If you were injured as a passenger or crew member aboard a Silversea ship, a Silversea Cruises lawsuit almost always has to be filed in federal court in South Florida, and the clock is short: written notice of the claim within six months of the incident, and a complaint on file within one year. Those two deadlines, set by the passenger ticket contract and backed by federal law, decide more Silversea cases than any argument about fault ever does.
The Deadlines That Decide Most Cases
Silversea’s passenger ticket contract imposes two time limits that are shorter than most state personal injury statutes. First, an injured passenger has to deliver written notice of the claim to the cruise line within six months of the incident.1Brais Law Firm. Silversea Cruises Second, the actual lawsuit has to be filed within one year of the date of the accident.2Cruise Lawyer Miami. Silversea Cruise Accidents Injuries Miss either and the case is usually over.
Federal law lets cruise lines enforce these restrictions under 46 U.S.C. § 30508.3Plaintiff Magazine. Cruise Ship Passenger Injury Litigation The Eleventh Circuit has upheld the one-year filing period against Silversea passengers directly. In Baer v. Silversea Cruises Ltd. (2018), the court ruled that the deadline had been “reasonably communicated” to the passenger and was binding.4FindLaw. Baer v. Silversea Cruises Ltd.
Crew members are on a different clock. Claims brought under the Jones Act generally carry a three-year statute of limitations, though individual employment contracts may shorten that window.5Chalik Law. How the Jones Act Impacts Cruise Ship Injury Claims
Where the Case Has to Be Filed
Silversea’s ticket contract requires virtually all personal injury suits to be filed in the United States District Court for the Southern District of Florida, which sits in Fort Lauderdale and Miami. That rule applies no matter where you live, where the ship departed, or where you were hurt. The company named in the contract is Silversea Cruises Ltd., with a registered address at 1050 Caribbean Way, Miami, Florida.6Royal Caribbean Cruises Ltd. Some plaintiffs name the parent company, Royal Caribbean Cruises Ltd., instead of the Silversea subsidiary. Royal Caribbean acquired two-thirds of Silversea in July 2018 and the remainder in July 2020, and the Silversea brand now operates out of Royal Caribbean Group headquarters in Miami.8Silversea Cruises. What Kinds of Injuries Lead to Lawsuits
Claims against Silversea tend to cluster in a few recurring categories:
- Slip-and-fall injuries on wet decks, staircases, pool areas, buffet lines, and gangways.2Cruise Lawyer Miami. Silversea Cruise Accidents Injuries
- Gangway accidents tied specifically to worn or missing anti-slip strips, which have surfaced in more than one recent case.
- Medical malpractice by onboard doctors and nurses, who the ticket contract classifies as independent contractors.9Silversea Cruises. United States Cruise Ticket Contract
- Shore excursion injuries, where Silversea’s terms designate the local operator as an independent contractor and say the cruise line is “in no way responsible for the performance of the excursion.”10Silversea Cruises. Global Purchase Terms and Conditions
- Sexual assault and other criminal acts aboard, where cruise lines have a duty to provide reasonable security against foreseeable harm.
