silicosis, progressive massive fibrosis, silica-related kidney disease, or silica-related lung cancer. Documentation of the specific brands handled matters, because liability is apportioned among the manufacturers whose products the plaintiff worked with.
