Streaming Settlement: Who Qualifies, Payout Amounts, and Claim Status

The Tubi settlement is a $19.99 million class action resolution in Gregory v. Tubi, Inc., resolving claims that the free streaming service shared users’ viewing information with third-party advertisers in violation of the federal Video Privacy Protection Act. If you used Tubi between June 23, 2021 and August 26, 2024 and filed a valid claim by the November 28, 2024 deadline, you’re in line for a pro rata share of what remains of the fund after fees and costs. Payments are in progress: the settlement administrator announced in October 2025 that failed digital payments are being reissued by check.1Video Streaming Settlement. Gregory v. Tubi, Inc. How Much Each Claimant Gets

Tubi funded a $19,990,000 common fund.2Simpluris. Notice of Proposed Class Action Settlement Several things come out of that fund before class members are paid:

  • Attorneys’ fees and expenses, with class counsel at McGuire Law requesting up to 35% of the fund.
  • A requested $5,000 service award for the named plaintiff, Jacqueline Gregory.
  • Administration costs for notice, claim processing, and distribution.

Whatever is left is divided equally among all valid claimants on a pro rata basis. The per-person payout therefore depends on the total number of valid claims filed, and that number has not been publicly disclosed.2Simpluris. Notice of Proposed Class Action Settlement

Where Payments Stand

The fairness hearing was held on December 4, 2024, and continued to January 8, 2025, with the motion for final approval taken under advisement.1Video Streaming Settlement. Gregory v. Tubi, Inc. In October 2025, the settlement website posted an update saying that claimants who chose a digital payment and could not successfully receive their funds would have their payment reissued by check.1Video Streaming Settlement. If you selected a digital payment option and nothing arrived, a paper check should follow.

What the Lawsuit Was About

The claims rest on the Video Privacy Protection Act, a federal law originally written in the late 1980s to protect VHS rental records but now applied to digital streaming. Named plaintiff Jacqueline Gregory alleged that Tubi disclosed “personally identifiable information” of its users to third parties for targeted advertising without the consent the VPPA requires.2Simpluris. Tubi denied violating the VPPA, denied any wrongdoing, and maintained that neither the plaintiff nor any class members were entitled to recover anything. The settlement agreement states it is “not an admission of wrongdoing by Tubi.”2Simpluris. Notice of Proposed Class Action Settlement

The Opt-Out Arbitration Dispute

If you’ve read about a separate fight over Tubi arbitrations, that is a parallel track and does not affect the class settlement payments. Nearly 24,000 class members opted out of the $19.99 million deal and were represented by the firm Keller Postman, which filed individual arbitration demands alleging violations of a California law prohibiting the use of age and gender in targeted advertising.4Law.com. Tubi sued Keller Postman in federal court in June 2024, accusing the firm of inducing subscribers to file manufactured arbitration claims; Keller Postman denied the allegations and called the suit a tactical attempt at intimidation. The two sides reached a deal in September 2025 to resolve the underlying arbitration claims, and Tubi voluntarily dismissed its federal suit in November 2025. According to Keller Postman’s Warren Postman, “no money was exchanged” between the firm and Tubi to end the federal case, though the financial terms of the arbitration resolution were not disclosed.7Reuters.