What the Ticket Contract Takes Away
Beyond the venue and deadlines, Silversea’s contract strips out several rights passengers may assume they have. It waives the right to a jury trial, prohibits class actions, and limits the carrier’s liability to injury “directly caused by its negligence or willful misconduct.” Personal injury, illness, and death claims are excluded from the mandatory arbitration clause, so those still go to court.10Silversea Cruises. Global Purchase Terms and Conditions
For international voyages involving European Union ports, the contract caps liability under EU Regulation 392/2009 and the Athens Convention at 400,000 Special Drawing Rights per passenger, roughly $552,000.11Silversea Cruises. Passage Contract
The jury question has one wrinkle. When a case is filed solely under federal admiralty jurisdiction, there is generally no jury. A jury is available if the case is filed in state court under the Savings to Suitors Clause or in federal court under diversity jurisdiction.3Plaintiff Magazine. Cruise Ship Passenger Injury Litigation
Shore excursions deserve their own warning. The contract directs passengers to bring any shore excursion injury claim “against the local shore excursion operator” rather than against Silversea.10Silversea Cruises. Global Purchase Terms and Conditions That is not always the last word. Attorneys have gotten around the clause by alleging negligent selection or vetting of the operator, or enough cruise-line control over the excursion to create an agency relationship. Holding the cruise line responsible for a shore injury generally requires showing it had actual or constructive knowledge of the danger.3Plaintiff Magazine. Cruise Ship Passenger Injury Litigation
Crew Member Claims Are Different
Crew members have broader and longer-running options than passengers. Under the Jones Act (46 U.S.C. § 30104), qualifying seamen can sue their employer for injuries caused by negligence. The protection covers kitchen staff, entertainers, housekeepers, deckhands, and most other workers who spend a substantial portion of their time performing duties aboard a vessel on navigable waters.5Chalik Law. How the Jones Act Impacts Cruise Ship Injury Claims
Two additional remedies sit alongside Jones Act negligence. An unseaworthiness claim holds the vessel owner responsible for providing a properly maintained ship, including equipment like gangways. A maintenance and cure claim requires the employer to pay for medical care and a daily living allowance until the worker reaches maximum medical improvement, regardless of fault.12Holzberg Legal. Recent Cases Show How This Plays Out
Two gangway cases from the past two years illustrate how passenger and crew claims look in practice, and how similar the underlying facts can be.
Brown v. Royal Caribbean Cruises (2025)
Ruth Brown sued in the Southern District of Florida after slipping on a 36-step steel gangway while disembarking the Silver Muse in Hobart, Tasmania, on January 23, 2025. Her complaint called the gangway damp and “dangerously slick” and alleged the anti-slip strips were “worn out or partially missing.” She accused Silversea of negligent maintenance and failure to warn by posting signs or cordoning off the area.13Holzberg Legal. The parties settled in August 2025, and Judge Rodolfo A. Ruiz II dismissed the case with prejudice on September 22, 2025. Settlement terms were not disclosed.14PACER Monitor. Brown v. Mulic v. International Cruise Shops and Silversea (2026)
Nidzara Mulic, a Bosnian citizen working as a boutique manager aboard the Muse, sued both her employer, International Cruise Shops Ltd., and Silversea Cruises Ltd. under the Jones Act and general maritime law. She alleged a severe knee injury (ruptured ligament, dislocated kneecap, torn cartilage) after slipping on a gangway in Australia on November 15, 2024. The friction strips, she said, were “eroded and gone” and no warning signs had been posted. The complaint added that ship security acknowledged the worn strips after other passengers slipped on the same gangway that day, that repairs were not made for another two days, that she was made to keep working for weeks, and that medical staff delayed her surgery until December 23, 2024. The case, No. 1:26-cv-21258-KMM, was filed in the Southern District of Florida and remained active in mid-2026.12Holzberg Legal. How a Case Actually Moves
A Silversea injury case generally runs along the same track. An attorney reviews the ticket contract to pin down the deadlines, venue, and any liability limits. Written notice of the claim goes to the cruise line within six months. If the matter proceeds, the complaint is filed in the Southern District of Florida laying out the allegations and damages. Both sides then exchange documents, take depositions, and develop expert reports in discovery. Many cases settle before trial, often during court-ordered mediation. If they do not, they go to the bench or, in the narrower circumstances described above, to a jury.
Maritime attorneys handling these claims almost always work on contingency, meaning no fee upfront. The firm advances costs and takes a percentage of any recovery, typically 33% to 40%. If the case loses, the client owes no attorney fee, though some agreements still require repayment of out-of-pocket costs such as expert witness fees.
Because the six-month notice window closes faster than most people realize, the single most useful step after a serious injury on a Silversea ship is to get a maritime attorney reviewing your ticket contract early, long before the one-year filing deadline comes into view.
