What the Cease-and-Desist Demanded
The letter from Swift’s legal team demanded West stop making the claims immediately and refrain from further posts of a similar nature. Why Swift Hasn’t Filed a Defamation Suit
A cease-and-desist is a demand letter, not a lawsuit. It puts the recipient on notice and preserves the sender’s options; it does not commence litigation. If Swift did file, she would need to clear the high evidentiary bar American law sets for public figures.

Sullivan, a public figure suing for defamation must prove “actual malice,” meaning the defendant either knew the statement was false or acted with reckless disregard for the truth.5Justia. Kim Kardashian then released edited Snapchat clips of a phone call between West and Swift in July 2016. The full unedited recording leaked in March 2020 and confirmed Swift had not been told about the “bitch” line.
