Tanner Horner Death Penalty: Plea, Sentence, and Appeal

Tanner Lynn Horner received the death penalty on May 5, 2026, when a Tarrant County jury sentenced him to execution by lethal injection for the kidnapping and murder of seven-year-old Athena Strand. Horner, a 31-year-old FedEx contract delivery driver at the time of the November 2022 crime, had pleaded guilty weeks earlier to capital murder and aggravated kidnapping, leaving the jury to decide only between death and life without parole. After 19 days of penalty-phase testimony, jurors deliberated for roughly two and a half hours before choosing death.¹²

What Horner Did

Athena Strand was last seen at her home in Paradise, Texas, at about 5:30 p.m. on November 30, 2022. Horner had just delivered a package of Barbie dolls to the Strand home when he abducted her. Cameras and audio inside his delivery van captured what happened next.³⁴

Video showed Athena following Horner to the van and peering inside before he picked her up and placed her in the vehicle. An hour-plus audio recording captured her asking “Are you a kidnapper?” and calling for her mother. Horner told her she was pretty, threatened to hurt her if she screamed, and told her to remove her shirt.⁵

The Chief Medical Examiner, Dr. Jessica Dwyer, determined that Athena died from blunt force injuries combined with smothering and strangulation. The autopsy found multiple blunt force injuries from her chest to the top of her head, along with a zigzag tread pattern on her face that matched the sole of Horner’s shoe. Horner later told a psychiatrist he had tried to snap the child’s neck and, when that failed, strangled her repeatedly. Her body was found two days later at Bobo’s Crossing, roughly nine to fifteen miles from her home.⁶⁷

Horner was arrested two days after the abduction. Texas Ranger Job Espinoza eventually got him to lead investigators to the body by addressing him as “Zero,” the name Horner gave to what he described as a violent alter ego.⁸

The Guilty Plea That Shortened the Trial

Horner was indicted on February 16, 2023, for capital murder of a person under the age of ten and aggravated kidnapping. The next day, Wise County District Attorney James Stainton filed notice that the state would seek death. Because of extensive local media coverage, the case was moved to Tarrant County, where Judge George Gallagher presided.⁹¹⁰

Horner initially pleaded not guilty. On April 7, 2026, after the jury had been seated and a full capital trial was about to begin, he changed his plea to guilty on both counts. That decision eliminated the guilt phase entirely. The trial proceeded straight to sentencing, where the same jury would decide between death and life without parole.¹¹

Why the Jury Chose Death

Under Texas capital sentencing law, jurors had to answer two questions unanimously to impose a death sentence: whether Horner would be a continuing threat to society, and whether any mitigating circumstances justified life over death. Prosecutors spent 19 days building the case that the answers were yes and no.¹²

The centerpiece was the recording from Horner’s delivery van, played for jurors on April 16, 2026. The judge cleared cameras from the courtroom, Athena’s parents chose not to be present, and several jurors were seen crying as it played.¹³

Forensic evidence included DNA from a sexual assault kit that could not exclude Horner, male DNA under Athena’s fingernails, and biological evidence on his clothing. Digital examiners showed the jury his post-crime internet searches, which included “Paradise missing girl” and “Do FedEx truck cameras constantly record?” Texas Ranger Espinoza testified that Horner had used a sticky note to cover the van’s interior camera on multiple days leading up to the crime, including November 26, 29, and 30, evidence the prosecution used to argue planning.¹⁴⁵

To show a pattern, the prosecution called two women who testified Horner had sexually assaulted them as minors, including one who said she was 14 when she woke to find him assaulting her. A late rebuttal witness, a man raised as Horner’s cousin, testified that Horner had sexually assaulted him twice during childhood and had later mentioned wondering “what it would be like to kill someone.” Horner also faced three pending counts of sexual assault of a child under 17 from alleged incidents in 2013, filed in Tarrant County after his arrest for Athena’s murder.¹⁴¹⁵¹⁶

