Sovereign Citizens: Beliefs, Tactics, and Legal Penalties

Sovereign citizens are Americans who believe they can declare themselves exempt from federal and state law, and the FBI classifies them as domestic extremists. Adherents number in the hundreds of thousands and come from every background. Their legal theories have never succeeded in any court, and acting on them routinely produces fines, felony charges, and prison sentences.1FBI. The Sovereign Citizen Movement

What Sovereign Citizens Believe

The Strawman

The foundational claim is that every person exists as two separate entities. One is the flesh-and-blood human. The other is a corporate shell adherents call the “strawman,” which they say the government created the moment a birth certificate was issued. Under this theory, the government uses the strawman to assign debts, taxes, and legal obligations to the real person. Believers signal the supposed distinction by writing their names in all capital letters on legal documents, insisting the capitalized version refers only to the corporate entity.

A birth certificate is a record of a biological event. It is not a financial account and does not create a corporate entity. The FBI has classified the broader “redemption” scheme built on the strawman theory as a common form of bond fraud.1FBI. The Sovereign Citizen Movement

Maritime Law and the Government as Corporation

Sovereign citizens also divide law into two systems. “Common law,” they say, governs free people. “Admiralty” or “maritime law” applies to commercial activity and international waters. They argue that the United States stopped being a legitimate public body and became a private corporation when it abandoned the gold standard in 1933, so statutes are merely corporate policies that bind only people who have consented to be governed. Consent, they say, can be revoked at will. The gold fringe on a courtroom flag, which adherents treat as proof of admiralty jurisdiction, is a decorative feature with no legal meaning.

None of this has a basis in law. The Supremacy Clause of the Constitution makes federal law “the supreme Law of the Land” binding on every judge in every state.2Congress.gov. U.S. Constitution – Article VI No one opts out by withdrawing consent, and no court recognizes the common-law-versus-admiralty split sovereign citizens describe.

What Sovereign Citizens Do

Self-Made Documents and Filings

Sovereign citizens produce a steady stream of self-created paperwork. A “Declaration of Sovereignty” is meant to notify the government that the person no longer considers themselves a citizen. UCC-1 financing statements, filed through the Uniform Commercial Code, are used to place a supposed lien on the person’s own name, treating their identity as private property the government cannot use without permission. These documents go to secretary of state offices and county recorders. They have zero effect on citizenship, tax obligations, or legal status, and courts treat them as legally meaningless at best and evidence of fraud at worst.

Homemade license plates and ID cards are common. Plates often read “traveler” instead of displaying a state registration, reflecting the belief that driving for personal purposes is not a regulated activity. The ID cards mimic the layout of government documents but carry dense legalistic text about the bearer’s sovereignty in place of real security features. Using them during a traffic stop almost always escalates a routine encounter into an arrest.

Traffic Stops

The traffic stop is the most common flashpoint. Sovereign citizens refuse to produce a driver’s license, arguing they are “traveling” in a private capacity rather than “driving” commercially, and that the right to travel cannot be regulated. Courts have consistently held that while a constitutional right to interstate travel exists, operating a motor vehicle on public roads is a regulated privilege. States require licenses, registration, and insurance for anyone behind the wheel, and refusing to produce a license during a lawful stop typically ends in arrest.

Courtroom Tactics

In court, sovereign citizens deploy a familiar toolkit. Some refuse to cross the wooden railing, claiming it marks a separate jurisdiction. Others demand to see the judge’s oath of office, ask whether the court operates under admiralty law, or challenge the court’s jurisdiction over their “flesh and blood” person. A frequent move is presenting a “fee schedule” that purports to charge the court exorbitant sums for every minute of the defendant’s time or for any “unauthorized use” of their name. Judges see all of this constantly. The result is almost always a contempt finding, sanctions, or a default judgment.

The Redemption Scheme and Fake Financial Instruments

The redemption theory takes the strawman belief into active financial fraud. Adherents claim that when the government created the strawman, it also opened a secret Treasury account in the person’s name worth hundreds of thousands or millions of dollars. They believe they can draw on that account to pay off mortgages, credit cards, and taxes.

To do it, they create fake financial instruments they call “sight drafts,” “bills of exchange,” or “bonded promissory notes,” and present them to banks, creditors, and government agencies as if they were legitimate payments. The Department of the Treasury has stated that drawing such drafts on the U.S. Treasury “is fraudulent and a violation of federal law” and that the Justice Department “is vigorously prosecuting these crimes.”3TreasuryDirect. Bogus Sight Drafts / Bills of Exchange Drawn on the Treasury Federal law makes it a felony to create or pass any fictitious financial instrument that purports to be issued under government authority.4Office of the Law Revision Counsel. 18 U.S. Code 514 – Fictitious Obligations The accounts don’t exist, the debts remain fully enforceable, and the attempt creates a paper trail that leads directly to prosecution.

