How Investigators Found Out

Suzanne had suspected Barry of cheating on her. To catch him, she bought a voice-activated “spy pen” and placed it in her closet. The pen never recorded Barry with another woman. The pen recordings gave the FBI a voice but not a name. Agents spent six months identifying the man on the audio as Libler. Once he realized investigators were closing in, Libler deleted his social media accounts, later saying he “didn’t want it to be her legacy.” He then cooperated fully, giving investigators his DNA, phone records, and account passwords. What Suzanne Was Saying About Her Marriage

Court documents unsealed in June 2023 showed that Suzanne was preparing to leave Barry, and that the affair was one part of a bigger story. To Oliver, Suzanne described Barry as “not stable,” a “Jekyll and Hyde” who would “blow up” over small issues and disappear. On May 6, 2020, four days before she disappeared, Suzanne sent Barry a message: “I’m done. I could care less what you’re up to and have been for years. The affair sits at the center of the prosecution’s motive theory. The arrest affidavit filed against Barry alleged he “could not control Suzanne’s insistence on leaving him” and “resorted to something he has done his entire life — hunt and control Suzanne like he had hunted and controlled animals.”1CBS News. Barry is a former deer farmer who had access to a wildlife tranquilizer known as BAM — a combination of butorphanol, azaperone, and medetomidine used to sedate large animals for antler removal or transport. When Suzanne’s remains were recovered in September 2023 in a shallow grave near Moffat in Saguache County, the autopsy detected all three components of BAM in her bone marrow. Prosecutors have paired the drug evidence with additional findings inside the Morphew home: a tranquilizer rifle, darts with capped needles in a gun safe, a plastic needle cap in the family’s clothes dryer, and a crack in the master bedroom door frame that prosecutors say came from Barry chasing Suzanne after a dart struck her. Where the Criminal Case Stands

Barry Morphew was first arrested and charged with first-degree murder in May 2021, but prosecutors moved to dismiss the case in April 2022, two weeks before trial.
