Simmons BIPA Settlement: Payment Timing, Amounts, and Eligibility

The Simmons BIPA settlement is a $47.5 million class action resolution with Motorola Solutions and its subsidiary Vigilant Solutions over the FaceSearch facial recognition tool. Approved claimants were estimated to receive between $200 and $550 each, and the settlement administrator scheduled payments to be sent out on February 6, 2026.¹²

When Payments Are Being Sent

After Judge Joel Chupack granted final approval on August 20, 2025, the settlement administrator finalized award amounts and set February 6, 2026 as the payment issue date.¹³

Cash the check quickly. Settlement checks expire and become void 90 days after issuance. Any uncashed funds will be donated to a court-approved cy pres recipient, as Illinois law requires.⁴

How Much Each Person Gets

Class counsel estimated individual payments in the $200 to $550 range.² The exact figure depends on how many valid claims were filed, because approved claimants split the net settlement fund in equal shares.

The net fund is what remains after several deductions come out of the $47.5 million total:

$16,150,000 in attorneys’ fees, costs, and expenses awarded to class counsel Loevy & Loevy, or 34% of the fund.⁵
$7,500 incentive awards to each of the two class representatives, Irene Simmons and Rodell Sanders.⁵

Who Qualifies as a Class Member

The settlement class covers every person whose face appeared in an image processed by FaceSearch at any time through April 9, 2025, so long as the person was an Illinois resident or was physically present in Illinois when the image was taken or processed.⁴ That includes people whose images sat in booking photo databases and people whose images were used to train or test the FaceSearch system.⁵

Class membership alone does not produce a payment. Only people who submitted a valid claim by the deadline are in line to receive money.

What the Lawsuit Was About

Plaintiffs Irene Simmons and Rodell Sanders sued Motorola Solutions and Vigilant Solutions in 2020, alleging violations of the Illinois Biometric Information Privacy Act.⁴ The claims focused on FaceSearch, a facial recognition tool marketed to law enforcement as an affordable way to search databases of police booking photos.² According to the complaint, images of Illinois residents were collected, stored, used, and disclosed through FaceSearch without the disclosure, informed consent, retention, and deletion protections BIPA requires.

Motorola and Vigilant denied any wrongdoing and said they entered the settlement to avoid the cost and uncertainty of further litigation.³ The case was dismissed with prejudice on final approval, so the claims cannot be refiled.⁵

Key Dates Already Passed

The main deadlines for participating in the settlement are closed:

April 9, 2025: Preliminary approval granted.
July 8, 2025: Deadline to opt out of the class or file objections.
July 29, 2025: Deadline to submit claims. The online claims portal at SimmonsBIPASettlement.com has since closed.⁶
August 20, 2025: Final approval hearing at the Richard J. Daley Center in Chicago, where Judge Chupack found the settlement fair, reasonable, and adequate and overruled all objections.⁵

If you did not file a claim by July 29, 2025, you are not eligible for a payment even if your image was processed through FaceSearch.