Why the Arguments Fail in Court

No federal or state court has ever accepted a sovereign citizen legal theory. The Supremacy Clause makes federal law binding on everyone within the country’s borders regardless of personal beliefs about consent or corporate governance.2Congress.gov. U.S. Constitution – Article VI American law contains no mechanism by which an individual can unilaterally declare themselves exempt from it.

The Seventh Circuit captured the judicial view in United States v. Sloan. Sloan, who described himself as a “freeborn, natural individual” and a citizen only of Indiana, argued he was not subject to federal jurisdiction. The court ruled that “all individuals, natural or unnatural, must pay federal income tax on their wages” regardless of whether they requested or exercised any privilege from the government.5Justia Law. United States of America v. Lorin G. Sloan The court compared tax protesters to moths drawn to a flame, noting that “these people sometimes get burned.” Sloan was sentenced to four months in federal prison. The strawman distinction fares no better. Writing your name in capital letters on a court filing changes nothing about your legal obligations.

The Legal Penalties

Frivolous Tax Filings

The IRS imposes a $5,000 penalty on anyone who files a tax return based on a position the agency has identified as frivolous, or that reflects an intent to delay federal tax administration.6Office of the Law Revision Counsel. 26 U.S. Code 6702 – Frivolous Tax Submissions Sovereign citizen arguments appear on the IRS’s frivolous positions list by name, including the claim that a taxpayer’s income is excluded from taxation because they have “renounced United States citizenship” and consider themselves a citizen exclusively of a state.7Internal Revenue Service. IRS Notice 2010-33 – Frivolous Positions The same $5,000 penalty applies to frivolous submissions like collection due process hearing requests. The IRS gives a 30-day window to withdraw a frivolous submission before the penalty attaches.

Beyond penalties, the IRS can levy wages, seize bank accounts, and sell real estate, vehicles, and other personal property to satisfy unpaid taxes.8Internal Revenue Service. Levy Sovereign citizens who stop filing and paying don’t disappear from the tax system. They become targets of it.

Paper Terrorism

Filing fraudulent liens against public officials who have crossed them is one of the most damaging sovereign citizen tactics. Judges, prosecutors, police officers, and clerks have all been targeted. The bogus liens attach to property records and can disrupt the victim’s credit and ability to sell property, even though the liens are legally baseless. Federal law makes it a crime to file a false lien against a federal official on account of their official duties, with a penalty of up to 10 years in federal prison.9Office of the Law Revision Counsel. 18 U.S. Code 1521 – Retaliating Against a Federal Judge or Federal Law Enforcement Officer Many states have passed their own paper terrorism statutes imposing additional criminal penalties and giving victims expedited processes for removing fraudulent filings.

Passport Fraud

Some sovereign citizens attempt to travel internationally using homemade passports or documents from organizations with no governmental authority, such as the World Service Authority’s “World Passport.” No developed country recognizes these documents for entry. Presenting a forged or fictitious passport is a federal crime carrying up to 10 years in prison for a first or second offense, climbing to 20 years if connected to drug trafficking and 25 years if connected to international terrorism.10Office of the Law Revision Counsel. 18 U.S. Code 1543 – Forgery or False Use of Passport Similar penalties apply to fraud involving visas, border crossing cards, and other immigration documents.11Office of the Law Revision Counsel. 18 U.S. Code 1546 – Fraud and Misuse of Visas, Permits, and Other Documents

Fictitious Financial Instruments

Creating or presenting fake sight drafts, bonds, or promissory notes that claim to be backed by the U.S. Treasury is a federal felony.4Office of the Law Revision Counsel. 18 U.S. Code 514 – Fictitious Obligations The Secret Service investigates these offenses alongside other federal agencies. People who try to discharge a mortgage or car loan with these instruments face prosecution, and the original debt remains fully enforceable on top of whatever criminal sentence follows.

The Violence Risk

Sovereign citizen ideology is more than a legal nuisance. Since 2000, sovereign citizen extremists acting alone have killed six law enforcement officers in the United States. During a 2010 traffic stop in Arkansas, 16-year-old Joseph Kane opened fire on two police officers with an AK-47, killing both. His father, Jerry Kane, had been a prominent figure in the redemption movement, traveling the country teaching people how to use bogus financial instruments. In New Hampshire, a husband and wife convicted of tax evasion and conspiracy fraud barricaded themselves in their home for months with pipe bombs, improvised explosive devices, and a cache of rifles including .50-caliber weapons.12FBI. Sovereign Citizens: A Growing Domestic Threat to Law Enforcement

The pattern across every sovereign citizen encounter is consistent. The theories sound elaborate enough to seem plausible to someone unfamiliar with the law, and they collapse on contact with an actual courtroom. No one has ever successfully used these arguments to avoid taxes, escape a traffic ticket, or discharge a debt. The only guaranteed outcome is a worse legal situation than the one the person started with.
