The Extended Warranty You Can Still Use
Subaru extended its New Vehicle Limited Warranty to cover qualifying windshield cracks for eight years or 100,000 miles from the vehicle’s in-service date, whichever comes first. Coverage is a one-time replacement of the original windshield with glass made under a revised manufacturing process. You don’t need to file a claim or submit anything in advance. If a qualifying crack appears, take the vehicle to an authorized Subaru dealer. For claimants who filed on time, Tier 1 required proof of repair costs plus photos of the windshield damage and paid at least 125 percent of out-of-pocket expenses with no dollar cap. What the Lawsuit Alleged
Plaintiffs claimed the affected windshields contained “residual stress” from manufacturing, meaning internal tension in the glass that made it vulnerable to cracking from minor impacts. Owners reported windshields cracking while parked, while driving with no debris present, or after activating the defroster. Subaru denied wrongdoing. The company said its windshields met federal safety standards, that the glass varied by model and manufacturer and could not be collectively defective, and that warranty terms did not cover damage from external impacts.6CarComplaints.com. What You Give Up by Staying In
If you’re a class member and did not opt out by the February 15, 2025 deadline, you released Subaru and related parties from any claims arising from a qualifying windshield crack on your covered vehicle. That means you cannot bring a separate lawsuit or arbitration over the same issue. Not the Same as the EyeSight Settlement
A separate Subaru class action, Sampson v. Subaru of America, Inc., addressed alleged defects in the EyeSight driver-assistance system itself, including Pre-Collision Braking, Rear Automatic Braking, and Lane Keep Assist.
