Sodexo, the French food services and facilities management giant, has been the defendant in a long run of U.S. lawsuits over the past two decades, and the Sodexo lawsuits on record cover racial discrimination, government contract fraud, food safety, wage theft, employee benefits, data security, and disability accommodation. Several produced settlements in the tens of millions and forced changes to how the company operates. Others are still working their way through the courts.
The $80 Million Racial Discrimination Class Action
The largest case against Sodexo was a class action filed in 2001 in the U.S. District Court for the District of Columbia, McReynolds v. Sodexho Marriott Services, Inc. African-American employees alleged the company systematically denied them promotions into upper management.1Civil Rights Litigation Clearinghouse. McReynolds v. Sodexho Marriott Services, Inc.
The plaintiffs said managerial jobs were often filled without postings, that white decision-makers used subjective criteria and pre-selection, and that Black managers were steered into what the company internally called “Black accounts,” including contracts at historically Black colleges, where the path into broader leadership was narrow.2NBC News. Sodexho Settles Bias Lawsuit for $80M
The class covered roughly 3,400 Black mid-level managers employed between 1998 and 2004. On April 27, 2005, days before jury selection, Sodexo agreed to pay $80 million.3The Washington Post. $80 Million Settles Race Bias Case4JURIST. Sodexho Settles Racial Discrimination
The settlement also required Sodexo to rebuild its promotion process around objective, structured criteria, to run anti-discrimination training, to launch a supplier diversity initiative, and to accept an independent compliance panel jointly appointed by the plaintiffs and the company.1Civil Rights Litigation Clearinghouse. New York School Lunch Rebate Fraud
On July 21, 2010, Sodexo paid $20 million to resolve allegations that it defrauded New York public programs by secretly pocketing vendor rebates. The New York Attorney General’s office called it the largest New York State False Claims Act settlement outside the Medicaid context at the time.6Grist. Sodexo to Pay New York $20 Million for Fraud
Sodexo held food service contracts with 21 public school districts and the State University of New York. Those contracts and federal rules required the company to pass vendor rebates back to the schools. Investigators found that starting in 2004 and continuing for five years, Sodexo instead pressed vendors for off-invoice rebates and kept the money.7FalseClaimsAct.com. The case grew out of a 2006 whistleblower complaint by former Sodexo employees John and Jay Carciero, who filed under both the federal False Claims Act and New York state law. The brothers received $3.6 million of the settlement.6Grist. Sodexo to Pay New York $20 Million for Fraud
E. Coli Outbreak at Marine Corps Bases
In late October 2017, at least 302 Marine recruits at Marine Corps Recruit Depot San Diego and Camp Pendleton were sickened with E. coli. A CDC investigation traced the source to undercooked ground beef in dining facilities managed by Sodexo.8Marine Corps Times. Third Former Marine Recruit Sues Food Company Alleging Brain and Kidney Damage
Three former recruits — Tristan Abbott, Vincent Grano, and Michael Baker Jr. — filed federal lawsuits against Sodexo in 2018. Each said the contaminated food caused severe illness, hospitalization, and lasting damage including brain and kidney injury, and each was medically discharged from the Marine Corps. A Sodexo spokesperson said the CDC report “did not conclusively determine or identify the source of the E. coli.” The cases were later settled to cover lost wages, medical expenses, and future care, with amounts not disclosed.8Marine Corps Times. Kronos Ransomware Payroll Suit
When the Kronos timekeeping system was knocked offline by a December 2021 ransomware attack, Sodexo’s payroll was disrupted for weeks. Smith v. Sodexo, Inc., filed in the U.S. District Court for the District of Maryland, alleged that non-exempt employees went unpaid or were paid late from December 2021 through March 2022. The court-approved settlement covered employees in 14 states and offered payments for underpayment, late payment, and state-specific penalties. The opt-in deadline for eligible employees was December 27, 2024. The aggregate amount was not published in the settlement notice.12ILYM Group. Smith v. Sodexo Settlement Notice
Anaheim Living Wage Class Action
Sodexo was a co-defendant with the Walt Disney Company in a California state court class action alleging workers at Disney theme parks and hotels in Anaheim were paid less than the city’s living wage ordinance required under Anaheim Municipal Code Chapter 6.99. The Sodexo subclass included 547 nonexempt current and former employees who worked at the Disney properties from January 2019 onward. A California judge granted final approval of the combined Disney and Sodexo settlements in October 2025, with the overall package totaling $234.75 million. Sodexo’s share was $1.75 million, with a net anticipated payout of roughly $1.31 million after fees and costs. Payments to class members began in December 2025.13Sodexo Living Wage Case. Platt v. Sodexo and the Tobacco Surcharge
In 2022, Sodexo employee Robert Platt filed a class action in California federal court challenging a monthly tobacco surcharge on the company’s health insurance. Platt alleged the surcharge violated the Employee Retirement Income Security Act because it was discriminatory, lacked a “reasonable alternative standard,” and let Sodexo use the surcharge money to offset its own required contributions to the plan, which he said was a breach of fiduciary duty.16U.S. Court of Appeals for the Ninth Circuit. Platt v. Sodexo, S.A., No. 23-55737
The case turned into a fight over arbitration. In 2021, Sodexo had unilaterally added an arbitration clause to the plan that also forbade representative or class actions. When Sodexo moved to compel arbitration, Platt said he never agreed.
On August 4, 2025, the Ninth Circuit split the question. On Platt’s individual claims seeking recovery of losses for plan participants, the court held an employer cannot unilaterally add an arbitration clause to an ERISA plan without the participant’s consent, and it affirmed the lower court’s refusal to compel arbitration. On the breach-of-fiduciary-duty claim brought on behalf of the plan itself, the court found the plan had consented through its governing documents, which gave Sodexo broad amendment authority.16U.S. Court of Appeals for the Ninth Circuit. Platt v. Sodexo, S.A., No. 23-55737
The court also held that the plan’s ban on representative actions was unenforceable under the “effective vindication” doctrine. Because ERISA lets participants sue on behalf of an entire plan, stripping that representative capacity would eliminate a remedy Congress authorized. The U.S. Department of Labor filed an amicus brief backing that reading, calling a representative action waiver under ERISA an invalid waiver of a substantive statutory right rather than a procedural rule. The holding aligned with rulings from five other federal circuits. The case was sent back to the district court to work out remaining questions about unconscionability and severability.17U.S. Department of Labor. Platt v. 2025 Employee Data Breach Class Action
On April 24, 2025, a former employee filed a proposed class action in the U.S. District Court for the District of Maryland alleging Sodexo failed to protect current and former employees’ personal information from a cyberattack. The complaint says a hacker group pulled hundreds of gigabytes of employee data, including Social Security numbers collected during hiring, and later posted the data online. The proposed class covers current and former Sodexo employees. As of mid-2025, the case was in its early stages with no reported response from Sodexo.18Bloomberg Law. 2026 Disability Discrimination Suit
In April 2026, former HVAC technician Michael Corona sued Sodexo in the U.S. District Court for the District of Kansas, alleging disability discrimination, failure to accommodate, retaliation, and retaliatory discharge. Corona says the company applied a blanket policy capping modified-duty assignments at 90 days. He alleges that in December 2024, with modified work still available, Sodexo pulled his accommodation and forced him onto medical leave without the interactive process the Americans with Disabilities Act requires. He was terminated in April 2025 during a restructuring, though he says he had more tenure, experience, and certifications than retained employees. The complaint cites disparaging remarks by his operations director about his medical restrictions. The case is pending, and Sodexo had not yet responded.19HCAMag.
