What the Extended Warranty Pays For
Effective July 29, 2025, Subaru extended its New Vehicle Limited Warranty on covered vehicles to pay 75% of the cost of a qualifying EyeSight repair. You pay the remaining 25%. A covered repair is one that fixes or replaces a diagnosed malfunction in Pre-Collision Braking, Rear Automatic Braking, or Lane Keep Assist caused by a failure of the EyeSight camera assembly or the rear sonar sensors. Here is the catch for older vehicles. If your four-year or 48,000-mile window had already expired by July 29, 2025, Subaru added a four-month grace period that ran through November 29, 2025. Reimbursement for Past Repairs Is Closed
Class members who paid out of pocket for a qualifying EyeSight repair before July 29, 2025 could claim 75% of the invoice cost for one such repair, so long as it fell within the four-year or 48,000-mile window from the vehicle’s in-service date. The claim deadline was September 27, 2025, and no new claims can be filed.6EyeSightSettlement.com. What the Lawsuit Alleged
The case, Sampson, et al. v. Subaru of America, Inc., was filed in April 2021 in the U.S. District Court for the District of New Jersey. The plaintiffs alleged that the EyeSight camera assembly and rear sonar sensors caused emergency braking to activate when nothing was in front of the vehicle and, conversely, to fail to activate when a pedestrian or stopped vehicle was in the car’s path. Newer Subarus Aren’t in This Settlement
If you own a 2022–2026 Subaru and have had similar EyeSight problems, the Sampson settlement doesn’t apply to you. A separate class action, Hall et al. v. Subaru of America, Inc. (Case No. 1:26-cv-05266), was filed in May 2026 in the same New Jersey federal court. It targets 2022–2026 model year vehicles and alleges that the automatic emergency braking system causes sudden, forceful braking without driver input or any real obstacle, while also failing to activate in actual emergencies.8The Brake Report. The Hall complaint references more than 25 NHTSA consumer complaints, including a highway braking event at 65 mph that led to a rear-end collision and an unwanted deceleration from 40 mph to 15 mph. The plaintiffs, represented by Ahdoot & Wolfson, PC and the Murphy Law Firm, argue that the persistence of the problem in current models shows Subaru failed to implement effective fixes after the Sampson case. Because the claim window has closed, any message telling you to file a new reimbursement claim now should be treated as suspect. The only remaining benefit is the extended warranty, and it applies automatically to covered vehicles still inside the time and mileage limits.