Forensic psychiatrist Dr. Michael Arambula testified that Horner showed evidence of sexual deviance and sadism and would be a future danger. A director from the Texas Department of Criminal Justice testified he would remain dangerous even in prison. DA Stainton called Horner a “true predator” capable of “maximum violence.” Athena’s mother, Maitlyn Gandy, testified about her final moments with her daughter.⁷

What the Defense Argued for Life

Horner’s defense team, led by Susan Anderson of the Regional Public Defenders’ Office, asked for life without parole and built its case around mental health and upbringing. Experts testified Horner had been diagnosed with autism spectrum disorder, ADHD, PTSD, bipolar disorder, generalized anxiety, and fetal alcohol spectrum disorder. His mother testified she used alcohol, cigarettes, and marijuana while pregnant. Dr. Aaron Specht testified that Horner’s bones held lead at levels 24 times higher than normal. Child development expert Dr. Jolie Brams described him as “remarkably impaired and extremely immature for adulthood.”⁷¹⁶

The defense described a childhood spent bouncing between schools, homes, caregivers, and rehab facilities, marked by bullying, domestic conflict, and sexual abuse Horner had suffered as a child. Attorney Steven Goble argued that the state had not proven Horner would remain dangerous in a controlled prison setting. The defense also framed the crime as unpremeditated, saying it “snowballed” after Horner took Athena because she had witnessed him using cocaine and he feared losing his job.¹⁷⁷

In January 2026, the defense filed a motion to bar the death penalty entirely, arguing that Horner’s autism reduced his moral culpability and that executing him would violate the Eighth Amendment. Judge Gallagher denied the motion but allowed the same information to be presented to the jury.¹⁸

The Sentence

The jury deliberated for slightly less than three hours before answering both Texas special issues against Horner: yes on future danger, no on sufficient mitigation. Judge Gallagher sentenced him to execution by lethal injection at the Huntsville Unit, on a date to be determined.¹²

Horner was received by the Texas Department of Criminal Justice on May 5, 2026, and is now housed at the Allan B. Polunsky Unit in West Livingston, which holds the state’s male death row population.¹⁹

After the verdict was read, Athena’s uncle, Elijah Strand, addressed Horner directly in a victim impact statement. “You did not just take a life, you destroyed a family,” he said. “You took a little girl who trusted the world and repaid that innocence with violence.” He added, “Her name will forever be remembered. Everyone will forget you.”²⁰

The Appeal and Timeline Ahead

A Texas death sentence triggers an automatic direct appeal to the Texas Court of Criminal Appeals, the state’s highest criminal court. Filings in Horner’s case were entered on May 6 and May 11, 2026, though they did not initially contain detailed arguments. Horner has also requested additional counsel for habeas corpus proceedings.²¹²²

After the direct appeal, a defendant may file a state habeas corpus application raising issues outside the trial record, such as claims of ineffective assistance of counsel. The Office of Capital and Forensic Writs is typically appointed within 30 days of judgment. If state courts deny relief, the case can move to federal habeas review in a U.S. District Court, then potentially to the U.S. Court of Appeals for the Fifth Circuit, and ultimately to the U.S. Supreme Court. Under Texas law, an execution date cannot be set sooner than 91 days after state relief is denied, and in practice dates are rarely set until federal proceedings are complete. The full process typically takes years.²⁰

The Civil Lawsuits Against FedEx

Separate from the criminal case, both of Athena’s parents have filed wrongful death lawsuits against Horner, FedEx Ground, and Big Topspin Inc., the Fort Worth-based independent service provider that employed Horner. Jacob Strand, Athena’s father, filed suit in December 2022 seeking damages in excess of $1 million. Maitlyn Gandy filed an amended 18-page complaint on February 17, 2023. The suits allege negligent hiring, training, and supervision.²³²⁴

Horner passed a third-party criminal background check before being hired because the 2013 sexual assault allegations against him had never resulted in a conviction. FedEx has denied liability, stating that Horner “was not acting as an agent of, nor was he in any course and scope of any employment of, FedEx Ground at the time of said criminal acts,” and noting that its more than 6,000 independent contracting businesses retain sole discretion over hiring. Big Topspin voluntarily dissolved on December 29, 2025, three months before Horner’s trial began.²⁵²⁴
