The Speed UTV lawsuit drawing the most attention is a federal patent infringement case brought by TAPP MFG, Inc., which in March 2026 won a preliminary injunction barring Speed UTV from making or selling the CVT clutch components at the heart of its drivetrain. A second suit, a maritime shipping contract dispute filed by Orient Express Container Co., was dismissed by stipulation in January 2026. Both landed on a company that has spent years struggling to deliver vehicles to customers who paid deposits as far back as 2019.
The TAPP MFG Patent Infringement Case
TAPP MFG, a British Columbia manufacturer of CVT clutch systems for UTVs and snowmobiles, sued Speed UTV on November 13, 2024 in the U.S. District Court for the Middle District of North Carolina. The two companies had a licensing relationship. On November 4, 2020, TAPP granted Speed UTV the right to use its CVT primary clutch technology in Speed UTV’s vehicles. The patent at issue is U.S. Patent No. 12,104,695, “CVT Primary Clutch for Off-Road Vehicles,” which issued on October 1, 2024. What the Preliminary Injunction Blocks
In March 2026 the court granted TAPP’s motion for a preliminary injunction. The court found TAPP had shown a likelihood of success on the merits of its infringement claims and that it would suffer irreparable harm if Speed UTV continued its conduct. That is a serious operational constraint. The enjoined clutch is a core drivetrain component, so unless Speed UTV sources or engineers a replacement, the ruling reaches directly into its ability to build vehicles. The Orient Express Maritime Suit (Dismissed)
Orient Express Container Co., Ltd. sued Speed UTV on August 5, 2024 in the U.S. District Court for the Central District of California. Filed under maritime and shipping law, it was a contract dispute over cargo carried in ten marine shipping containers. The complaint named Speed UTV both in personam and in rem against the cargo itself. The public docket described the nature of suit as “Contract – Marine” but did not lay out the underlying facts in detail; the in rem posture against shipping containers is consistent with a dispute over unpaid shipping or container charges. What It Means for Customers Waiting on Vehicles
Speed UTV began taking pre-orders in 2019 and by March 2021 reported more than 2,700 units on order, roughly 80 percent of them the El Jefe four-seater.5UTV Driver. Against that history, the TAPP injunction is what matters most. The Orient Express matter is over. But a court order preventing Speed UTV from building with its CVT clutch technology, layered onto a delivery record that customers and industry outlets already describe as opaque, is the piece of the legal picture most likely to affect anyone still holding an unfilled order.
